STATE AGENCIES - REAL PROPERTY PURCHASE - Adds to existing law to provide
that no state agency, department or institution shall purchase real
property that will be used for office space or building space, which
purchase will require a current or future appropriation, without an
affirmative vote of the Joint Finance-Appropriations Committee (JFAC); to
provide procedures for requests for lease of office space or building space
to be presented to JFAC; and to provide for a waiver provision in the event

  1                                        AN ACT
  2    RELATING TO STATE BUILDINGS; AMENDING CHAPTER 57, TITLE 67, IDAHO CODE, BY THE
  3        ADDITION OF A NEW SECTION 67-5711D, IDAHO CODE, TO PROVIDE THAT  NO  STATE
  4        AGENCY,  DEPARTMENT  OR INSTITUTION SHALL PURCHASE REAL PROPERTY THAT WILL
  5        BE USED FOR OFFICE SPACE OR BUILDING SPACE WHICH PURCHASE WILL  REQUIRE  A
  6        CURRENT  OR FUTURE FISCAL YEAR'S APPROPRIATION WITHOUT AN AFFIRMATIVE VOTE
  7        OF THE JOINT FINANCE-APPROPRIATIONS  COMMITTEE  ON  A  MOTION  DULY  MADE,
  8        ADOPTED AND RECORDED IN THE COMMITTEE'S MINUTES, TO PROVIDE PROCEDURES FOR
  9        REQUESTS  FOR  LEASE  OF OFFICE SPACE OR BUILDING SPACE TO BE PRESENTED TO
 10        THE JOINT FINANCE-APPROPRIATIONS COMMITTEE, AND TO PROVIDE  FOR  A  WAIVER
 11        PROVISION IN THE EVENT OF AN EMERGENCY OR DISASTER.
                                                                        
 12    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 13        SECTION  1.  That  Chapter  57,  Title 67, Idaho Code, be, and the same is
 14    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 15    ignated as Section 67-5711D, Idaho Code, and to read as follows:
                                                                        
 16        67-5711D.  STATE  AGENCIES PURCHASING, LEASING OR PROCURING REAL PROPERTY.
 17    Notwithstanding any other provision of law to the contrary, no  state  agency,
 18    department  or  institution shall purchase real property that will be used for
 19    office space or building space which purchase will require a current or future
 20    fiscal year's appropriation without an affirmative vote of the joint  finance-
 21    appropriations  committee  on  a motion duly made, adopted and recorded in the
 22    committee's minutes. Advance notice of requests for lease of office  space  or
 23    building  space  or  renewal of the lease shall be given to the joint finance-
 24    appropriations committee at either of the joint finance-appropriations commit-
 25    tee meetings held during the legislative interim or  at  the  budget  hearings
 26    during the regular sessions of the legislature. In the case of an emergency or
 27    disaster,  any state agency, department or institution, through the department
 28    of administration, may petition the governor, the president pro tempore of the
 29    senate and the speaker of the house of representatives to have the  provisions
 30    of  this  section waived. The signature of the governor, president pro tempore
 31    of the senate and the speaker of the house of  representatives  shall  be  all
 32    that is necessary for such waiver.

accountability for the decision to obtain office space 
back to elected officials.
