]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE SENATE SENATE BILL NO. 1407 BY EDUCATION COMMITTEE 1 AN ACT 2 RELATING TO SCHOLARSHIPS; AMENDING SECTION 33-4302, IDAHO CODE, TO PROVIDE FOR 3 ADDITIONAL SCHOLARSHIP ELIGIBILITY, TO DEFINE A TERM AND TO MAKE TECHNICAL 4 CORRECTIONS. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 33-4302, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 33-4302. SCHOLARSHIPS -- STATE AID. (1) The following individuals shall 9 be eligible for the scholarship program provided for herein: 10 (a) Any dependent of any Idaho citizen who is a resident of the state of 11 Idaho on or after the effective date of this act and who has been deter- 12 mined by the federal government to be a prisoner of war or missing in 13 action; or to have died of, or become disabled by, injuries or wounds sus- 14 tained in action in southeast Asia, including Korea, or in Iraq or in 15 Afghanistan or who shall become so hereafter, in any area of armed con- 16 flict in which the United States is a party; and 17 (b) Any dependent of any member of the armed forces of the United States 18 who is stationed in the state of Idaho on military orders and who is 19 deployed from the state of Idaho to any area of armed conflict in which 20 the United States is a party and who has been determined by the federal 21 government to be a prisoner of war or missing in action; or to have died 22 of, or become disabled by, injuries or wounds sustained in action as a 23 result of such deployment. Provided further, that such dependent must be a 24 resident of the state of Idaho and must have completed secondary school or 25 its equivalent in the state of Idaho. 26 (2) An eligible individual who applies for the scholarship provided for 27 herein shall, after verification of eligibility, receive the scholarship and 28 be admitted to attend any public institution of higher education or public 29 professional-technical college within the state of Idaho without the necessity 30 of paying tuition and fees therefor; such student shall be provided with 31 books, equipment and supplies necessary for pursuit of such program of enroll- 32 ment not to exceed five hundred dollars ($500) per quarter, semester, intensi- 33 fied semester, or like educational period; such student shall be furnished on- 34 campus housing and subsistence for each month he or she is enrolled under this 35 program and actually resides in such on-campus facility; provided, however, 36 that such educational benefits shall not exceed a total of thirty-six (36) 37 months or four (4) nine (9) month periods. Provided further, that the initia- 38 tion of such educational benefits shall extend for a period of ten (10) years 39 after achieving a high school diploma or its equivalency, or for a period of 40 ten (10) years after the event giving rise to the eligibility for the scholar- 41 ship, whichever is longer. 42 (3) The dependent shall meet such other educational qualifications as 43 such institution of higher education or professional-technical college has 2 1 established for other prospective students of this state. 2 (4) Application for eligibility under this section shall be made to the 3 state board of education and the board of regents of the university of Idaho 4 or the state board of vocational-technical education. The board shall verify 5 the eligibility of the dependent and communicate such eligibility to the 6 dependent and the affected institution or college. 7 (5) Affected institutions shall in their preparation of future budgets 8 include therein costs resultant from such tuition, fee, book, equipment, sup- 9 ply, housing and subsistence loss for reimbursement thereof from appropria- 10 tions of state funds. 11 For the purposes of this section, a member of the armed forces of the 12 United States is considered disabled if he or she is unable to perform with 13 reasonable continuity the material duties of any gainful occupation for which 14 he or she is reasonably fitted by education, training and experience. 15 (6) Applicants for the scholarship program herein prescribed shall pro- 16 vide institutional administrative personnel with documentation of their rights 17 under this act.
STATEMENT OF PURPOSE RS 17778 This bill provides for a scholarship for dependents of Idaho's members of the military service who are disabled (totally and permanently from any employment), as a result of injuries incurred while engaged in the conflict in Iraq and Afghanistan. FISCAL NOTE The fiscal impact is dependent upon the total number of Idaho military personnel who incur disabling injuries while serving their state and nation in Operation Iraqi Freedom and Operation Enduring Freedom. A fiscal impact is expected of $13,000 per student per year of scholarship granted. Annual fiscal impact would be $65,000 beginning FY 2010 and for the following ten years. Contact Name: Sen.
