                         BY TRANSPORTATION AND DEFENSE COMMITTEE

 1                                        AN ACT
 2    RELATING TO MILITARY AFFAIRS; AMENDING SECTION 46-113, IDAHO CODE,  TO  DELETE
 3        THE  REQUIREMENT  THAT  THE  ASSISTANT ADJUTANT GENERAL APPOINTED FROM THE
 4        IDAHO AIR NATIONAL GUARD BE A RATED OFFICER.

 5    Be It Enacted by the Legislature of the State of Idaho:

 6        SECTION 1.  That Section 46-113, Idaho Code, be, and the  same  is  hereby
 7    amended to read as follows:

 8        46-113.  ASSISTANT  ADJUTANTS  GENERAL.  There  shall be two (2) assistant
 9    adjutants general who shall be appointed by and serve at the pleasure  of  the
10    adjutant general.
11        (a)  One  (1)  of  the assistant adjutants general shall be appointed from
12    the Idaho army national guard and may be chief of staff to the  adjutant  gen-
13    eral  for  all  the  Idaho  army  national guard forces. He shall perform such
14    duties as are assigned to him by the adjutant general. No person shall be eli-
15    gible for appointment as assistant  adjutant  general  under  this  subsection
16    unless  he  is a member of the Idaho army national guard with at least six (6)
17    years service as commissioned officer therein and has  attained  the  rank  of
18    major  or  above.  He shall be a federally recognized officer and may hold the
19    rank of brigadier general or such other rank as may hereafter be authorized by
20    the table of organization for the army national guard.
21        (b)  The other assistant adjutant general  shall  be  appointed  from  the
22    Idaho air national guard and may be chief of staff to the adjutant general for
23    all  the  Idaho air national guard forces. He shall perform such duties as are
24    assigned to him by the adjutant general.  No  person  shall  be  eligible  for
25    appointment as assistant adjutant general under this subsection unless he is a
26    member  of the Idaho air national guard with at least six (6) years service as
27    a commissioned officer therein and has attained the rank of major or above. He
28    shall be a federally recognized  and rated  officer  and  may  hold
29    the  rank  of  brigadier general or such other rank as may hereafter be autho-
30    rized by the tables of organization for the air national guard.
31        (c)  In the event of the absence or inability of the adjutant  general  to
32    perform his duties, he shall designate one (1) of the assistant adjutants gen-
33    eral  to  perform the duties of his office as acting adjutant general. If nei-
34    ther assistant adjutant general is available, he may  designate  any  national
35    guard officer to be the acting adjutant general.

                            STATEMENT OF PURPOSE

    Amends Idaho Code Section 46-113 to delete the requirement that
    
    the Assistant Adjutant General for the Idaho Air National 
    Guard must be a rated officer. This will enable the Adjutant 
    General to select as the Assistant Adjutant General for the 
    Idaho Air National Guard the officer most qualified for the 
    position; regardless of whether or not he or she is in a rated 
    career field.
