|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature First Regular Session - 2001IN THE SENATE SENATE BILL NO. 1179 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO AUDITORIUM DISTRICTS; AMENDING CHAPTER 49, TITLE 67, IDAHO CODE, 3 BY THE ADDITION OF A NEW SECTION 67-4931, IDAHO CODE, TO PROVIDE APPLICA- 4 TION OF THE CAMPAIGN REPORTING AND LIMITATIONS UPON CONTRIBUTIONS LAW TO 5 AUDITORIUM DISTRICT ELECTIONS. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Chapter 49, Title 67, Idaho Code, be, and the same is 8 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 9 ignated as Section 67-4931, Idaho Code, and to read as follows: 10 67-4931. APPLICATION OF CAMPAIGN REPORTING LAW TO AUDITORIUM DISTRICT 11 ELECTIONS. The provisions of sections 67-6601 through 67-6616, Idaho Code, and 12 sections 67-6623 through 67-6628, Idaho Code, insofar as they relate to the 13 reporting of campaign contributions and expenditures are hereby made applica- 14 ble to all elections for auditorium district commissioners and all elections 15 for the creation or dissolution of an auditorium district, except that the 16 clerk of the county wherein the district is organized shall stand in place of 17 the secretary of state. 18 For the purposes of the application of contribution limits to auditorium 19 districts, aggregate contributions made by a corporation, political committee, 20 other recognized legal entity or an individual, supporting or opposing the 21 formation of an auditorium district shall be limited to five thousand dollars 22 ($5,000). Aggregate contributions made by a corporation, political committee, 23 other recognized legal entity or an individual, other than a candidate, to a 24 candidate for director of an auditorium district in an auditorium district 25 election shall be limited to one thousand dollars ($1,000). For purposes of 26 complying with reporting deadlines, an election to form an auditorium district 27 or to elect directors of an auditorium district shall be deemed to be a gen- 28 eral election.

STATEMENT OF PURPOSE RS 11137C1 This legislation applies the Idaho Campaign Finance Disclosure Act (“Sunshine Law”) to Auditorium District elections. The Sunshine Act now applies to other special district elections, such as Highway District elections. This legislation makes this special district conform to the same public policy.
