|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature Second Regular Session - 2002IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 605 BY COMMERCE AND HUMAN RESOURCES COMMITTEE 1 AN ACT 2 RELATING TO SNOWMOBILES; AMENDING SECTION 67-7103, IDAHO CODE, TO REQUIRE VEN- 3 DORS TO BE WITHIN THE STATE OF IDAHO AND TO PROVIDE THAT ALL APPLICATIONS 4 SHALL ONLY BE MADE WITHIN THE STATE OF IDAHO; AND AMENDING SECTION 5 67-7104, IDAHO CODE, TO PROVIDE THAT A NONRESIDENT CERTIFICATE OF NUMBER 6 SHALL ONLY BE ISSUED AND SOLD WITHIN THE STATE OF IDAHO. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Section 67-7103, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 67-7103. APPLICATION FOR NUMBER -- ATTACHMENT OF NUMBER -- CERTIFICATE -- 11 APPLICATION FOR TRANSFER OF CERTIFICATE -- TRANSFER OF CERTIFICATE FEE -- TEM- 12 PORARY NUMBER -- FEES. (1) On or before November 1 of each year the owner of 13 each snowmobile requiring numbering by the state of Idaho shall file an appli- 14 cation for number with the department on forms approved by it. The application 15 shall be signed by the owner and shall, except as provided in subsection (7) 16 of this section, be accompanied by a fee of twenty dollars ($20.00). Upon 17 receipt of the application the department shall issue to the applicant a cer- 18 tificate of number stating the number assigned to the snowmobile and the name 19 and address of the owner. The owner shall paint on or attach to the snowmobile 20 the identification number in a manner as may be prescribed by rules of the 21 department. The number shall be located on the right and left side of the 22 cowling of the snowmobile and shall be completely visible and shall be main- 23 tained in legible condition. The certificate of number shall be pocket size 24 and shall be available at all times for inspection on the snowmobile for which 25 issued, wherever the snowmobile is in operation. 26 (2) The department may issue any certificate of number directly or may 27 authorize any persons within the state of Idaho to act as vendor for the issu- 28 ance. In the event a person accepts the authorization, he may be assigned a 29 block of numbers and certificates which upon issue, in conformity with this 30 chapter and with any rules of the department, shall be valid as if issued 31 directly by the department. 32 (3) All records of the department made or kept pursuant to this section 33 shall be public records. 34 (4) Each snowmobile must be registered before it leaves the premises at 35 the time of sale from any retail snowmobile dealer. 36 (5) The purchaser of a snowmobile shall, within fifteen (15) days immedi- 37 ately after acquisition, make application to the department for transfer to 38 him of the certificate of number issued to the snowmobile, giving his name, 39 address and the number of the snowmobile and shall at the same time pay to the 40 department a fee of three dollars ($3.00). Upon receipt of the application and 41 fee, the department shall transfer the certificate of number issued for the 42 snowmobile to the new owner or owners. Unless the application is made and fee 43 paid within fifteen (15) days, the snowmobile shall be considered to be with- 2 1 out a certificate of number and it shall be unlawful for any person to operate 2 that snowmobile until the certificate is issued. 3 (6) No number other than the number issued to a snowmobile pursuant to 4 this chapter shall be painted, attached, or otherwise displayed on the snowmo- 5 bile, except a temporary number may be attached to identify a snowmobile for 6 the purpose of racing or other sporting events. 7 (7) Resident and nonresident owners of snowmobiles used for rental pur- 8 poses shall purchase certificates of number for fifty dollars ($50.00) and the 9 certificates of number shall be displayed on the machine at all times. 10 (8) All applications pursuant to this section shall only be made within 11 the state of Idaho. 12 SECTION 2. That Section 67-7104, Idaho Code, be, and the same is hereby 13 amended to read as follows: 14 67-7104. NONRESIDENT. (1) The provisions of this chapter shall not apply 15 to a nonresident, noncommercial owner who has a snowmobile which is currently 16 numbered or licensed by his resident state or province, provided that the res- 17 ident state or province does not charge a snowmobiling fee to Idaho residents. 18 If a nonresident operates a snowmobile in this state for a period in excess of 19 fifteen (15) consecutive days, the owner shall be liable for and shall pay to 20 the director or his agent the fee as provided in section 67-7103, Idaho Code. 21 (2) Notwithstanding the provisions of subsection (1) of this section, all 22 nonresident operators of snowmobiles used in Idaho shall comply with one (1) 23 of the following requirements: 24 (a) The snowmobile shall be registered in Idaho and the certificate of 25 number shall be displayed in the manner provided in section 67-7103, Idaho 26 Code; or 27 (b) The nonresident shall obtain a nonresident snowmobile user certifi- 28 cate upon payment of twenty dollars ($20.00) and the certificate of number 29 shall be displayed in the same manner as provided in section 67-7103, 30 Idaho Code. Such certificates shall be valid beginning November 1 through 31 October 31 of the following year. Issuance and administration of nonresi- 32 dent snowmobile user certificates shall be conducted in the same manner as 33 provided in section 67-7103, Idaho Code, for numbering of snowmobiles. A 34 nonresident certificate of number shall only be issued and sold within the 35 state of Idaho. 36 (3) For purposes of this section, "nonresident" shall be as defined in 37 section 36-202, Idaho Code.
STATEMENT OF PURPOSE RS 11940 *The proposed legislation amends Section 67-7103 of the Idaho Code in that all snowmobile permits shall only be issued and sold within the state of Idaho. Permits sold over the internet are excluded. FISCAL IMPACT About 3,300 non-resident snowmobile permits were sold out-ofstate last year. Many of these permits were sold in other states just across the Idaho state line. The requirement for nonresidents to purchase their permits in state would encourage them to spend their tourist dollars for gas, food, and sundries at local Idaho businesses that sell the snowmobile permits. The Department of Commerce estimates that each non-resident snowmobile party will spend about $200 per day in Idaho. This legislation will have a positive economic impact in communities where snow mobile permits are sold. Counties receive a portion of the snowmobile permit sold within Idaho.
