SPEAKER Requested by: Bureau of Occupational Licenses 1 AN ACT 2 RELATING TO THE BOARD OF SOCIAL WORK EXAMINERS; AMENDING SECTION 54-3209, 3 IDAHO CODE, TO INCREASE THE MAXIMUM FEE FOR SOCIAL WORK LICENSES; AND 4 AMENDING SECTION 54-3211, IDAHO CODE, TO PROVIDE THAT THE DEPARTMENT MAY 5 TAKE DISCIPLINARY ACTION OTHER THAN NONRENEWAL, SUSPENSION OR REVOCATION 6 OF A LICENSE FOR UNPROFESSIONAL CONDUCT AND TO MAKE TECHNICAL CORRECTIONS. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Section 54-3209, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 54-3209. FEES -- LICENSING -- DURATION OF LICENSES. Each person licensed 11 to practice social work shall pay to the treasurer of the state of Idaho a 12 license fee, not to exceedfiftyseventy-five dollars ($750.00) as determined 13 by the board, on July 1 of each year for the following fiscal year. Licenses 14 shall expire on the last day of the month of June following their issuance and 15 shall become invalid after that date. Renewal may be effected in accordance 16 with the requirements of section 67-2614, Idaho Code. 17 SECTION 2. That Section 54-3211, Idaho Code, be, and the same is hereby 18 amended to read as follows: 19 54-3211. REFUSAL TO RENEW, SUSPENSION OR REVOCATION OF LICENSE -- UNPRO- 20 FESSIONAL CONDUCT. Thedepartmentboard may refuse to renew, may suspend, or 21 may revoke any license issued under this act, or take other disciplinary 22 action, upon proof, after a hearing, that the person has engaged in 23 "unprofessional conduct." The words "unprofessional conduct" as relating to 24 persons licensed under this act are defined to include but are not limited to: 25 (1) Conviction of a felony, or of any offense involving moral turpitude. 26 (2) Habitual drunkenness or addiction to habit-forming drugs, either of 27 which impair the ability to perform his work without danger to himself or the 28 public he serves. 29 (3) Conviction of fraud or deceit in connection with services rendered as 30 a certified social worker or social worker, or in establishing qualifications 31 under this act. 32 (4) Aiding or abetting a person not licensed under this act or a person 33 representing himself as licensed in the practice of social work in the state 34 of Idaho. 35 (5) Failing to be licensed or continuing to represent himself as licensed 36 after the expiration of his license. 37 (6) Being found guilty of unprofessional conduct by the rules established 38 by the board.

STATEMENT OF PURPOSE RS 10482 The fee cap increase in this legislation will allow the board to increase fees by rule. Fee increases are necessary to generate additional funding for continued board operation and will prevent the board from incurring a deficit account. This legislation also allows the board the discretion to apply discipline other than the suspension or revocation of a license. This action is taken at the Deputy AG's suggestion which will allow the board to enter into consent agreements with licensees to assess fines and recover costs rather than being forced to go through the hearing process (which is more costly to both the board and the licensee; typically $5 - $50 thousand). FISCAL IMPACT There is no fiscal impact to the general fund. An increase in fees will be necessary by rule to meet operating expenses. The overall estimated increase in annual revenue is $17,000 in dedicated funds. CONTACT Name: Thomas E.
