  1                                        AN ACT
  2    RELATING TO POWERS OF THE STATE DEPARTMENT OF  HEALTH  AND  WELFARE;  AMENDING
  3        SECTION  56-203,  IDAHO  CODE,  TO  AUTHORIZE  THE DEPARTMENT TO IMPLEMENT
  4        COPAYMENT AND OTHER REASONABLE COST-SHARING METHODS FOR MEDICAL ASSISTANCE
  5        PROGRAMS AND TO MAKE A TECHNICAL CORRECTION.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Section 56-203, Idaho Code, be, and the  same  is  hereby
  8    amended to read as follows:
                                                                        
  9        56-203.  POWERS  OF  STATE DEPARTMENT. The state department shall have the
 10    power to:
 11        (a)  Enter into contracts  and  agreements  with  the  federal  government
 12    through  its  appropriate agency or instrumentality whereby the state of Idaho
 13    shall receive federal grants-in-aid or other benefits for public assistance or
 14    public welfare purposes under any act or acts of congress heretofore or  here-
 15    after enacted;
 16        (b)  Cooperate with the federal government in carrying out the purposes of
 17    any  federal  acts pertaining to public assistance or welfare services, and in
 18    other matters of mutual concern;
 19        (c)  Cooperate with county governments and other  branches  of  government
 20    and  other agencies, public or private, in administering and furnishing public
 21    welfare services;
 22        (d)  Enter into reciprocal agreements with other states  relative  to  the
 23    provisions of public assistance and welfare services to residents and nonresi-
 24    dents;
 25        (e)  Initiate  and  administer  public  assistance and social services for
 26    persons physically or mentally handicapped;
 27        (f)  Establish such requirements of residence for public assistance  under
 28    this  act  as  may  be deemed advisable, subject to any limitations imposed in
 29    this act;
 30        (g)  Define persons entitled to medical assistance in such terms  as  will
 31    meet  requirements  for  federal financial participation in medical assistance
 32    payments;
 33        (h)  Accept the legal custody of children  committed  to  it  by  district
 34    courts  of  this  state  under the Child Protective Act, to provide protective
 35    supervision as defined therein, to place children for adoption when such chil-
 36    dren are in the legal custody of the state department and are  legally  avail-
 37    able for adoption and to exercise consent to adoption when the authority to do
 38    so  is  vested in the department by court order or legally authorized parental
 39    relinquishment;
 40        (i)  Determine the amount, duration and scope of care and services  to  be
 41    purchased as medical assistance on behalf of needy eligible individuals;
 42        (j)  Manage  and  operate  the  Idaho  state school and hospital at Nampa,
 43    Idaho;

  1        (k)  Implement reasonable copayments for medical assistance as allowed  by
  2    federal  law;  provided  that providers of services will retain all copayments
  3    they collect pursuant to this subsection and will not have their reimbursement
  4    for services reduced by the amount of the copayments;
  5        (l)  Implement other reasonable cost-sharing methods  for  medical  assis-
  6    tance as allowed by federal law.

Statement of Purpose / Fiscal Impact


               STATEMENT OF PURPOSE
                   RS 10537

During the 2000 session, the Legislature passed intent 
language for state fiscal year 2001 to implement cost 
sharing measures to the extent allowed by federal law 
for services funded by the Medicaid program.  After 
that period, the Department was to propose legislation 
to implement longer term cost control measures. The 
proposed legislation gives the Department of Health 
and Welfare ongoing authority to implement cost sharing 
measures for Medicaid services.

               FISCAL IMPACT

There is no fiscal impact from this proposed legislation.
