|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature Second Regular Session - 2002IN THE SENATE SENATE JOINT RESOLUTION NO. 102 BY STATE AFFAIRS COMMITTEE 1 A JOINT RESOLUTION 2 PROPOSING AN AMENDMENT TO SECTION 8, ARTICLE IX, OF THE CONSTITUTION OF THE 3 STATE OF IDAHO, RELATING TO LOCATION, DISPOSITION AND MANAGEMENT OF PUBLIC 4 LANDS TO PROVIDE THAT THE STATE BOARD OF LAND COMMISSIONERS SHALL MANAGE 5 STATE LANDS IN ACCORDANCE WITH STATE STATUTES GOVERNING LOCAL LAND USE 6 PLANNING; STATING THE QUESTION TO BE SUBMITTED TO THE ELECTORATE; DIRECT- 7 ING THE LEGISLATIVE COUNCIL TO PREPARE THE STATEMENTS REQUIRED BY LAW; AND 8 DIRECTING THE SECRETARY OF STATE TO PUBLISH THE AMENDMENT AND ARGUMENTS AS 9 REQUIRED BY LAW. 10 Be It Resolved by the Legislature of the State of Idaho: 11 SECTION 1. That Section 8, Article IX, of the Constitution of the State 12 of Idaho be amended to read as follows: 13 SECTION 8. LOCATION AND DISPOSITION OF PUBLIC LANDS. It shall 14 be the duty of the state board of land commissioners to provide for 15 the location, protection, sale or rental of all the lands heretofore, 16 or which may hereafter be granted to or acquired by the state by or 17 from the general government, under such regulations as may be pre- 18 scribed by law, and in such manner as will secure the maximum 19 long-term financial return to the institution to which granted or to 20 the state if not specifically granted; provided, that no state lands 21 shall be sold for less than the appraised price; provided further, 22 that state lands shall be managed in accordance with state statutes 23 governing local land use planning. No law shall ever be passed by the 24 legislature granting any privileges to persons who may have settled 25 upon any such public lands, subsequent to the survey thereof by the 26 general government, by which the amount to be derived by the sale, or 27 other disposition of such lands, shall be diminished, directly or 28 indirectly. The legislature shall, at the earliest practicable 29 period, provide by law that the general grants of land made by con- 30 gress to the state shall be judiciously located and carefully pre- 31 served and held in trust, subject to disposal at public auction for 32 the use and benefit of the respective object for which said grants of 33 land were made, and the legislature shall provide for the sale of 34 said lands from time to time and for the sale of timber on all state 35 lands and for the faithful application of the proceeds thereof in 36 accordance with the terms of said grants; provided, that not to 37 exceed one hundred sections of state lands shall be sold in any one 38 year, and to be sold in subdivisions of not to exceed three hundred 39andtwenty acres of land to any one individual, company or corpora- 40 tion. The legislature shall have power to authorize the state board 41 of land commissioners to exchange granted or acquired lands of the 42 state on an equal value basis for other lands under agreement with 43 the United States, local units of government, corporations, compa- 2 1 nies, individuals, or combinations thereof. 2 SECTION 2. The question to be submitted to the electors of the State of 3 Idaho at the next general election shall be as follows: 4 "Shall Section 8, Article IX, of the Constitution of the State of Idaho be 5 amended to require that the state board of land commissioners manage state 6 lands in accordance with state statutes governing local land use planning?". 7 SECTION 3. The Legislative Council is directed to prepare the statements 8 required by Section 67-453, Idaho Code, and file the same. 9 SECTION 4. The Secretary of State is hereby directed to publish this pro- 10 posed constitutional amendment and arguments as required by law.
STATEMENT OF PURPOSE RS 11532 The purpose of this legislation is to propose an amendment to Section 8, Article IX, of the Constitution of the State of Idaho.
