]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature First Regular Session - 2005IN THE HOUSE OF REPRESENTATIVES HOUSE CONCURRENT RESOLUTION NO. 12 BY HEALTH AND WELFARE COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE CONCERNING A MODIFICATION TO EXISTING HOME 3 AND COMMUNITY-BASED DEVELOPMENTAL DISABILITIES WAIVER PROGRAMS THAT 4 INCLUDES AN OPPORTUNITY FOR INDIVIDUALS TO SELF-DIRECT THEIR OWN SERVICES 5 AND SUPPORTS, ENCOURAGING THE DEPARTMENT OF HEALTH AND WELFARE TO PROCEED 6 WITH WAIVERS AND OTHER IMPLEMENTATION PROCEDURES AND TO REPORT TO THE LEG- 7 ISLATURE. 8 Be It Resolved by the Legislature of the State of Idaho: 9 WHEREAS, the state of Idaho has home and community-based services avail- 10 able to eligible adults to avoid institutionalization; and 11 WHEREAS, the Department of Health and Welfare, in accordance with House 12 Concurrent Resolution No. 29 of the First Regular Session of the Fifty-seventh 13 Idaho Legislature, has been collaborating with the Idaho Council on Develop- 14 mental Disabilities, service providers, consumers and advocates to develop a 15 self-directed model of services and supports that provides an additional 16 option to home and community-based waiver recipients; and 17 WHEREAS, the Department of Health and Welfare collaborated with the Idaho 18 Council on Developmental Disabilities to obtain a grant to develop the neces- 19 sary infrastructure to provide a new option for receiving services and sup- 20 ports under existing waiver programs. 21 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session 22 of the Fifty-eighth Idaho Legislature, the House of Representatives and the 23 Senate concurring therein, that the Department is encouraged to proceed with 24 an application to amend its existing waivers for individuals with developmen- 25 tal disabilities to include a self-directed system option for all individuals 26 with developmental disabilities who are eligible for waiver services. This 27 option presents waiver recipients who are living in their own homes and commu- 28 nities with the opportunity to control and direct Medicaid funds. 29 BE IT FURTHER RESOLVED that the Legislature encourages the Department to 30 continue its collaboration with the Idaho Council on Developmental Disabili- 31 ties, as well as other stakeholders that represent other home and community- 32 based waiver participants. 33 BE IT FURTHER RESOLVED that the Legislature encourages the Department to 34 pursue a test program that provides for evaluation of the system design and 35 respond with necessary changes to meet the objectives of this new option. The 36 test should be of a size that provides sufficient information for statewide 37 implementation. Due to the initiative and time investment of the Idaho Council 38 on Developmental Disabilities, the service option would be offered to eligible 39 individuals under the Developmental Disabilities Home and Community-based 40 Waiver Program. The Legislature acknowledges that the test program will 41 require approval of the federal Centers for Medicare and Medicaid Services 42 (CMS) prior to implementation. 43 BE IT FURTHER RESOLVED that the infrastructure costs associated with the 44 test program, evaluation and start-up of statewide implementation are covered 2 1 by the Independence Plus Grant awarded to the Department of Health and Welfare 2 by the Centers for Medicare and Medicaid Services. However, after the third 3 year of the grant, ending September 30, 2006, there may be some additional 4 administrative costs associated with the implementation and ongoing monitoring 5 of this program. 6 BE IT FURTHER RESOLVED that the Department of Health and Welfare report 7 the results of the test program to the Second Regular Session of the 8 Fifty-eighth Idaho Legislature along with recommendations for any further 9 legislative action, including additional personnel needed by the Department 10 based on the findings of the test program.
STATEMENT OF PURPOSE RS 14459C2 This House Concurrent Resolution requests that the Legislature encourage the Department to amend its Medicaid home and community-based (HCBS) waiver programs to include a self-directed or self-determination model of services and supports option. This model would give eligible adults greater control and choice over their Medicaid services. This resolution incorporates a test program that will apply initially to the developmental disabilities program. It is contingent upon the Centers for Medicare and Medicaid approval. The model also would provide an evaluation component to determine the model s effectiveness and potential. Preliminary work on the proposed model began last year through a federal grant. The Department will report the results of the test program to the Legislature along with recommendations for further legislative action. FISCAL NOTE The development cost of this new service delivery model is covered under a $500,000 Independence Plus Grant awarded by the Centers for Medicare and Medicaid. The three-year grant began last year and runs through September 30, 2006. The Developmental Disabilities Council provides matching funds of $65,000 over the life of the grant. The grant pays for infrastructure development and implementation of the test program. Costs are estimated at $150,000 in this second year of the grant. After the test program has been completed and evaluated, the Department will provide the findings and projected costs of future implementation to the Legislature for further legislative action.
