PLUMBERS - Amends existing law to provide that the issuance of certificates
of competency to plumbers shall be within the exclusive jurisdiction of the
state and to prohibit local jurisdictions from requiring or issuing
certificates of competency or licenses to plumbers possessing certificates

Safety.

 1                                        AN ACT
 2    RELATING TO PLUMBERS; AMENDING SECTION 54-2610, IDAHO CODE,  TO  PROVIDE  THAT
 3        THE ISSUANCE OF CERTIFICATES OF COMPETENCY TO PLUMBERS SHALL BE WITHIN THE
 4        EXCLUSIVE  JURISDICTION  OF  THE STATE AND TO PROHIBIT LOCAL JURISDICTIONS
 5        FROM REQUIRING OR ISSUING CERTIFICATES OF COMPETENCY OR LICENSES TO PLUMB-
 6        ERS POSSESSING CERTIFICATES OF COMPETENCY ISSUED BY THE  ADMINISTRATOR  OF
 7        THE  DIVISION OF BUILDING SAFETY, TO PROVIDE THAT THE STATE SHALL INVESTI-
 8        GATE AND PROSECUTE LOCAL INFRACTIONS AND STATE VIOLATIONS OF  THE  CHAPTER
 9        WITH  THE ASSISTANCE OF LOCAL JURISDICTIONS AND TO PROVIDE THAT NOTHING IN
10        THE CHAPTER SHALL RESTRICT A CITY OR COUNTY FROM IMPOSING STRICTER  PUBLIC
11        SAFETY  RULES;  AND  AMENDING SECTION 54-2619, IDAHO CODE, TO PROVIDE THAT
12        CITIES SHALL NOT REQUIRE ANY ADDITIONAL CERTIFICATE OF COMPETENCY OR SEPA-
13        RATE LICENSE FROM A PLUMBING CONTRACTOR OR JOURNEYMAN POSSESSING  A  VALID
14        CERTIFICATE  OF  COMPETENCY ISSUED BY THE ADMINISTRATOR OF THE DIVISION OF
15        BUILDING SAFETY.

16    Be It Enacted by the Legislature of the State of Idaho:

17        SECTION 1.  That Section 54-2610, Idaho Code, be, and the same  is  hereby
18    amended to read as follows:

19        54-2610.  CERTIFICATE  A  PREREQUISITE    --  CERTIFICATION AUTHORITY
20    EXCLUSIVE TO THE STATE .  (1)  It shall be unlawful  for  any
21    person  or  firm,  copartnership, association or corporation, to engage in the
22    business, trade, practice or work of plumbing in this state after the adoption
23    of this act, unless such person, or responsible person representing such firm,
24    copartnership, association or corporation, has successfully passed an examina-
25    tion as provided herein and has issued to him a state  certificate  of  compe-
26    tency,  which  shall  not be transferable, and said certificates of competency
27    shall not be required for sewer contractors, sewage disposal  contractors,  or
28    any  excavating  or  utility contractors, or for their employees, as set forth
29    and defined in section 54-2602(f), Idaho Code.
30         (2)  The issuance of certificates of competency  for  plumbing  con-
31    tractors  and  journeymen  shall  be  within the exclusive jurisdiction of the
32    state pursuant to this chapter  and  no  local  jurisdiction  shall  have  the
33    authority  to  require  licensure or a certificate of competency or to issue a
34    license or certificate of competency to any person possessing a certificate of
35    competency issued by the administrator of the division of building safety pur-
36    suant to the provisions of this chapter. The state shall investigate all local
37    infractions and state violations of this chapter and prosecute the same. Local
38    jurisdictions will assist the state by requesting investigations within  their
39    jurisdictions.  Nothing  in  this chapter shall restrict a city or county from
40    imposing stricter public safety rules, notwithstanding any other provision  of
41    Idaho Code to the contrary. 

42        SECTION  2.  That  Section 54-2619, Idaho Code, be, and the same is hereby

 1    amended to read as follows:

 2        54-2619.  MUNICIPAL FEES FOR PERMITS, INSPECTIONS -- EXCEPTIONS. No provi-
 3    sion of this act shall deprive incorporated cities, including those  specially
 4    chartered,  from  collections  of  fees from permits and inspections. Notwith-
 5    standing the provisions of sections 50-304, 50-306 and 50-606, Idaho Code,  no
 6    cities,  including  those  specially  chartered,  shall  require  occupational
 7    license  fees  ,  any  additional  certificate  of competency or separate
 8    license  from  a  plumbing contractor s  and  journeymen
 9       or journeyman  who possess es  a valid certifi-
10    cate of competency issued by the administrator of  the  division  of  building
11    safety  ,  except  those  cities  that have qualified plumbing inspectors
12    .

    This legislation reserves exclusive jurisdiction to the state 
    of Idaho to issue certificates of competency for plumbing 
    contractors, and prohibits local jurisdictions from requiring or 
    issuing additional certificates of competency or licenses. The
    
    legislation further provides that the state will investigate 
    infractions and violations of this provision. It is also understood 
    that nothing in this legislation will restrict a city or county from 
    imposing stricter public safety rules.
    
                               FISCAL NOTE
    
    There will be no fiscal impact to the state. There may be some loss 
    of revenue to local jurisdictions because they will no longer be 
    able to require additional licenses. However, if they have been 
    requiring such licenses, they have been doing so illegally.
