  1                                        AN ACT
  2    RELATING TO ABATEMENT OF SERIOUS SAFETY HAZARDS IN SCHOOL FACILITIES; AMENDING
  3        CHAPTER 16, TITLE 33, IDAHO  CODE,  BY  THE  ADDITION  OF  A  NEW  SECTION
  4        33-1613A,  IDAHO CODE, TO PROVIDE ACTION TO BE TAKEN BY THE STATE BOARD OF
  5        EDUCATION SHOULD A SCHOOL DISTRICT FAIL TO ABATE  SERIOUS  SAFETY  HAZARDS
  6        WITHIN THE TIME SPECIFIED.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION  1.  That  Chapter  16,  Title 33, Idaho Code, be, and the same is
  9    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 10    ignated as Section 33-1613A, Idaho Code, and to read as follows:
                                                                        
 11        33-1613A.  FAILURE  TO  ABATE SERIOUS SAFETY HAZARDS. If a school district
 12    fails to begin abating serious safety hazards as provided in section  39-8004,
 13    Idaho  Code,  within two (2) years of their identification, the state board of
 14    education shall declare the school district to be a noncompliant  school  dis-
 15    trict, and shall develop and implement a plan to abate the serious safety haz-
 16    ards.  In executing the abatement plan, notwithstanding any other provision of
 17    law, the state board of education shall have and is hereby granted the author-
 18    ity to:
 19        (1)  Redirect and reallocate noncompliant school district funds.
 20        (2)  Order the closure of facilities with serious  safety  hazards  within
 21    the noncompliant school district.
 22        (3)  Shift students from facilities with serious safety hazards within the
 23    noncompliant school district to other buildings, schools or school districts.
 24        (4)  Order  an increase in the noncompliant school district's levy rate to
 25    pay for abatement costs.
 26        (5)  Order the consolidation of the noncompliant school  district  with  a
 27    neighboring school district.

conditions within a specified time.
