|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature First Regular Session - 2001IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 64 BY JUDICIARY, RULES AND ADMINISTRATION COMMITTEE 1 AN ACT 2 RELATING TO ADMINISTRATION OF COUNTY JAILS; AMENDING SECTION 20-619, IDAHO 3 CODE, TO INCREASE THE FEE A COUNTY JAIL MAY CHARGE TO NONINDIGENT INMATES 4 FOR SEEING MEDICAL PERSONNEL. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 20-619, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 20-619. FEE FOR MEDICAL SERVICE. (1) County sheriff departments adminis- 9 tering county jails may charge a nominal fee ofonefive dollars ($15.00) to 10 any nonindigent inmate who has sufficient funds in his commissary/personal 11 account for the purpose of seeing the jail provided doctor or nurse for a med- 12 ical complaint. In the event that an inmate is indigent, such service shall be 13 provided by the county at no cost. 14 (2) The county sheriff departments administering county jails may charge 15 actual costs to any nonindigent inmate who has sufficient funds in his 16 commissary/personal account for pharmaceuticals prescribed or authorized by 17 jail medical staff. 18 (3) A "nonindigent" inmate, for purposes of this section, is an inmate 19 who has money in his commissary/personal account normally used for the pur- 20 chase of personal items for the inmate.
STATEMENT OF PURPOSE RS 10641 This legislation will change the nominal fee for medical service for county inmates from one to five dollars. The original legislation was passed in 1994 to curtail baseless requests for medical service by bored inmates. While this has worked to an extent, the fee is so low that some inmates are still engaging in such requests. In addition, the fee is so low that it will not justify the cost of keeping the record and making the transfer of the dollar from one account to another. This legislation will not affect indigent inmates, who may still obtain medical service for free. FISCAL IMPACT This legislation has no impact on the general fund.
