  1                                        AN ACT
  2    RELATING TO OFFENSES ON HIGHWAYS; AMENDING SECTION 49-709, IDAHO CODE, TO PRO-
  3        VIDE THAT A PERSON MAY STAND ON A  HIGHWAY  TO  SOLICIT  CONTRIBUTIONS  IF
  4        ALLOWED TO DO SO BY THE LOCAL AUTHORITY HAVING JURISDICTION OVER THE HIGH-
  5        WAY.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Section  49-709, Idaho Code, be, and the same is hereby
  8    amended to read as follows:
                                                                        
  9        49-709.  PEDESTRIANS SOLICITING RIDES OR BUSINESS.  (1)  No  person  shall
 10    stand on a highway for the purpose of soliciting a ride.
 11        (2)  No  person  shall  stand  on  a highway for the purpose of soliciting
 12    employment, business or contributions from the occupant of any  vehicle,  pro-
 13    vided  however,  that a person may stand on a highway to solicit contributions
 14    if allowed to do so by the local authority having jurisdiction over the  high-
 15    way.
 16        (3)  No person shall stand on or in proximity to a highway for the purpose
 17    of soliciting the watching or guarding of any vehicle while parked or about to
 18    be parked on a highway.

  1                                AMENDMENT TO SECTION 1
  2        On page 1 of the printed bill, in line  13,  following  "highway"  insert:
  3    "other  than  a  state  or  federal highway"; in line 14, delete "allowed" and
  4    insert: "authorized";  and  also  in  line  14,  following  "so"  insert:  "in
  5    writing".

 15    local  authority  having  jurisdiction over the highway, and provided further,
 16    that any such authorization shall not be valid for more than one (1) year from
 17    the date of issuance.
 18        (3)  No person shall stand on or in proximity to a highway for the purpose
 19    of soliciting the watching or guarding of any vehicle while parked or about to
 20    be parked on a highway.

Statement of Purpose / Fiscal Impact




                      STATEMENT OF PURPOSE

At present Idaho law does not permit local government entities to

allow the raising of funds by requesting that motorists donate

from their cars. This bill will give local jurisdictions the

discretion to allow such activities, such as the Professional

Firefighters "Fill the Boot" benefit for the Muscular Dystrophy

Association, should such entities so decide; the bill does not

require these authorities to do so.
