|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature First Regular Session - 2001IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 47 BY HORNBECK 1 AN ACT 2 RELATING TO DRIVER'S LICENSES, IDENTIFICATION CARDS AND FEES; AMENDING SECTION 3 49-306, IDAHO CODE, TO INCREASE FEES AND TO PROVIDE ALLOCATION TO THE 4 EMERGENCY MEDICAL SERVICES ACCOUNT AND TO MAKE TECHNICAL CORRECTIONS; AND 5 DECLARING AN EMERGENCY. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 49-306, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 49-306. APPLICATION FOR DRIVER'S LICENSE OR INSTRUCTION PERMIT. (1) Every 10 application for any instruction permit or for a driver's license shall be made 11 upon a form furnished by the department and shall be verified by the applicant 12 before a person authorized to administer oaths. Officers and employees of the 13 department and sheriffs and their deputies are authorized to administer the 14 oaths without charge. Applications 23 on file shall be exempt from disclosure except as provided in sections 49-202, 24 49-203, 49-203A and 49-204, Idaho Code. 25 Every application shall also state whether the applicant has previously 26 been licensed as a driver, and if so, when and by what state or country, and 27 whether a driver's license or privileges have ever been suspended, revoked, 28 denied, disqualified, cancelled or whether an application has ever been 29 refused, and if so, the date of and reason for the suspension, revocation, 30 denial, disqualification, cancellation or refusal and the applicant's oath 31 that all information is correct as signified by the applicant's signature. 32 The applicant may be required to submit proof of identity acceptable to 33 the examiner or the department and date of birth as set forth in a certified 34 copy of his birth certificate when obtainable, or another document which pro- 35 vides satisfactory evidence of a person's date of birth acceptable to the 36 examiner or the department. 37 (3) Whenever an application is received from a person previously licensed 38 in another jurisdiction, the department shall request a copy of the driver's 39 record from the other jurisdiction and shall contact the national driver reg- 40 ister. When received, the driver's record from the previous jurisdiction shall 41 become a part of the driver's record in this state with the same force and 42 effect as though entered on the driver's record in this state in the original 43 instance. 44 (4) Whenever the department receives a request for a driver's record from 45 another licensing jurisdiction, the record shall be forwarded without charge. 46 (5) The department shall contact and notify the commercial driver license 47 information system of the proposed application for a class A, B or C driver's 48 license to insure identification of the person and to obtain clearance to 49 issue the license. 50 (6) When the fees required under this section are collected by a county 51 officer, they shall be paid over to the county treasurer not less often than 52 monthly, who shall immediately: 53 (a) Deposit an amount equal to five dollars ($5.00) from each driver's 54 license except an eight-year class D license, or any class D instruction 55 permit application fees, application for a duplicate driver's license or 3 1 permit, classification change, seasonal driver's license and additional 2 endorsement, and ten dollars ($10.00) from each eight-year class D 3 driver's license, in the current expense fund; and 4 (b) Deposit two dollars and fifty cents ($2.50) from each motorcycle 5 endorsement and motorcycle endorsement instruction permit fee in the cur- 6 rent expense fund; and 7 (c) Deposit an amount equal to three dollars ($3.00) from each fee for a 8 knowledge test in the current expense fund; and 9 (d) Deposit an amount equal to five dollars ($5.00) from each fee for a 10 motorcycle endorsement skills test in the current expense fund; provided 11 however, if a contractor administers the skills test he shall be entitled 12 to the five dollar ($5.00) fee; and 13 (e) Remit the remainder to the state treasurer; and 14 (f) Deposit eleven dollars and fifty cents ($11.50) from each fee for a 15 class D skills test into the county current expense fund, unless the test 16 is administered by a department-approved contractor, in which case the 17 contractor shall be entitled to eleven dollars and fifty cents ($11.50) of 18 each fee. 19 (7) When the fees required under this section are collected by a state 20 officer or agency, they shall be paid over to the state treasurer. 21 (8) The state treasurer shall distribute the moneys received from fees 22 imposed by the provisions of this section, whether collected by a county offi- 23 cer or by a state officer or agency as follows: 24 (a) Two dollars ($2.00) of each fee for a four-year driver's license or 25 seasonal driver's license, and four dollars ($4.00) of each fee for an 26 eight-year class D driver's license, and one dollar and fifty cents 27 ($1.50) of each fee charged for driver's licenses pursuant to subsections 28 (1)(b), (d) and (e) of this section, and fifty cents (50) of each fee 29 charged for driver's licenses pursuant to subsections (1)(c) and (f) of 30 this section, shall be deposited in the emergency medical services account 31 II created in section 39-146A, Idaho Code, and four dollars ($4.00) of 32 each fee charged pursuant to subsections (1)(a), (g) and (s) of this sec- 33 tion and eight dollars ($8.00) of each fee charged pursuant to subsection 34 (1)(h) of this section and three dollars ($3.00) of each fee for driver's 35 licenses pursuant to subsections (1)(b), (d) and (e) of this section, and 36 one dollar ($1.00) of each fee charged for driver's licenses pursuant to 37 subsections (1)(c) and (f) of this section shall be deposited in the emer- 38 gency medical services account III created in section 39-146B, Idaho Code; 39 and 40 (b) Sixteen dollars and fifty cents ($16.50) of each fee for a seasonal 41 or class A, B or C driver's license, and ten dollars ($10.00) of each fee 42 charged for a license pursuant to subsection (1)(b) of this section, and 43 five dollars and forty-one cents ($5.41) of each fee charged for a license 44 pursuant to subsection (1)(c) of this section shall be deposited in the 45 state highway account; and 46 (c) Ten dollars and fifty cents ($10.50) of each fee for a class A, B or 47 C instruction permit or driver's license classification change shall be 48 deposited in the state highway account; and 49 (d) Four dollars ($4.00) of each fee for a class A, B or C instruction 50 permit shall be deposited in the emergency medical services account III 51 created in section 39-146B, Idaho Code; and 52 (e) Six dollars and fifty cents ($6.50) of each fee for a duplicate sea- 53 sonal or class A, B or C driver's license, class A, B or C driver's 54 license extension, or additional endorsement shall be deposited in the 55 state highway account; and 4 1 (f) Four dollars ($4.00) of each fee for a motorcycle endorsement and 2 motorcycle endorsement instruction permit shall be deposited in the state 3 highway account; and 4 (g) Five dollars and thirty cents ($5.30) of each fee for a four-year 5 class D driver's license, and ten dollars and sixty cents ($10.60) of each 6 fee for an eight-year class D driver's license, and four dollars ($4.00) 7 of each fee charged for a license pursuant to subsections (1)(d) and (e) 8 of this section, and one dollar and thirty-three cents ($1.33) of each fee 9 charged for a license pursuant to subsection (1)(f) of this section shall 10 be deposited in the driver training account; and 11 (h) Seven dollars and twenty cents ($7.20) of each fee for a four-year 12 class D driver's license, and fourteen dollars and forty cents ($14.40) of 13 each fee for an eight-year class D driver's license, and six dollars 14 ($6.00) of each fee charged for a license pursuant to subsections (1)(d) 15 and (e) of this section, and four dollars and eight cents ($4.08) of each 16 fee charged for a license pursuant to subsection (1)(f) of this section 17 shall be deposited in the highway distribution account; and 18 (i) Two dollars and sixty cents ($2.60) of each fee for a class D 19 instruction permit, duplicate class D license or permit, and class D 20 license extension shall be deposited in the driver training account; and 21 (j) Three dollars and ninety cents ($3.90) of each fee for a class D 22 instruction permit, duplicate class D license or permit, and class D 23 license extension shall be deposited in the highway distribution account; 24 and 25 (k) Five dollars ($5.00) of each fee for a class A, B,or C skills test 26 shall be deposited in the state highway account; and 27 (l) One dollar ($1.00) of each fee for a class A, B, C or four-year D 28 driver's license, and two dollars ($2.00) of each fee for an eight-year 29 class D driver's license, and one dollar ($1.00) of each fee charged for a 30 license pursuant to subsections (1)(b), (d) and (e) of this section, and 31 thirty-four cents (34) of each fee charged for a license pursuant to sub- 32 sections (1)(c) and (f) of this section shall be deposited in the motor- 33 cycle safety program fund established in section 33-4904, Idaho Code; and 34 (m) Three dollars and fifty cents ($3.50) of each fee for a class D 35 skills test shall be deposited into the state highway account. 36 (9) The contractor administering a class A, B or C skills test shall be 37 entitled to not more than fifty dollars ($50.00) of the skills test fee. A 38 contractor administering a class A, B or C skills test may collect an addi- 39 tional fee for the use of the contractor's vehicle for the skills test. 40 (10) Thirty-five dollars ($35.00) of each restricted driving permit shall 41 be deposited in the state highway account. 42 (11) The department may issue seasonal class B or C driver's licenses 43 that: 44 (a) Will only be valid for driving commercial vehicles that normally 45 require class B or C commercial driver's licenses; 46 (b) Will be valid for seasonal periods that begin on the date of issuance 47 and that are not to exceed one hundred eighty (180) days in a twelve (12) 48 month period; 49 (c) May only be obtained twice in a driver's lifetime; 50 (d) Are valid only within a one hundred fifty (150) mile radius of the 51 place of business or farm being serviced; and 52 (e) Will be valid only in conjunction with valid Idaho class D driver's 53 licenses. 54 (12) The department may issue seasonal class B or C driver's licenses to 55 drivers who: 5 1 (a) Have not violated the single license provisions of 49 CFR part 383; 2 (b) Have not had any license suspensions, revocations or cancellations; 3 (c) Have not had any convictions in any vehicle for any offense listed in 4 section 49-335(1) or (2), Idaho Code, or any one (1) serious traffic 5 offense; 6 (d) Have at least one (1) year of driving experience with a class D or 7 equivalent license in any type motor vehicle; and 8 (e) Are at least sixteen (16) years old. 9 SECTION 2. An emergency existing therefor, which emergency is hereby 10 declared to exist, this act shall be in full force and effect on and after its 11 passage and approval.

and 14 (e) Remit the remainder to the state treasurer; and 15 (f) Deposit eleven dollars and fifty cents ($11.50) from each fee for a 16 class D skills test into the county current expense fund, unless the test 17 is administered by a department-approved contractor, in which case the 18 contractor shall be entitled to eleven dollars and fifty cents ($11.50) of 19 each fee. 20 (7) When the fees required under this section are collected by a state 21 officer or agency, they shall be paid over to the state treasurer. 22 (8) The state treasurer shall distribute the moneys received from fees 23 imposed by the provisions of this section, whether collected by a county offi- 24 cer or by a state officer or agency as follows: 25 (a) Two dollars ($2.00) of each fee for a four-year driver's license or 26 seasonal driver's license, and four dollars ($4.00) of each fee for an 27 eight-year class D driver's license, and one dollar and fifty cents 28 ($1.50) of each fee charged for driver's licenses pursuant to subsections 29 (1)(b), (d) and (e) of this section, and fifty cents (50) of each fee 30 charged for driver's licenses pursuant to subsections (1)(c) and (f) of 31 this section, shall be deposited in the emergency medical services account 32 II created in section 39-146A, Idaho Code, and four dollars ($4.00) of 33 each fee charged pursuant to subsections (1)(a), (g) and (s) of this sec- 34 tion and eight dollars ($8.00) of each fee charged pursuant to subsection 35 (1)(h) of this section and three dollars ($3.00) of each fee for driver's 36 licenses pursuant to subsections (1)(b), (d) and (e) of this section, and 37 one dollar ($1.00) of each fee charged for driver's licenses pursuant to 38 subsections (1)(c) and (f) of this section shall be deposited in the emer- 39 gency medical services account III created in section 39-146B, Idaho Code; 40 and 41 (b) Sixteen dollars and fifty cents ($16.50) of each fee for a seasonal 42 or class A, B or C driver's license, and ten dollars ($10.00) of each fee 43 charged for a license pursuant to subsection (1)(b) of this section, and 44 five dollars and forty-one cents ($5.41) of each fee charged for a license 45 pursuant to subsection (1)(c) of this section shall be deposited in the 46 state highway account; and 47 (c) Ten dollars and fifty cents ($10.50) of each fee for a class A, B or 48 C instruction permit or driver's license classification change shall be 49 deposited in the state highway account; and 50 (d) Four dollars ($4.00) of each fee for a class A, B or C instruction 51 permit shall be deposited in the emergency medical services account III 52 created in section 39-146B, Idaho Code; and 53 (e) Six dollars and fifty cents ($6.50) of each fee for a duplicate sea- 54 sonal or class A, B or C driver's license, class A, B or C driver's 55 license extension, or additional endorsement shall be deposited in the 4 1 state highway account; and 2 (f) Four dollars ($4.00) of each fee for a motorcycle endorsement and 3 motorcycle endorsement instruction permit shall be deposited in the state 4 highway account; and 5 (g) Five dollars and thirty cents ($5.30) of each fee for a four-year 6 class D driver's license, and ten dollars and sixty cents ($10.60) of each 7 fee for an eight-year class D driver's license, and four dollars ($4.00) 8 of each fee charged for a license pursuant to subsections (1)(d) and (e) 9 of this section, and one dollar and thirty-three cents ($1.33) of each fee 10 charged for a license pursuant to subsection (1)(f) of this section shall 11 be deposited in the driver training account; and 12 (h) Seven dollars and twenty cents ($7.20) of each fee for a four-year 13 class D driver's license, andfourteenten dollars and forty cents 14 ($140.40) of each fee for an eight-year class D driver's license, and six 15 dollars ($6.00) of each fee charged for a license pursuant to subsections 16 (1)(d) and (e) of this section, and four dollars and eight cents ($4.08) 17 of each fee charged for a license pursuant to subsection (1)(f) of this 18 section shall be deposited in the highway distribution account; and 19 (i) Two dollars and sixty cents ($2.60) of each fee for a class D 20 instruction permit, duplicate class D license or permit, and class D 21 license extension shall be deposited in the driver training account; and 22 (j) Three dollars and ninety cents ($3.90) of each fee for a class D 23 instruction permit, duplicate class D license or permit, and class D 24 license extension shall be deposited in the highway distribution account; 25 and 26 (k) Five dollars ($5.00) of each fee for a class A, B,or C skills test 27 shall be deposited in the state highway account; and 28 (l) One dollar ($1.00) of each fee for a class A, B, C or four-year D 29 driver's license, and two dollars ($2.00) of each fee for an eight-year 30 class D driver's license, and one dollar ($1.00) of each fee charged for a 31 license pursuant to subsections (1)(b), (d) and (e) of this section, and 32 thirty-four cents (34) of each fee charged for a license pursuant to sub- 33 sections (1)(c) and (f) of this section shall be deposited in the motor- 34 cycle safety program fund established in section 33-4904, Idaho Code; and 35 (m) Three dollars and fifty cents ($3.50) of each fee for a class D 36 skills test shall be deposited into the state highway account. 37 (9) The contractor administering a class A, B or C skills test shall be 38 entitled to not more than fifty dollars ($50.00) of the skills test fee. A 39 contractor administering a class A, B or C skills test may collect an addi- 40 tional fee for the use of the contractor's vehicle for the skills test. 41 (10) Thirty-five dollars ($35.00) of each restricted driving permit shall 42 be deposited in the state highway account. 43 (11) The department may issue seasonal class B or C driver's licenses 44 that: 45 (a) Will only be valid for driving commercial vehicles that normally 46 require class B or C commercial driver's licenses; 47 (b) Will be valid for seasonal periods that begin on the date of issuance 48 and that are not to exceed one hundred eighty (180) days in a twelve (12) 49 month period; 50 (c) May only be obtained twice in a driver's lifetime; 51 (d) Are valid only within a one hundred fifty (150) mile radius of the 52 place of business or farm being serviced; and 53 (e) Will be valid only in conjunction with valid Idaho class D driver's 54 licenses. 55 (12) The department may issue seasonal class B or C driver's licenses to 5 1 drivers who: 2 (a) Have not violated the single license provisions of 49 CFR part 383; 3 (b) Have not had any license suspensions, revocations or cancellations; 4 (c) Have not had any convictions in any vehicle for any offense listed in 5 section 49-335(1) or (2), Idaho Code, or any one (1) serious traffic 6 offense; 7 (d) Have at least one (1) year of driving experience with a class D or 8 equivalent license in any type motor vehicle; and 9 (e) Are at least sixteen (16) years old.
STATEMENT OF PURPOSE RS 10561 This Legislation will incorporate a $1.00 per year fee, $8.00 on eight year driver's licenses issued pursuant to subsection (1)(h) of Section 49-306, Idaho Code, to be deposited in the Emergency Medical Services Fund III. Due to an oversight of adding this fee to the original legislation which created the eight year driver's licenses, the Emergency Medical Services Fund III has suffered a loss of $228,092 between January 1, 2000 and October 31, 2000. This money would provide for desperately needed ambulances and equipment. FISCAL NOTE There will be no impact on the General Fund.
