]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature First Regular Session - 2005IN THE SENATE SENATE BILL NO. 1131 BY TRANSPORTATION COMMITTEE 1 AN ACT 2 RELATING TO PEDESTRIANS AND BICYCLES; AMENDING SECTION 49-720, IDAHO CODE, TO 3 PROVIDE STOPPING REQUIREMENTS AT A STEADY RED TRAFFIC CONTROL LIGHT FOR 4 PERSONS OPERATING A BICYCLE OR A HUMAN-POWERED VEHICLE. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 49-720, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 49-720. STOPPING -- TURN AND STOP SIGNALS. (1) A person operating a bicy- 9 cle or human-powered vehicle approaching a stop sign shall slow down and, if 10 required for safety, stop before entering the intersection. After slowing to a 11 reasonable speed or stopping, the person shall yield the right-of-way to any 12 vehicle in the intersection or approaching on another highway so closely as to 13 constitute an immediate hazard during the time the person is moving across or 14 within the intersection or junction of highways, except that a person after 15 slowing to a reasonable speed and yielding the right-of-way if required, may 16 cautiously make a turn or proceed through the intersection without stopping. 17 (2) A person operating a bicycle or human-powered vehicle approaching a 18 steady red traffic controlsignallight shall stop before entering the inter- 19 section, exceptand shall yield to all other traffic. Once the person has 20 yielded, he may proceed through the steady red light with caution. Provided 21 however, that a person after slowing to a reasonable speed and yielding the 22 right-of-way if required, may cautiously make a right-hand turn.without stop-23ping or may cautiously make aA left-hand turn onto a one-way highwaywithout24 may be made on a red light after stopping and yielding to other traffic. 25 (3) A person riding a bicycle shall comply with the provisions of section 26 49-643, Idaho Code. 27 (4) A signal of intention to turn right or left shall be given during not 28 less than the last one hundred (100) feet traveled by the bicycle before turn- 29 ing, provided that a signal by hand and arm need not be given if the hand is 30 needed in the control or operation of the bicycle.
STATEMENT OF PURPOSE RS 14956 This amendment clarifies that a bicyclist must stop at a red traffic light and yield to oncoming traffic. It does not change the current law regarding making a right-hand turn or making a left-hand turn onto a one-way street. This proposed amendment is designed to make the road safer for bicyclists.
