2 RELATING TO LEGISLATIVE INTENT ASSOCIATED WITH THE APPROPRIATION OF MONEYS TO
3 THE DEPARTMENT OF HEALTH AND WELFARE FOR FISCAL YEAR 2002; AMENDING SEC-
4 TION 8, CHAPTER 368, LAWS OF 2001, TO STRIKE REFERENCE TO SPECIAL RATES
5 FOR PRIVATE INTERMEDIATE CARE FACILITIES FOR THE MENTALLY RETARDED;
6 DECLARING AN EMERGENCY AND PROVIDING RETROACTIVE APPLICATION.
7 Be It Enacted by the Legislature of the State of Idaho:
8 SECTION 1. That Section 8, Chapter 368, Laws of 2001, be, and the same is
9 hereby amended to read as follows:
10 SECTION 8. Notwithstanding the provisions of Section 56-113, Idaho Code,
11 it is the intent of the Idaho Legislature that for the period July 1, 2001,
12 through June 30, 2002, rates, including special rates of private intermediate
13 care facilities for the mentally retarded, shall not exceed the rates in
14 effect in state fiscal year 2000.
15 SECTION 2. An emergency existing therefor, which emergency is hereby
16 declared to exist, this act shall be in full force and effect on and after its
17 passage and approval, and retroactively to July 1, 2001.
STATEMENT OF PURPOSE
RS 12223
SB 1274 of the 2001 Legislative Session was the appropriation
bill for medical assistance programs in the Department of Health
and Welfare. That bill contained intent language for
Intermediate Care Facilities for the mentally retarded which
capped their reimbursement rates at 2000 rates and included
special rates. Notwithstanding the limitation, approximately 10
consumers with intense care needs have been given special rates
during fiscal year 2002. The Department recently determined that
special rates had been given in error and has discontinued them.
Without the special rate, which, in these cases, resulted in a
total payment of $279.00 per person per day, care cannot be given
in a private ICF/MR. Therefore, these consumers may be sent to
the Idaho State School and Hospital in Nampa which costs an
average $554.00 per person per day for such care. It is intended
that special rates, which had been previously granted and were in
effect in state fiscal year 2002 would be continued, but no new
special rates would be negotiated in state fiscal year 2002.
FISCAL IMPACT
Beginning July 1, 2001, special rates were paid and continued
into the third quarter of state fiscal year 2002. Any additional
funds will be met in the current budget.
