                     BY JUDICIARY, RULES AND ADMINISTRATION COMMITTEE

 1                                        AN ACT
 2    RELATING TO THE COURT INTERLOCK FUND; AMENDING SECTION 18-8010, IDAHO CODE, TO
 3        PROVIDE THAT MONEYS IN THE FUND MAY BE USED  FOR  ALCOHOL  OR  DRUG  ABUSE
 4        RELATED  PROBATION,  TREATMENT  OR PREVENTION PROGRAMS FOR ADULTS OR JUVE-
 5        NILES.

 6    Be It Enacted by the Legislature of the State of Idaho:

 7        SECTION 1.  That Section 18-8010, Idaho Code, be, and the same  is  hereby
 8    amended to read as follows:

 9        18-8010.  SURCHARGE  ADDED  TO  ALL  FINES. Every person who is convicted,
10    found guilty, pleads guilty or receives a withheld judgment for violating  the
11    provisions of this chapter shall be required to pay an additional fifteen dol-
12    lars  ($15.00)  in  addition to any other fine, penalty or costs the court may
13    assess. Moneys received pursuant to this section  shall  be  remitted  to  the
14    county treasurer in the county where the person was adjudicated for deposit in
15    the  "court  interlock  device and electronic monitoring device fund" which is
16    hereby created in each county. Moneys in this fund may  be  utilized  for  the
17    purchase  of  ignition  interlock  devices  and  electronic monitoring devices
18    required pursuant to section 18-8008, Idaho Code. Additionally, any  moneys  a
19    court charges a defendant for using an ignition interlock device or electronic
20    monitoring  devices  shall  be placed in this fund. The court may also utilize
21    moneys in this fund to assist an indigent defendant to procure an ignition in-
22    terlock device or electronic monitoring devices. The court  may  also  utilize
23    moneys in this fund for  other   alcohol or drug abuse related
24     probation , treatment or prevention  programs for  per-
25    sons  who  plead  guilty  to  or are found guilty of misdemeanor violations of
26    driving under the influence of  alcohol,  drugs  or  other  intoxicating  sub-
27    stances,  pursuant to section 18-8004(1)(a), Idaho Code   adults or
28    juveniles .

                           STATEMENT OF PURPOSE

    Section 18-8010, Idaho Code, imposes a $15.00 
    surcharge, in addition to other fines and costs, on persons 
    who commit driving under the influence (DUI) offenses which 
    is deposited into a special county "court interlock device 
    and electronic monitoring device fund" for the purchase of 
    motor vehicle interlock devices and electronic monitoring 
    equipment.
    
    Monies in the fund may also be expended for the 
    purpose of providing probation programs for persons 
    convicted of DUI offenses.
    
    However, not all persons who drive under the influence 
    of alcohol or drugs are apprehended and subsequently 
    convicted of a DUI offense.
    
    This bill amends Section 18-8010, Idaho Code, to provide 
    that in addition to motor vehicle interlock devices and 
    electronic monitoring equipment, monies in the fund may also 
    be used for any alcohol or drug abuse related probation, 
    treatment, or prevention programs for adults or juveniles as 
    an intervention to future drunken driving offenses before 
    they occur.
    
                               FISCAL NOTE
    
    This bill only expands the authorized uses of the 
    court interlock fund and does not add more revenue to 
    the fund or create more costs on county government.
