                                    HOUSE BILL NO. 586

                            BY REVENUE AND TAXATION COMMITTEE

 1                                        AN ACT
 2    RELATING TO THE STATE  TAX  COMMISSION  AND  ALTERNATIVE  DISPUTE  RESOLUTION;
 3        AMENDING CHAPTER 1, TITLE 63, IDAHO CODE, BY THE ADDITION OF A NEW SECTION
 4        63-118,  IDAHO  CODE, TO PROVIDE FOR USE OF ALTERNATIVE DISPUTE RESOLUTION
 5        BY THE STATE TAX COMMISSION TO ARBITRATE OR MEDIATE ANY ISSUE  WITHIN  ITS
 6        TAX JURISDICTION.

 7    Be It Enacted by the Legislature of the State of Idaho:

 8        SECTION  1.  That  Chapter  1,  Title  63, Idaho Code, be, and the same is
 9    hereby amended by the addition thereto of a  NEW SECTION  ,  to  be
10    known and designated as Section 63-118, Idaho Code, and to read as follows:

11        63-118.  ALTERNATIVE DISPUTE RESOLUTION. (1)  The state tax commission may
12    use  alternative  dispute  resolution  procedures  to arbitrate or mediate any
13    issue within its tax jurisdiction.
14        (2)  The state tax commission may enter into contracts, not subject to the
15    provisions of chapter 52, title 67, Idaho Code, with individuals and organiza-
16    tions including, but not limited to, the multistate tax commission, to conduct
17    alternative dispute resolution. Costs of alternative dispute resolution proce-
18    dures may be paid from resultant  proceeds  without  regard  to  budgetary  or
19    appropriation restrictions.
20        (3)  The  state  tax  commission  shall  appoint one (1) of its members as
21    alternative dispute resolution coordinator and from its staff one (1) or  more
22    assistant coordinators.
