|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature Second Regular Session - 2002IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 599 BY JUDICIARY, RULES AND ADMINISTRATION COMMITTEE 1 AN ACT 2 RELATING TO WORKER'S COMPENSATION; AMENDING SECTION 72-412, IDAHO CODE, TO 3 PROVIDE EQUAL INCOME BENEFITS FOR DEATH TO WIDOWS AND WIDOWERS. 4 Be It Enacted by the Legislature of the State of Idaho: 5 SECTION 1. That Section 72-412, Idaho Code, be, and the same is hereby 6 amended to read as follows: 7 72-412. PERIODS OF INCOME BENEFITS FOR DEATH. The income benefits for 8 death herein provided for shall be payable during the following periods: 9 (1)To a widow, until death or remarriage, but in no case to exceed five10hundred (500) weeks.11(2)To a widow or widower, during disability or until remarriage, but in 12 no case to exceed five hundred (500) weeks. 13 (32) To or for a child, until eighteen (18) years of age, and if incapa- 14 ble of self-support after age eighteen (18) for an additional period not to 15 exceed five hundred (500) weeks, deducting the period benefits which were paid 16 prior to eighteen (18) years of age. Provided, income benefits payable to or 17 for any child shall cease when such child marries. 18 (43) To a parent or grandparent, during the continuation of a condition 19 of actual dependency, but in no case to exceed five hundred (500) weeks. 20 (54) To or for a grandchild, brother or sister, during dependency as 21 hereinbefore defined, but in no case to exceed five hundred (500) weeks. 22 (65) In case death occurs after a period of disability, either total or 23 partial, the period of disability shall be deducted from the total periods of 24 compensation respectively stated in this section.

STATEMENT OF PURPOSE RS 11870 This legislation corrects a differential in Worker's Compensation death benefits between men and women that currently exists in Idaho Code.
