]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature First Regular Session - 2005IN THE SENATE SENATE BILL NO. 1102 BY TRANSPORTATION COMMITTEE 1 AN ACT 2 RELATING TO PEDESTRIANS AND BICYCLES; AMENDING SECTION 49-715, IDAHO CODE, TO 3 PROVIDE THAT A PERSON OPERATING A VEHICLE BY HUMAN POWER UPON AND ALONG A 4 SIDEWALK, OR ACROSS A HIGHWAY UPON AND ALONG A CROSSWALK, SHALL HAVE ALL 5 THE RIGHTS AND DUTIES APPLICABLE TO A PEDESTRIAN UNDER THE SAME CIRCUM- 6 STANCES. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Section 49-715, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 49-715. RIDING ON BICYCLES. (1) A person propelling a bicycle shall not 11 ride other than upon or astride an attached permanent and regular seat. 12 (2) No bicycle or human-propelled vehicle shall be used to carry more 13 persons at one (1) time than the number for which it is designed and equipped. 14 (3) An adult rider may carry a child securely attached to his person in a 15 backpack or sling or in a child carrier attached to the bicycle. 16 (4) A person operating a vehicle by human power upon and along a side- 17 walk, or across a highway upon and along a crosswalk, shall have all the 18 rights and duties applicable to a pedestrian under the same circumstances.
STATEMENT OF PURPOSE RS 14819 This amendment clarifies that a bicyclist must obey the same rights and duties as pedestrians on sidewalks and crosswalks. FISCAL IMPACT There will be no fiscal impact to the State General Fund or local Governments for this change, with the exception of possibly reducing time in courts for people who are cited for violation of this statute.
