H0605|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 605 BY EDUCATION COMMITTEE 1 AN ACT 2 RELATING TO TEACHER CERTIFICATE RECORDS AND FEES; AMENDING SECTION 33-1205, 3 IDAHO CODE, TO INCREASE THE FEES FOR ISSUANCE AND RENEWAL OF A TEACHER 4 CERTIFICATE AND FOR CHANGES TO A CERTIFICATE AND TO MAKE A TECHNICAL COR- 5 RECTION. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 33-1205, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 33-1205. CERTIFICATE RECORDS AND FEES. The state board of education shall 10 cause to be maintained a record of all certificates issued, showing names, 11 dates of issue and renewal, and if revoked, the date thereof and the reason 12 therefor. Athirty-fivefifty dollar ($3135 0 .00) nonrefundable fee shall accompany each application 14 for an original certificate and each application for renewal. Afifteen15thirty dollar ($1530 .00) nonre- 16 fundable fee shall accompany each application for certificate changes that are 17 processed subsequent to the issuance of the original or renewed certificate. 18 The fee s shall be used by the professional standards commission 19 for payment of the reasonable expenses in performing its duties and responsi- 20 bilities as approved by the state board of education and a portion of the fees 21 shall be used by the state department of education to partially defray the 22 cost of the office of certification.
STATEMENT OF PURPOSE
RS 07439
The purpose of this bill is to further the work of the
Professional Standards Commission, while maintaining the
proportionate amount of revenue to partially defray the cost
of the Office of Teacher Certification. The bill would amend
Idaho Code 33-1205 to increase the teacher certification fee
from thirty-five dollars ($35) to fifty dollars ($50). The
last fee increase was in 1987. Justifications for requesting
an increase include:
a. Implementation of the background check requirement
has increased personnel and operating costs.
b. Provisions for due process proceedings include the cost
of contracting with an attorney to advise the hearing panel,
as directed by the Administrative Procedures Act.
c. There has been an increase in the number of Professional
Standards Commission investigations into whether an
individual is fit to hold a certificate.
d. Personnel costs and other expenditures have
increased.
To the greatest extent possible, the Office of Teacher
Certification has decreased its costs by using technology
to reduce the expense of printing certification manuals.
FISCAL NOTE
There will be no fiscal impact on the General Account as a
consequence of adopting this proposal. The fee increase
will neither add to or take from the General Account.
