H0474|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 474 BY GAGNER 1 AN ACT 2 RELATING TO EASTERN IDAHO TECHNICAL COLLEGE; AMENDING SECTION 33-2208, IDAHO 3 CODE, TO PROVIDE CORRECT TERMINOLOGY AND TO MAKE A TECHNICAL CORRECTION; 4 AMENDING SECTION 33-2210, IDAHO CODE, TO CLARIFY THAT INSTRUCTIONAL PRO- 5 GRAMS HAVE BEEN APPROVED BY THE STATE BOARD FOR VOCATIONAL EDUCATION, TO 6 PROVIDE FOR THE GRANTING OF AN ASSOCIATE DEGREE AND TO PROVIDE FOR TRANS- 7 FERABILITY OF COURSES; AND AMENDING SECTION 33-2211, IDAHO CODE, TO CHANGE 8 THE TITLE OF SUPERINTENDENT TO PRESIDENT OF THE COLLEGE, TO PROVIDE FOR 9 THE GRANTING OF AN ASSOCIATE DEGREE AND TO MAKE A TECHNICAL CORRECTION. 10 Be It Enacted by the Legislature of the State of Idaho: 11 SECTION 1. That Section 33-2208, Idaho Code, be, and the same is hereby 12 amended to read as follows: 13 33-2208. EASTERN IDAHO TECHNICAL COLLEGE CREATED. There is hereby estab- 14 lished in Bonneville County, Idaho apost-secondary vocational school15post-secondary technical college to be designated and 16 known as the Eastern Idaho Technical College, consisting of such vocational 17 and technical trainingcoursesprograms, including academic 18 courses necessarily included in such programs, as the state board for 19 vocational education may, from time to time authorize. 20 SECTION 2. That Section 33-2210, Idaho Code, be, and the same is hereby 21 amended to read as follows: 22 33-2210.COURSESPROGRAMS, CERTIFICATES AND DEGREES 23 OFFERED .-- CERTIFICATES OF COMPLETION.The 24 Eastern Idaho Technical College shall offer and give instruction in vocational 25 and technicalcourses as are usually included in post-secondary26 programs as approved by the state board for vocational27schoolseducation . Such courses or programs may be given 28 or conducted on or off campus, or in night school, summer school, or by exten- 29 sion courses. The state board for vocational education shall grant certifi- 30 cates of completion , or associate of applied science degrees for 31 successful completion of courses or programs prescribed by the college. 32 The transferability of the Eastern Idaho Technical College courses shall be as 33 approved by the state board of education. 34 SECTION 3. That Section 33-2211, Idaho Code, be, and the same is hereby 35 amended to read as follows: 36 33-2211. POWERS OF STATE BOARD FOR VOCATIONAL EDUCATION. The state board 37 for vocational education shall have the power: 38 1. To adopt rulesand regulationsfor its own government and 39 the government of the Eastern Idaho Technical College; 2 1 2. To employ professional and nonprofessional persons and to prescribe 2 their qualifications; 3 3. To acquire and hold, and to dispose of, real and personal property, 4 and to construct, repair, remodel and remove buildings; 5 4. To contract for the acquisition, purchase or repair of buildings, in 6 the manner prescribed for trustees of school districts; 7 5. To dispose of real and personal property in the manner prescribed for 8 trustees of school districts; 9 6. To convey and transfer real property of the college upon which no 10 buildings used for instruction are situated, to nonprofit corporations, school 11 districts, community college housing commissions, counties or municipalities, 12 with or without consideration; to rent real or personal property for the use 13 of the college, its students or faculty, for such terms as may be determined 14 by the state board for vocational education; and to lease real or personal 15 property of the college not actually in use for instructional purposes on such 16 terms as may be determined by the state board for vocational education; 17 7. To acquire, hold, and dispose of, water rights; 18 8. To accept grants or gifts of money, materials, or property of any kind 19 from any governmental agency, or from any person, firm, or association, on 20 such terms as may be determined by the grantor; 21 9. To cooperate with any governmental agency, or any person, firm or 22 association in the conduct of any educational program; to accept grants from 23 any source for the conduct of such program, and to conduct such program on, or 24 off, campus; 25 10. To employ asuperintendentpresident of the 26 college and, with his advice, to appoint such assistants, instructors, spe- 27 cialists and other employees as are required for the operation of the college; 28 to fix salaries and prescribe duties; and to remove thesuperintendent29president or any other employee for cause; 30 11. With the advice of thesuperintendentpresident 31 , to prescribe the courses and programs of study, the requirements for 32 admission, the time and standards for completion of such courses and programs, 33 and to grant certificates of completion or associate of applied science 34 degrees for those students entitled thereto; 35 12. To employ architects or engineers in planning the construction, remod- 36 eling or repair of any building or property and, whenever no other agency is 37 designated by law so to do, to let contracts for such construction, remodeling 38 or repair and to supervise the work thereof; 39 13. To have at all times, general supervision and control of all property, 40 real and personal, appertaining to the college, and to insure the same.
STATEMENT OF PURPOSE RS 07520 To update current code for the awarding of associate of applied science degrees that are being used at Eastern Idaho Technical College as approved by the State Board of Education. To insure transferability of academic courses and to more correctly define the role of the head of the college. FISCAL NOTE None.
