 1                                        AN ACT
 2    RELATING TO THE DUTIES OF THE STATE FIRE MARSHAL;  REPEALING  SECTION  41-267,
 3        IDAHO CODE.

 4    Be It Enacted by the Legislature of the State of Idaho:

 5        SECTION  1.  That  Section  41-267, Idaho Code, be, and the same is hereby
 6    repealed.

    STATEMENT OF PURPOSE

    Section 41-267, Idaho Code, presently gives the State Fire Marshal the authority to grant 
    adjustments or variances to the act relating to fire protection and fire prevention if the act causes 
    financial or unnecessary hardship to the owner or occupant of property. This section is 
    confusing and places the Fire Marshal in direct conflict with the local jurisdictions he is, by 
    statute (Idaho Code, 41-257), required to assist. This legislation repeals Section 41-267, Idaho 
    Code, in its entirety.
