|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature First Regular Session - 2001IN THE SENATE SENATE BILL NO. 1103 BY TRANSPORTATION COMMITTEE 1 AN ACT 2 RELATING TO HIGHWAY DISTRICT PURCHASES; AMENDING SECTION 40-906, IDAHO CODE, 3 TO EXEMPT CERTAIN EQUIPMENT PURCHASES FROM THE REQUIREMENT FOR BIDS; 4 AMENDING CHAPTER 9, TITLE 40, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 5 40-906A, IDAHO CODE, TO PROVIDE THAT A HIGHWAY DISTRICT MAY PURCHASE 6 EQUIPMENT AT A PUBLIC AUCTION IF THE HIGHWAY DISTRICT BOARD OF COMMISSION- 7 ERS HAS MADE A FINDING THAT THE EQUIPMENT MAY BE PURCHASED AT A PUBLIC 8 AUCTION AT A LOWER PRICE. 9 Be It Enacted by the Legislature of the State of Idaho: 10 SECTION 1. That Section 40-906, Idaho Code, be, and the same is hereby 11 amended to read as follows: 12 40-906. EXPENDITURES FOR WHICH BIDS REQUIRED. Except as otherwise pro- 13 vided in section 40-906A, Idaho Code, wWhen the expenditure contemplated 14 exceeds five thousand dollars ($5,000), but not twenty-five thousand dollars 15 ($25,000) the district shall obtain price or cost quotations from at least 16 three (3) responsible vendors in the business of supplying such goods or ser- 17 vices. To enhance small business bidding opportunities, the district shall 18 seek a minimum of three (3) price quotations from registered vendors having a 19 significant Idaho economic presence as defined in section 67-2349, Idaho Code. 20 If the district finds that it is impractical or impossible to obtain three (3) 21 quotations for the proposed transaction, the district may acquire the property 22 in any manner the district deems best. The district shall then procure the 23 goods or services from the responsible vendor quoting the lowest price. When 24 the expenditure contemplated exceeds twenty-five thousand dollars ($25,000), 25 it shall be contracted for and let to the lowest responsible bidder. Where 26 both bids and quality of property offered are the same, preference shall be 27 given to the property of local and domestic production and manufacture or from 28 bidders having a significant Idaho economic presence as defined in section 29 67-2349, Idaho Code. 30 SECTION 2. That Chapter 9, Title 40, Idaho Code, be, and the same is 31 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 32 ignated as Section 40-906A, Idaho Code, and to read as follows: 33 40-906A. EQUIPMENT PURCHASE AT PUBLIC AUCTION. Notwithstanding the provi- 34 sions of section 40-906, Idaho Code, a highway district may purchase equipment 35 at a public auction if the highway district board of commissioners has made a 36 finding that the price of the equipment to be purchased at a public auction is 37 lower than the price of the equipment on the market.
STATEMENT OF PURPOSE RS 10891 This legislation creates a new section of Idaho Code section 40-906(A), Title 40, to allow highway district commissioners to purchase equipment at public auction.
