H0615|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 615, As Amended BY RESOURCES AND CONSERVATION COMMITTEE 1 AN ACT 2 RELATING TO WATERSHED ADVISORY GROUPS; AMENDING SECTION 39-3615, IDAHO CODE, 3 TO RESTRUCTURE MEMBERSHIP OF WATERSHED ADVISORY GROUPS TO PROVIDE A BAL- 4 ANCED REPRESENTATION OF THE INTERESTS IN THE WATERSHED. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 39-3615, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 39-3615. CREATION OF WATERSHED ADVISORY GROUPS. The director, with the 9 advice of the appropriate basin advisory group, may name watershed advisory 10 groups which will generally advise the department on the development and 11 implementation of TMDLs and other state water quality plans, including those 12 specific actions needed to control point and nonpoint sources of pollution 13 within the watersheds of those water bodies where designated beneficial uses 14 are not fully supported.MembersThe membership of 15 each watershed advisory group shall be representative of the industries and 16 interests directly affected by themanagement of that17implementation of water quality programs within the 18 watershed, along with representatives of local government and the land19managing or regulatory agencies with an interest in the management of that20watershed and the quality of the water bodies within itand each 21 member of the group shall either reside within the watershed or represent per- 22 sons within the watershed who have a real property, water rights or grazing 23 interest in the watershed. Each watershed advisory group named by the director 24 shall reflect a balanced representation of the interests in the watershed and 25 where appropriate shall include a representative of each of the 26 following: agriculture, mining, nonmunicipal point source discharge permit- 27 tees, forest products, local government, livestock, Indian tribes for areas 28 within reservation boundaries, water-based recreation, state land management 29 agencies, federal land management agencies and environmental interest. The 30 director may also name as technical nonvoting advisors, persons from the regu- 31 latory agencies with an interest in the management of the watershed and the 32 expertise necessary to assist in the work of the watershed advisory group 33 . Members of each watershed advisory group shall serve and shall not be 34 reimbursed for their expenses during their term of service.
