]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE HOUSE OF REPRESENTATIVES HOUSE JOINT MEMORIAL NO. 19 BY REVENUE AND TAXATION COMMITTEE 1 A JOINT MEMORIAL 2 TO THE SENATE AND HOUSE OF REPRESENTATIVES OF THE UNITED STATES IN CONGRESS 3 ASSEMBLED, AND TO THE CONGRESSIONAL DELEGATION REPRESENTING THE STATE OF 4 IDAHO IN THE CONGRESS OF THE UNITED STATES. 5 We, your Memorialists, the House of Representatives and the Senate of the 6 State of Idaho assembled in the Second Regular Session of the Fifty-eighth 7 Idaho Legislature, do hereby respectfully represent that: 8 WHEREAS, in April 2005 the United States Department of Agriculture 9 released a Draft Strategic Plan and Draft Program Standards for implementing a 10 mandatory National Animal Identification System, commonly referred to as NAIS; 11 and 12 WHEREAS, the NAIS is a national program intended to register premises 13 where livestock are raised or held and to identify all agricultural animals 14 and track them as they come into contact with, or are intermixed with, animals 15 other than herdmates from their premises of origin; and 16 WHEREAS, the USDA has set July 2006 as the target date for issuance of a 17 proposed rule setting forth the requirements for NAIS premises registration, 18 animal identification and animal tracking and, pursuant to the plan timetable, 19 premises identification and individual animal identification will be mandatory 20 as of January 1, 2008, provided however, the USDA could advance or delay this 21 timetable; and 22 WHEREAS, there are numerous concerns regarding the NAIS program, including 23 concerns relating to costs, confidentiality of information and liability; and 24 WHEREAS, although significant costs associated with the program are antic- 25 ipated, costs have not been quantified and there are ongoing uncertainties 26 regarding how the costs will be shared; and 27 WHEREAS, concerns relating to confidentiality exist in terms of which 28 entities and agencies will have access to registration and identification 29 data, how the data will be used, and whether the general public will have 30 access to the data; and 31 WHEREAS, many in the agriculture industry have expressed concerns regard- 32 ing the use of information by individuals for food safety issues and that the 33 traceability of food products would increase participants' risk of liability 34 and financial loss from food safety issues for which they are not responsible; 35 and 36 WHEREAS, given the uncertainties and risks associated with the NAIS pro- 37 gram, residents of the state of Idaho oppose the program and oppose mandatory 38 premises identification, individual animal identification and animal tracking. 39 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses- 40 sion of the Fifty-eighth Idaho Legislature, the House of Representatives and 41 the Senate concurring therein, that we urge the United States Department of 42 Agriculture to forgo implementation of the NAIS program, or alternatively, to 43 delay the issuance of the proposed rule which will set forth NAIS requirements 44 now targeted for July 2006 to afford the public additional information relat- 2 1 ing to the proposed mandatory program and additional time for public comment. 2 BE IT FURTHER RESOLVED that the Chief Clerk of the House of Representa- 3 tives be, and she is hereby authorized and directed to forward a copy of this 4 Memorial to the President of the Senate and the Speaker of the House of Repre- 5 sentatives of Congress, and the congressional delegation representing the 6 State of Idaho in the Congress of the United States.
