1 AN ACT
2 APPROPRIATING MONEYS TO THE DEPARTMENT OF ENVIRONMENTAL QUALITY FOR FISCAL
3 YEAR 2006; LIMITING THE NUMBER OF FULL-TIME EQUIVALENT POSITIONS; PROVID-
4 ING THAT THE STATE CONTROLLER SHALL MAKE TRANSFERS TO THE ENVIRONMENTAL
5 REMEDIATION FUND; EXPRESSING LEGISLATIVE INTENT REGARDING THE ENVIRONMEN-
6 TAL REMEDIATION FUND AND REQUIRING AN ANNUAL REPORT; EXPRESSING LEGISLA-
7 TIVE INTENT WITH REGARD TO USE OF THE WATER POLLUTION CONTROL FUND; AND
8 EXPRESSING LEGISLATIVE INTENT THAT ANY UNEXPENDED AND UNENCUMBERED BAL-
9 ANCES IN THE BIG PAYETTE LAKE WATER QUALITY COUNCIL ADMINISTRATIVE ACCOUNT
10 BE TRANSFERRED TO THE DEPARTMENT OF ENVIRONMENTAL QUALITY FUND.
11 Be It Enacted by the Legislature of the State of Idaho:
12 SECTION 1. There is hereby appropriated to the Department of Environmen-
13 tal Quality the following amounts to be expended for the designated programs
14 according to the designated expense classes from the various funds listed for
15 the period July 1, 2005, through June 30, 2006:

35 SECTION 2. In accordance with Section 67-3519, Idaho Code, the Department
36 of Environmental Quality is authorized no more than three hundred seventy-four
37 and fifty-five hundredths (374.55) full-time equivalent positions at any point
38 during the period July 1, 2005, through June 30, 2006, unless specifically
39 authorized by the Governor. The Joint Finance-Appropriations Committee will be
40 notified promptly of any increased positions so authorized.
41 SECTION 3. Notwithstanding the provisions of Section 39-3630, Idaho Code,
42 the State Controller is hereby directed to transfer $1,500,000 from the Water
43 Pollution Control Fund to the Environmental Remediation Fund (Basin) for the
44 period July 1, 2005, through June 30, 2006.
45 SECTION 4. It is legislative intent that moneys deposited into the Envi-
46 ronmental Remediation Fund (Basin) are to be used for remediation of the Coeur
47 d'Alene Basin in accordance with the superfund contract with the Environmental
48 Protection Agency. The Department of Environmental Quality shall file an
49 annual report no later than January 1 of each year with the Governor, the Leg-
50 islature, and the Coeur d"Alene Basin Environmental Improvement Project Com-
51 mission on the remediation progress and the expenditures involved.

1 SECTION 5. It is legislative intent that the appropriation of moneys from
2 the Water Pollution Control Fund in Section 1 of this act specifically super-
3 sedes the provisions of Section 39-3630, Idaho Code.
4 SECTION 6. Whereas, the Big Payette Lake Water Quality Council estab-
5 lished by Section 39-6603, Idaho Code, will disband in March 2005, it is leg-
6 islative intent that any unexpended and unencumbered balances in the Big Pay-
7 ette Lake Water Quality Council Administrative Account be transferred to the
8 Department of Environmental Quality Fund to be used to further protect, pre-
9 serve and improve the water quality of Big Payette Lake.

This is the fiscal year 2006 appropriation to the Department of Environmental Quality in the amount of $52,088,300 of which $15,406,700 is from the General Fund, $6,788,100 is from dedicated funds, and $29,893,500 is from federal funds. Section 2 places a cap of 374.55 on the number of authorized full-time equivalent positions. Sections 3 and 4 direct the State Controller to transfer $1,500,000 from the Water Pollution Control Fund to the Environmental Remediation Fund and to use those moneys for remediation of the Coeur d’Alene Basin. Section 5 provides that the Water Pollution Control Funds appropriated for the Water Quality Program may be used for water quality monitoring. Section 6 is due to the disbanding of the Big Payette Lake Water Quality Council. It authorizes the transfer of the remaining unencumbered balances in the Big Payette Lake Water Quality Council Administrative Account to the Department of Environmental Quality Fund to be used to protect and improve the water quality of Big Payette Lake (about $23,400).
