]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-seventh Legislature Second Regular Session - 2004IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 552 BY HEALTH AND WELFARE COMMITTEE 1 AN ACT 2 RELATING TO COUNSELORS AND MARRIAGE AND FAMILY THERAPISTS; AMENDING SECTION 3 54-3404, IDAHO CODE, TO REVISE TERMINOLOGY, TO PROVIDE REFERENCES TO 4 PASTORAL COUNSELORS AND TO AUTHORIZE THE BOARD TO ADOPT RULES REQUIRING 5 ANNUAL CONTINUING EDUCATION AS A CONDITION FOR THE RENEWAL OF LICENSES; 6 AMENDING SECTION 54-3405A, IDAHO CODE, TO DELETE CERTAIN CONTINUING EDUCA- 7 TION REQUIREMENTS FOR PASTORAL COUNSELORS, TO REVISE TERMINOLOGY, TO MAKE 8 TECHNICAL CORRECTIONS AND TO DELETE LANGUAGE REFERRING TO THE MEANING OF 9 "LICENSED PASTORAL COUNSELOR" AND "LICENSED PROFESSIONAL COUNSELOR"; AND 10 AMENDING SECTION 54-3405C, IDAHO CODE, TO REVISE TERMINOLOGY AND TO DELETE 11 CERTAIN CONTINUING EDUCATION REQUIREMENTS FOR MARRIAGE AND FAMILY 12 THERAPISTS. 13 Be It Enacted by the Legislature of the State of Idaho: 14 SECTION 1. That Section 54-3404, Idaho Code, be, and the same is hereby 15 amended to read as follows: 16 54-3404. IDAHO STATE LICENSING BOARD OF PROFESSIONAL COUNSELORS AND MAR- 17 RIAGE AND FAMILY THERAPISTS -- POWERS. The board shall have the following 18 powers: 19 (1) To regulate the practice oflicensed counselors and licensedprofes- 20 sional counselors,and licensedmarriage and family therapists and pastoral 21 counselors in the state of Idaho. 22 (2) To pass upon the qualifications and fitness of applicants for 23 licenses and to adopt rules requiring annual continuing education as a condi- 24 tion for the renewal of licenses issued under this chapter. 25 (3) To adopt and from time to time revise such rules as may be necessary 26 to carry into effect the provisions of this chapter. Such rules shall include, 27 but not be limited to, a code of ethics forlicensedprofessional counselors 28 and a code of ethics for marriage and family therapists in the state, which 29 shall be adopted in compliance with chapter 52, title 67, Idaho Code. 30 (4) To review the practice of professional counselors, pastoral counsel- 31 ors and marriage and family therapists licensed under this chapter and charged 32 with a violation of the provisions of this chapter. This review may include 33 the notes of the license holder and other materials related to the practice. 34 The review will remain subject to disclosure according to chapter 3, title 9, 35 Idaho Code, unless the written consent of the client is received by the board. 36 (5) To establish a peer review system whereby each license holder's prac- 37 tice may be reviewed to ensure continuing practice in an appropriate and ethi- 38 cal manner. 39 (6) To examine for, deny, approve, issue, revoke, suspend and renew the 40 licenses of applicants pursuant to this chapter, and to conduct hearings in 41 connection therewith. 42 (7) To conduct hearings to suspend or revoke licenses for violations of 43 the law and rules adopted pursuant to this chapter and cause the prosecution 2 1 and enjoinder of all such violations. 2 (8) In any proceeding before the board authorized by this chapter, the 3 board or its designee may administer oaths or affirmations to witnesses 4 appearing before it. 5 (9) To authorize, by written agreement, the chief of the bureau of occu- 6 pational licenses as agent to act in its interest. 7 (10) To provide, by rule,licensedprofessional counselor andlicensed8 marriage and family therapist specialty standards. 9 SECTION 2. That Section 54-3405A, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 54-3405A. QUALIFICATIONS FOR LICENSURE FOR LICENSED PASTORAL COUNSELORS. 12 (1) Licensure as a"licensed"pastoral counselor" shall be restricted to per- 13 sons of good moral characterwho have successfully completed the following14requirementswho have applied forlicensedpastoral counselorslicensure 15 (L.Pas.C.) and who have successfully completed the following requirements: 16 (1a) Holds a master of divinity (M.Div.) degree or doctoral degree with a 17 major in pastoral counseling from an accredited university or religious 18 institution with a requirement of sixty (60) semester credit hours of 19 counseling related courses in a minimum of eight (8) of the following 20 eleven (11) areas with the areas of study being specified by the American 21 association of pastoral counselors (AAPC): 22 (ai) Theories of personality and personality development; 23 (bii) Theories of counseling and psychotherapy; 24 (ciii) Marriage and family dynamics and counseling; 25 (div) Group dynamics and counseling; 26 (ev) Personality, culture and ethics; 27 (fvi) Psychology of religious experience; 28 (gvii) Pastoral assessment and treatment; 29 (hviii) Psychopathology; 30 (ix) Theories of pastoral care; 31 (jxi) Research methods; 32 (kxii) Orientation to the helping professions. 33 (2b) Completion of a practicum of supervised counseling experience of 34 four hundred (400) contact hours, supervised at a ratio of one (1) hour of 35 supervision for each ten (10) contact hours. 36 (3c) Graduate studies shall have been at a university or institution 37 which has been accredited by one (1) of the following: The middle states 38 association of colleges and secondary schools, the New England state asso- 39 ciation of colleges and secondary schools, the north central association 40 of colleges and secondary schools, the northwest association of colleges 41 and secondary schools, the southern association of colleges and secondary 42 schools or the western colleges association. The pastoral counselor pro- 43 gram may also be accredited by the association of theological schools 44 (ATS). 45 (4d) Completion of two thousand (2,000) contact hours of postgraduate 46 supervised counseling experience, with an approved supervisor. Approved 47 supervisors include an American association of pastoral counselors 48 approved supervisor, a licensed pastoral counselor, a licensed psychia- 49 trist, a licensed psychologist, or a licensed professional counselor. The 50 ratio of supervision to contact hours shall be one (1) to twenty (20). 51 (5e) Successful completion of the national counselor examination as 52 required by the board. 53(6) Each licensed pastoral counselor must obtain twenty (20) contact3 1hours of continuing education in an area that is approved by the board per2year.3 (72) Eachlicensedpastoral counselor shall adhere to the code of ethics 4 of the American counseling association. 5 (83) The board shall have the option of employing a consultant to assist 6 in the review of applications and in disciplinary actions. The cost of the 7 consultation shall be included in the fee for the pastoral counselor license. 8 (94) The board may issue licenses to those persons meeting the qualifica- 9 tions for licensure as alicensedpastoral counselor (L.Pas.C.) and the 10licensedpastoral counselor license shall be a separate and distinct license 11 from thelicensedprofessional counselor license. 12 (105)For the purposes of this chapter, fees and disciplinary actions,13the terms "licensed pastoral counselor" and "licensed professional counselor"14shall have the same meaning.The board may promulgate rules to implement the 15 provisions of this section in compliance with chapter 52, title 67, Idaho 16 Code. 17 SECTION 3. That Section 54-3405C, Idaho Code, be, and the same is hereby 18 amended to read as follows: 19 54-3405C. QUALIFICATIONS FOR LICENSURE. Licensure as a"licensed"mar- 20 riage and family therapist" shall be restricted to persons who have success- 21 fully completed each of the following requirements: 22 (1) A graduate degree which consists of at least sixty (60) semester 23 hours or ninety (90) quarter credits in marriage and family therapy from a 24 program accredited by the commission on accreditation for marriage and family 25 therapy education, or a marriage and family counseling or therapy program 26 which is accredited by the council for accreditation of counseling and related 27 educational programs, or a graduate degree from a regionally accredited educa- 28 tional institution and an equivalent course of study as approved by the board. 29 The course of study for any graduate degree shall include a minimum of thirty- 30 nine (39) semester credits in the following areas: 31 (a) Marriage and family studies -- nine (9) semester credit minimum. 32 Studies in this area shall include: 33 (i) Theoretical foundations, history, philosophy, etiology and con- 34 temporary conceptual directions of marriage and family therapy or 35 marriage and family counseling; 36 (ii) Family systems theories and other relevant theories and their 37 application in working with a wide variety of family structures, 38 including families in transition, nontraditional families and blended 39 families, and a diverse range of presenting issues; and 40 (iii)PreventativePreventive approaches, including premarital coun- 41 seling, parent skill training and relationship enhancement, for work- 42 ing with couples, families, individuals, subsystems and other sys- 43 tems. 44 (b) Marriage and family therapy -- nine (9) semester credit minimum. 45 Studies in this area shall include: 46 (i) The practice of marriage and family therapy related to theory, 47 and a comprehensive survey and substantive understanding of the major 48 models of marriage and family therapy or marriage and family counsel- 49 ing; and 50 (ii) Interviewing and assessment skills for working with couples, 51 families, individuals, subsystems and other systems, and skills in 52 the appropriate implementation of systematic interventions across a 53 variety of presenting clinical issues including, but not limited to, 4 1 socioeconomic disadvantage, abuse and addiction. 2 (c) Human development -- nine (9) semester credit minimum. Studies in 3 this area shall include: 4 (i) Individual development and transitions across the life span; 5 (ii) Family, marital and couple life cycle development and family 6 relationships, family of origin and intergenerational influences, 7 cultural influences, ethnicity, race, socioeconomic status, religious 8 beliefs, gender, sexual orientation, social and equity issues and 9 disability; 10 (iii) Human sexual development, function and dysfunction, impacts on 11 individuals, couples and families, and strategies for intervention 12 and resolution; and 13 (iv) Issues of violence, abuse and substance use in a relational 14 context, and strategies for intervention and resolution. 15 (d) Psychological and mental health competency -- six (6) semester credit 16 minimum. Studies in this area shall include: 17 (i) Psychopathology, including etiology, assessment, evaluation and 18 treatment of mental disorders, use of the current diagnostic and sta- 19 tistical manual of mental disorders, differential diagnosis and 20 multiaxial diagnosis; 21 (ii) Standard mental health diagnostic assessment methods and 22 instruments, including standardized tests; and 23 (iii) Psychotropic medications and the role of referral to and coop- 24 eration with other mental health practitioners in treatment planning, 25 and case management skills for working with individuals, couples and 26 families. 27 (e) Professional ethics and identity -- three (3) semester credit mini- 28 mum. Studies in this area shall include: 29 (i) Professional identity, including professional socialization, 30 professional organizations, training standards, credentialing bodies, 31 licensure, certification, practice settings and collaboration with 32 other disciplines; 33 (ii) Ethical and legal issues related to the practice of marriage 34 and family therapy, legal responsibilities of marriage and family 35 therapy and marriage and family counseling practice and research, 36 business aspects, reimbursement, recordkeeping, family law, confiden- 37 tiality issues and the relevant codes of ethics, including the code 38 of ethics specified by the board; and 39 (iii) The interface between therapist responsibility and the profes- 40 sional, social and political context of treatment. 41 (f) Research -- three (3) semester credit minimum. Studies in this area 42 shall include: 43 (i) Research in marriage and family therapy or marriage and family 44 counseling and its application to working with couples and families; 45 and 46 (ii) Research methodology, quantitative and qualitative methods, 47 statistics, data analysis, ethics and legal considerations of con- 48 ducting research, and evaluation of research. 49 (2) Completion of a one (1) year practicum of supervised marriage and 50 family therapy experience, consisting of a minimum of three hundred (300) 51 direct client contact hours, of which one hundred fifty (150) hours shall be 52 with couples or families, as part of the graduate program. 53 (3) Supervised experience in marriage and family therapy of three thou- 54 sand (3,000) hours, acceptable to the board as defined by rule. A minimum of 55 two hundred (200) hours of supervision of the postgraduate experience. Super- 5 1 vision may be provided by a clinical member of the American association for 2 marriage and family therapy, by a licensed marriage and family therapist, or 3 another qualified licensed professional as determined by the board who has a 4 minimum of five (5) years experience providing marriage and family therapy, 5 including: a licensed professional counselor, private practice; psychologist; 6 certified social worker, private and independent practice; or psychiatrist. 7 (4) Successful completion of a written examination as approved by the 8 board and defined by rule. 9 (5)Once licensed, a licensed marriage and family therapist shall obtain10twenty (20) hours of continuing education per year as approved by the board.11(6)From the effective date of this section until June 30, 2003, any per- 12 son who meets the educational qualifications for an appropriate graduate 13 degree, as defined by the board, from an accredited educational institution so 14 recognized at the time of granting such degree, and who demonstrates three 15 thousand (3,000) hours of postgraduate experience providing marriage and fam- 16 ily therapy may upon application, finding of fitness, and payment of fees, be 17 issued a marriage and family therapist license. In determining if the educa- 18 tion and experience qualifications have been met, the board may consider a 19 current clinical membership in the American association of marriage and family 20 therapy or the national association of certified family therapy, or membership 21 in or certification by another appropriate professional organization, as 22 defined by the board, to be sufficient demonstration of the qualifications, 23 and may issue a marriage and family therapy license. 24 (76) A license or conditional license will not be allowed an individual 25 whose license, certification or registration has been revoked or suspended in 26 this or any other state and in this or any other related field. Such an indi- 27 vidual may not be licensed under this chapter unless the period of revocation 28 or suspension has been completed and the board has conducted a competency 29 review and determined that an acceptable degree of rehabilitation has been 30 accomplished.

Studies in this area 29 shall include: 30 (i) Research in marriage and family therapy or marriage and family 31 counseling and its application to working with couples and families; 32 and 33 (ii) Research methodology, quantitative and qualitative methods, 34 statistics, data analysis, ethics and legal considerations of con- 35 ducting research, and evaluation of research. 36 (2) Completion of a one (1) year practicum of supervised marriage and 37 family therapy experience, consisting of a minimum of three hundred (300) 38 direct client contact hours, of which one hundred fifty (150) hours shall be 39 with couples or families, as part of the graduate program. 40 (3) Supervised experience in marriage and family therapy of three thou- 41 sand (3,000) hours, acceptable to the board as defined by rule. A minimum of 42 two hundred (200) hours of supervision of the postgraduate experience. Super- 43 vision may be provided by a clinical member of the American association for 44 marriage and family therapy, by a licensed marriage and family therapist, or 45 another qualified licensed professional as determined by the board who has a 46 minimum of five (5) years experience providing marriage and family therapy, 47 including: a licensed professional counselor, private practice; psychologist; 48 certified social worker, private and independent practice; or psychiatrist. 49 (4) Successful completion of a written examination as approved by the 50 board and defined by rule. 51 (5)Once licensed, a licensed marriage and family therapist shall obtain52twenty (20) hours of continuing education per year as approved by the board.53(6)From the effective date of this section until June 30, 2003, any per- 54 son who meets the educational qualifications for an appropriate graduate 55 degree, as defined by the board, from an accredited educational institution so 4 1 recognized at the time of granting such degree, and who demonstrates three 2 thousand (3,000) hours of postgraduate experience providing marriage and fam- 3 ily therapy may upon application, finding of fitness, and payment of fees, be 4 issued a marriage and family therapist license. In determining if the educa- 5 tion and experience qualifications have been met, the board may consider a 6 current clinical membership in the American association of marriage and family 7 therapy or the national association of certified family therapy, or membership 8 in or certification by another appropriate professional organization, as 9 defined by the board, to be sufficient demonstration of the qualifications, 10 and may issue a marriage and family therapy license. 11 (76) A license or conditional license will not be allowed an individual 12 whose license, certification or registration has been revoked or suspended in 13 this or any other state and in this or any other related field. Such an indi- 14 vidual may not be licensed under this chapter unless the period of revocation 15 or suspension has been completed and the board has conducted a competency 16 review and determined that an acceptable degree of rehabilitation has been 17 accomplished.
STATEMENT OF PURPOSE RS 13483 Amend section 54-3404, Idaho Code, to correct terminology, provide references to pastoral counselors, and allow the board to adopt rules requiring continuing education for renewal of license; amend 54-3405A, Idaho Code to delete continuing education requirement for pastoral counselors; delete obsolete language; make a grammatical change; and make technical corrections; amend 54-3405C, Idaho Code to delete certain continuing education requirements; to delete obsolete language and to make technical corrections.
