  1                                        AN ACT
  2    RELATING TO CERTAIN SPECIAL MOTOR VEHICLE LICENSE PLATE PROGRAMS FOR VETERANS;
  3        AMENDING SECTION 49-404A, IDAHO CODE, TO  PROVIDE  THAT  THE  INITIAL  AND
  4        ANNUAL  PROGRAM  FEES  FOR  THE ARMED FORCES RESERVE LICENSE PLATE PROGRAM
  5        SHALL BE DEPOSITED TO THE VETERANS CEMETERY MAINTENANCE FUND; AND AMENDING
  6        SECTION 49-418, IDAHO CODE, TO PROVIDE THAT THE INITIAL AND ANNUAL PROGRAM
  7        FEES FOR THE VETERANS LICENSE PLATE PROGRAM SHALL BE DEPOSITED TO THE VET-
  8        ERANS CEMETERY MAINTENANCE FUND AND TO MAKE A TECHNICAL CORRECTION.
                                                                        
  9    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 10        SECTION 1.  That Section 49-404A, Idaho Code, be, and the same  is  hereby
 11    amended to read as follows:
                                                                        
 12        49-404A.  MEMBERS  OF  THE ARMED FORCES RESERVE -- SPECIAL PLATES. (1) Any
 13    active member of the armed forces reserves of the United  States  who  is  the
 14    owner  of  a  vehicle registered under section 49-402(1) or section 49-434(1),
 15    Idaho Code, may, upon application to the department, register  not  more  than
 16    two (2) motor vehicles and  receive for each vehicle special license plates in
 17    lieu  of  regular  numbered  plates.  The provisions of this section shall not
 18    apply to any vehicle with a registered maximum gross  weight  over  twenty-six
 19    thousand  (26,000)  pounds.  The special license plates shall be designated by
 20    the department with the word "RESERVIST" centered along the bottom edge and be
 21    numbered in sets of two (2) with a different number following appropriate let-
 22    ters as follows: United States Army Reserve: Army (number); United States Navy
 23    Reserve: Navy (number); United States Marine  Corps  Reserve:  USMC  (number);
 24    United  States Air Force Reserve: USAF (number); and United States Coast Guard
 25    Reserve: USCG (number). Proof of being an active member in the  United  States
 26    armed  forces  reserves  must  be  furnished  to the department before special
 27    plates will be issued. Special license plates issued under this section  shall
 28    be  issued  under  the  staggered registration process provided for in section
 29    49-402(1), Idaho Code, or the annual registration in section 49-434(1),  Idaho
 30    Code.
 31        (2)  Any  branch  of the armed forces reserves of the United States shall,
 32    prior to an individual's discharge from duty  in  that  branch  of  the  armed
 33    forces  reserve,  require that the special armed forces reserve license plates
 34    either be turned back to the department or exchanged for other proper  license
 35    plates as a condition of discharge.
 36        (3)  In  addition  to  the  regular  registration fees required in section
 37    49-402(1) or 49-434(1), Idaho Code, the applicant shall pay the  initial  pro-
 38    gram  fee  and the annual program fee specified in section 49-402, Idaho Code.
 39    The initial program fee and the annual program fee shall be deposited  in  the
 40    state  highway account and shall be used to fund the cost of administration of
 41    this special license plate program which is provided to the public as  a  per-
 42    sonal  alternative to the standard license plate requirement veterans cemetery
 43    maintenance fund created in section 65-107, Idaho Code, for the operation  and

  1    maintenance  of  the state veterans cemetery. When a plate holder transfers or
  2    assigns his title or interest in the vehicle registered  under  this  section,
  3    the  registration  shall  expire, but the special plates may be transferred to
  4    another vehicle upon payment of the  required  transfer  fee.  Special  plates
  5    shall only be displayed after receipt of the new registration.
  6        (4)  The  design  and  numbering  scheme of the military reservist special
  7    plate shall be coordinated by the department with representatives of the armed
  8    forces reserves.  However, the department shall have the final approval of the
  9    plate design and numbering scheme to ensure conformity within existing  issues
 10    of  plates  and  to  contain  costs within the limit of the fees received from
 11    applicants.
                                                                        
 12        SECTION 2.  That Section 49-418, Idaho Code, be, and the  same  is  hereby
 13    amended to read as follows:
                                                                        
 14        49-418.  VETERANS  PLATES.  (1)  Any  person who is the owner of a vehicle
 15    registered under the provisions of section 49-402 or  49-434(1),  Idaho  Code,
 16    may  apply  for  and upon department approval receive special veterans license
 17    plates in lieu of regular license plates. The provisions of this section shall
 18    not apply to any vehicle with a registered maximum gross weight  over  twenty-
 19    six  thousand (26,000) pounds. Availability of veterans plates for other vehi-
 20    cles shall be subject to the rules, policies and procedures of the department.
 21        (2)  Proof of being a current or former member of the United States  armed
 22    forces must be furnished to the department before special veterans plates will
 23    be  issued.  Acceptable  proof  shall be a copy of form DD214 or an equivalent
 24    document or statement from the department of veterans affairs.
 25        (3)  In addition to the regular  registration  fees  required  in  section
 26    49-402(1)  or  49-434(1), Idaho Code, the applicant shall pay the initial pro-
 27    gram fee of twenty-five dollars ($25.00) and the annual program fee of fifteen
 28    dollars ($15.00) as specified in section 49-402, Idaho Code, and the plate fee
 29    specified in section 49-450, Idaho Code. Ten dollars ($10.00) of the The  ini-
 30    tial  program  fee and ten dollars ($10.00) of the annual program fee shall be
 31    deposited in the state highway account and shall be used to fund the  cost  of
 32    administration of this special license plate program. Fifteen dollars ($15.00)
 33    of  the initial program fee and five dollars ($5.00) of the annual program fee
 34    shall be deposited to the veterans cemetery maintenance fund created  in  sec-
 35    tion  65-107, Idaho Code, and shall be used to  operate and maintain a for the
 36    operation and maintenance of the state veterans cemetery.
 37        (4)  Whenever title or interest in a vehicle registered under  the  provi-
 38    sions  of  this section is transferred or assigned, the owner may transfer the
 39    special plates to another vehicle upon payment of the required transfer  fees.
 40    The  owner  may only display the plates on another vehicle upon receipt of the
 41    new registration from the department.
 42        (5)  The veterans license plate design shall include the colors red, white
 43    and blue, shall designate one (1) of the five (5) branches  of  military  ser-
 44    vice, and display either:
 45        (a)  The word "VETERAN"; or
 46        (b)  The  name of a conflict or war period recognized by the United States
 47        department of veterans affairs for the purpose of  awarding  federal  vet-
 48        erans benefits as defined in 38 U.S.C. 101(11).
 49    The license plate design shall comply with all applicable rules of the depart-
 50    ment,  and shall include a separate and distinct numbering system. The design,
 51    color, and numbering system shall be subject to approval of the department.
 52        (6)  Veterans license plates may be retained  and  displayed  on  vehicles
 53    owned by the surviving spouse of a qualified veteran. In addition, the surviv-

  1    ing  spouse  of  a  deceased  qualified veteran is eligible to reapply for and
  2    shall be issued veterans license plates if the deceased qualified veteran died
  3    on or after January 1 of the five (5) years preceding the date  of  reapplica-
  4    tion  for the plates. Such plates shall be used on a vehicle owned by the sur-
  5    viving spouse.

The purpose of this proposal is to provide that the initial and annual
program fees for the armed forces reserve license plate program shall
be deposited to the Veterans Cemetery Maintenance Fund; and to provide
that the initial and annual program fees for the veterans license
plate program shall be deposited to the Veterans Cemetery Maintenance
Fund.

                          FISCAL IMPACT



Based on calendar year 1999 sales volume, an additional $21,350 per
