]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 625 BY EDUCATION COMMITTEE 1 AN ACT 2 RELATING TO PUBLIC CHARTER SCHOOLS; AMENDING SECTION 33-5210, IDAHO CODE, TO 3 REQUIRE THE STATE BOARD OF EDUCATION TO ADOPT RULES ON SATISFACTORY PROOF 4 OF ADDRESS FOR CHILDREN ATTENDING PUBLIC VIRTUAL SCHOOLS. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 33-5210, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 33-5210. APPLICATION OF SCHOOL LAW -- ACCOUNTABILITY -- EXEMPTION FROM 9 STATE RULES. (1) All public charter schools are under the general supervision 10 of the state board of education. 11 (2) Every authorized chartering entity that approves a charter shall be 12 responsible for ensuring that each public charter school program approved by 13 that authorized chartering entity meets the terms of the charter, complies 14 with the general education laws of the state unless specifically directed 15 otherwise in this chapter 52, title 33, Idaho Code, and operates in accordance 16 with the state educational standards of thoroughness as defined in section 17 33-1612, Idaho Code. 18 (3) Each charter school shall comply with the financial reporting 19 requirements of section 33-701, subsections 5. through 10., Idaho Code, in the 20 same manner as those requirements are imposed upon school districts. 21 (4) Each public charter school is otherwise exempt from rules governing 22 school districts which have been promulgated by the state board of education, 23 with the exception of state rules relating to: 24 (a) Waiver of teacher certification as necessitated by the provisions of 25 section 33-5205(3)(g), Idaho Code; 26 (b) Accreditation of the school as necessitated by the provisions of sec- 27 tion 33-5205(3)(e), Idaho Code; 28 (c) Qualifications of a student for attendance at an alternative school 29 as necessitated by the provisions of section 33-5208(3), Idaho Code; 30 (d) The requirement that all employees of the school undergo a criminal 31 history check as required by section 33-130, Idaho Code; and 32 (e) All rules which specifically pertain to public charter schools pro- 33 mulgated by the state board of education. 34 (5) The state board of education shall adopt rules to require satisfac- 35 tory proof of address for students attending public virtual schools at regis- 36 tration and at least once more during the school year to ensure that children 37 attending public virtual schools reside in a permanent place of residence 38 within the authorized jurisdiction of the public virtual school.
