]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 633 BY WAYS AND MEANS COMMITTEE 1 AN ACT 2 RELATING TO VEHICLE REGISTRATION FEES; AMENDING SECTION 49-402, IDAHO CODE, TO 3 INCREASE THE ANNUAL REGISTRATION FEE ON CERTAIN SCHOOL BUSES, MOTORCYCLES 4 AND ALL-TERRAIN VEHICLES; AMENDING SECTION 49-402A, IDAHO CODE, TO 5 INCREASE THE FEES ON UTILITY TRAILERS; AMENDING SECTION 49-411, IDAHO 6 CODE, TO INCREASE THE FEE TO VALIDATE A DEALER OR MANUFACTURER NUMBER 7 PLATE; AND PROVIDING AN EFFECTIVE DATE. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 49-402, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 49-402. ANNUAL REGISTRATION. (1) The annual fee for operating each pickup 12 truck, each neighborhood electric vehicle and each other motor vehicle having 13 a maximum gross weight not in excess of eight thousand (8,000) pounds shall 14 be: 15 Vehicles one (1) and two (2) years old ............................ $48.00 16 Vehicles three (3) and four (4) years old ......................... $36.00 17 Vehicles five (5) and six (6) years old ........................... $36.00 18 Vehicles seven (7) and eight (8) years old ........................ $24.00 19 Vehicles over eight (8) years old ................................. $24.00 20 There shall be twelve (12) registration periods, starting in January for 21 holders of validation registration stickers numbered 1, and proceeding consec- 22 utively through December for holders of validation registration stickers num- 23 bered 12, each of which shall start on the first day of a calendar month and 24 end on the last day of the twelfth month from the first day of the beginning 25 month. Registration periods shall expire midnight on the last day of the reg- 26 istration period in the year designated by the validation registration 27 sticker. The numeral digit on the validation registration stickers shall, as 28 does the registration card, fix the registration period under the staggered 29 plate system of Idaho for the purpose of reregistration and notice of expira- 30 tion. 31 A vehicle that has once been registered for any of the above designated 32 periods shall, upon reregistration, be registered for the period bearing the 33 same number, and the registration card shall show and be the exclusive proof 34 of the expiration date of registration and licensing. Vehicles may be ini- 35 tially registered for less than a twelve (12) month period, or for more than a 36 twelve (12) month period, and the fee prorated on a monthly basis if the frac- 37 tional registration tends to fulfill the purpose of the monthly series regis- 38 tration system. 39 (2) For all school buses operated either by a nonprofit, nonpublic school 40 or operated pursuant to a service contract with a school district for trans- 41 porting children to or from school or in connection with school approved 42 activities, the annual fee shall betwentyfifty-four dollars ($254.00). 43 (3) For all motorcycles and all-terrain vehicles operated upon the public 2 1 highways the annual fee shall benineeighteen dollars ($918.00). For opera- 2 tion of an all-terrain vehicle or motorcycle off the public highways, the fee 3 specified in section 67-7122, Idaho Code, shall be paid. Registration exemp- 4 tions provided in section 49-426(2), (3) and (4), Idaho Code, apply to all- 5 terrain vehicles and motorcycles used for the purposes described in subsec- 6 tions (2), (3) and (4) of section 49-426, Idaho Code. 7 (4) For all motor homes the fee shall be as specified in subsection (1) 8 of this section and shall be in addition to the fees provided for in section 9 49-445, Idaho Code. 10 (5) Registration fees shall not be subject to refund. 11 (6) A financial institution or repossession service contracted to a 12 financial institution repossessing vehicles under the terms of a security 13 agreement shall move the vehicle from the place of repossession to the finan- 14 cial institution's place of business on a repossession plate. The repossession 15 plate shall also be used for demonstrating the vehicle to a prospective pur- 16 chaser for a period not to exceed ninety-six (96) hours. The registration fees 17 for repossession plates shall be as required in subsection (1) of this section 18 for a vehicle one (1) and two (2) years old. All other fees required under 19 chapter 4, title 49, Idaho Code, shall be in addition to the registration fee. 20 The repossession plate shall be issued on an annual basis by the department. 21 (7) In addition to the annual registration fee in this section, there 22 shall be an initial program fee of twenty-five dollars ($25.00) and an annual 23 program fee of fifteen dollars ($15.00) for all special license plate programs 24 for those license plates issued pursuant to sections 49-404A, 49-407, 49-408, 25 49-409, 49-414, 49-416, 49-418 and 49-418D, Idaho Code. For special plates 26 issued pursuant to sections 49-406 and 49-406A, Idaho Code, there shall be an 27 initial program fee of twenty-five dollars ($25.00) but there shall be no 28 annual renewal fee. For special plates issued pursuant to sections 49-415C, 29 49-415D, 49-416A, 49-416B, 49-416C, 49-416D, 49-416E, 49-417, 49-417A, 30 49-417B, 49-417C, 49-418A, 49-418B, 49-418C, 49-418E, 49-419, 49-419A, 31 49-419B, 49-419C, 49-419D, 49-420, 49-420A, 49-420B, 49-420C, 49-420D, 49-420E 32 and 49-420G, Idaho Code, there shall be an initial program fee of thirty-five 33 dollars ($35.00) and an annual program fee of twenty-five dollars ($25.00). 34 The fees contained in this subsection shall be applicable to all new special 35 plate programs. The initial program fee and the annual program fee shall be 36 deposited in the state highway account and shall be used to fund the cost of 37 administration of special license plate programs, unless otherwise specified 38 by law. 39 SECTION 2. That Section 49-402A, Idaho Code, be, and the same is hereby 40 amended to read as follows: 41 49-402A. UTILITY TRAILERS -- REGISTRATION, FEES AND TRANSFERS. (1) The 42 department shall register a utility trailer for a period of one (1) year for a 43 fee offiveten dollars ($510.00). 44 (2) The department may register a utility trailer for a five (5) year 45 period or for a ten (10) year period, and shall issue a license plate with the 46 year of expiration designated by a validation sticker. Five (5) year registra- 47 tions shall costtwentyforty dollars ($240.00) and ten (10) year registra- 48 tions shall costthirtysixty dollars ($360.00). 49 (3) If ownership or interest in the trailer transfers as a result of a 50 sale, neither the registration card nor plate can be transferred to another 51 person. The registration card and plate shall remain in the possession of the 52 transferor and may be transferred to another utility trailer owned by the 53 transferor, and shall be valid until expiration of the original registration. 3 1 SECTION 3. That Section 49-411, Idaho Code, be, and the same is hereby 2 amended to read as follows: 3 49-411. DEALER AND MANUFACTURER PLATE -- FEES. (1) Any person conducting 4 the business of manufacturing, buying, selling or dealing in vehicles, and 5 licensed as a manufacturer of or a dealer in vehicles, and owning and operat- 6 ing any such vehicle upon any highway may, in lieu of registering each vehicle 7 obtain from the department upon application on the proper form and payment of 8 the required fee, and attach to each vehicle, one (1) number plate as required 9 for different classes of vehicles in section 49-434, Idaho Code. The special 10 number plate shall bear a distinctive number assigned to the manufacturer or 11 dealer, the name of this state, which may be abbreviated, and the year for 12 which the plate is issued, together with words which may be abbreviated or a 13 distinguishing symbol indicating that the plate is issued to a manufacturer or 14 dealer. 15 (a) Dealer license plates shall be limited to two (2) license plates for 16 up to twenty (20) vehicles sold during the previous dealer licensing 17 period and one (1) license plate for each ten (10) additional vehicles 18 sold during the previous dealer licensing period. Any new dealer who 19 applies for a dealer license shall be eligible for the number of dealer 20 plates requested based on the number of vehicles that the dealer estimates 21 he will sell during the first year of licensure. 22 (b) Upon renewal of a dealer's license, the department may audit vehicle 23 sales from previous years to determine the number of dealer plates that 24 will be authorized for the current dealer licensing period. 25 (2) The fee to validate a dealer or manufacturer number plate shall be 26twelvetwenty-four dollars ($124.00) for each validation sticker. 27 (3) All such fees shall be paid to the state treasurer and deposited to 28 the state highway account. 29 SECTION 4. This act shall be in full force and effect on and after Janu- 30 ary 1, 2009.
STATEMENT OF PURPOSE RS 18100C1 This legislation is a revision to annual registration fees for school buses operated either by a non-profit, non-public or operated pursuant to a service contract with a school district for transportation, for all motorcycles and all-terrain vehicles operated on public highways, utility trailers and dealer and manufacturer plates. To increase the annual registration fees by thirty dollars ($30.00), nine dollars ($9.00), five dollars ($5.00) and twelve dollars ($12.00) respectively. The funds raised by this increase shall be placed in the Highway distribution Account and shall be distributed to the State Highway Department and cities and counties appropriately. FISCAL NOTE There will be an increase in funds raised by this bill of approximately $1,150,000 for the Highway Distribution Account. There are approximately 99,000 registrations affected by this legislation.
