]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE HOUSE OF REPRESENTATIVES HOUSE CONCURRENT RESOLUTION NO. 40 BY HEALTH AND WELFARE COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND REQUESTING THE DEPARTMENT OF HEALTH 3 AND WELFARE AND THE OFFICE OF THE ATTORNEY GENERAL TO DEVELOP A STATEWIDE, 4 UNIVERSAL SYSTEM AND FORM FOR PHYSICIAN ORDERS FOR LIFE-SUSTAINING TREAT- 5 MENT AND TO REPORT THEIR PROPOSALS TO THE LEGISLATURE. 6 Be It Resolved by the Legislature of the State of Idaho: 7 WHEREAS, physician orders for life-sustaining treatment are voluntary and 8 are intended to help the patient and the patient's physician or nurse practi- 9 tioner discuss and develop plans that reflect the patient's wishes; and 10 WHEREAS, physician orders for life-sustaining treatment are written 11 instructions stating the patient's intent on how the patient's medical deci- 12 sions are to be made if the patient is unable to make that decision; and 13 WHEREAS, physicians, nurses, emergency medical personnel and health care 14 facilities strive to honor and carry out patient intent on life-sustaining 15 treatment; and 16 WHEREAS, Idaho does not have a statewide, universal form for physician 17 orders for life-sustaining treatment; and 18 WHEREAS, some physician orders for life-sustaining treatment are recog- 19 nized in some care settings but not in others and may not be recognized by 20 emergency medical personnel or other health care providers. 21 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses- 22 sion of the Fifty-eighth Idaho Legislature, the House of Representatives and 23 the Senate concurring therein, that the Department of Health and Welfare and 24 the Office of the Attorney General are requested to develop a statewide, uni- 25 versal system or form for physician orders for life-sustaining treatment. The 26 Department of Health and Welfare and the Office of the Attorney General are 27 requested to work with representatives of emergency medical services, hospi- 28 tals, physicians, health care facilities and other interested parties to 29 develop the specific system or form for physician orders for life-sustaining 30 treatment, including the statewide and universal application and implementa- 31 tion guidelines. These parties are requested to bring a report to the First 32 Regular Session of the Fifty-ninth Idaho Legislature outlining their propos- 33 als. Legislation, if necessary, may be drafted by the Office of the Attorney 34 General to implement these suggestions.
STATEMENT OF PURPOSE RS 16008 The purpose of this resolution is to request that the Department of Health and Welfare and the Attorney General develop a statewide, universal system or form for physician orders for life-sustaining treatment.
