 1                                        AN ACT
 2    RELATING TO THE UNIFORM CONTROLLED SUBSTANCES ACT; AMENDING  SECTION  37-2705,
 3        IDAHO  CODE,  TO  INCLUDE GAMMA HYDROXYBUTYRATE (GHB) AS A CONTROLLED SUB-
 4        STANCE UNDER SCHEDULE I.

 5    Be It Enacted by the Legislature of the State of Idaho:

 6        SECTION 1.  That Section 37-2705, Idaho Code, be, and the same  is  hereby
 7    amended to read as follows:

 8        37-2705.  SCHEDULE I. (a) The controlled substances listed in this section
 9    are included in schedule I.
10        (b)  Any  of  the  following  opiates,  including  their  isomers, esters,
11    ethers, salts, and salts of isomers, esters, and ethers,  unless  specifically
12    excepted, whenever the existence of these isomers, esters, ethers and salts is
13    possible within the specific chemical designation:
14        (1)  Acetyl-alpha-methylfentanyl             (N-[1-(1-methyl-2-phenethyl)-
15        4-piperidinyl]-N-phenylacetamide);
16        (2)  Acetylmethadol;
17        (3)  Allylprodine;
18        (4)  Alphacetylmethadol  (except  levo-alphacetylmethadol  also  known  as
19        levo-alpha-acetylmethadol, levomethadyl acetate or LAAM);
20        (5)  Alphameprodine;
21        (6)  Alphamethadol;
22        (7)  Alpha-methylfentanyl;
23        (8)  Alpha-methylthiofentanyl           (N-[1-methyl-2-(2-thienyl)ethyl-4-

40        (3)  Benzylmorphine;
41        (4)  Codeine methylbromide;
42        (5)  Codeine-N-Oxide;
43        (6)  Cyprenorphine;
44        (7)  Desomorphine;
45        (8)  Dihydromorphine;
46        (9)  Drotebanol;
47        (10) Etorphine (except hydrochloride salt);
48        (11) Heroin;
49        (12) Hydromorphinol;
50        (13) Methyldesorphine;

 6        (d)  Hallucinogenic substances. Any material, compound, mixture or  prepa-
 7    ration which contains any quantity of the following hallucinogenic substances,
 8    their salts, isomers and salts of isomers, unless specifically excepted, when-
 9    ever  the  existence of these salts, isomers, and salts of isomers is possible
10    within the specific chemical designation (for purposes of this paragraph only,
11    the term "isomer" includes the optical, position and geometric isomers):
12        (1)  4-bromo-2,5-dimethoxy amphetamine;
13        (2)  2,5-dimethoxyamphetamine;
14        (3)  4-bromo-2,5-dimethoxyphenethylamine   (some   other   names:   alpha-
15        desmethyl DOB, 2C-B);
16        (4)  2,5-dimethoxy-4-ethylamphetamine (another name: DOET);
17        (5)  4-methoxyamphetamine (PMA);
18        (6)  5-methoxy-3,4-methylenedioxy-amphetamine;
19        (7)  4-methyl-2,5-dimethoxy-amphetamine (DOM, STP);
20        (8)  3,4-methylenedioxy amphetamine;
21        (9)  3,4-methylenedioxymethamphetamine (MDMA);
22        (10) 3,4-methylenedioxy-N-ethylamphetamine (also known  as  N-ethyl-alpha-
23        methyl-3,4 (methylenedioxy) phenethylamine, and N-ethyl MDA, MDE, MDEA);
24        (11) N-hydroxy-3,4-methylenedioxyamphetamine  (also  known  as  N-hydroxy-
25        alpha-methyl-3,4(methylenedioxy) phenethylamine, and N-hydroxy MDA);
26        (12) 3,4,5-trimethoxy amphetamine;
27        (13) Alpha-ethyltryptamine     (some     other     names:     etryptamine,
28        3-(2-aminobutyl) indole);
29        (14) Bufotenine;
30        (15) Diethyltryptamine (DET);
31        (16) Dimethyltryptamine (DMT);
32        (17) Ibogaine;
33        (18) Lysergic acid diethylamide;
34        (19) Marihuana;
35        (20) Mescaline;
36        (21) Parahexyl;
37        (22) Peyote;
38        (23) N-ethyl-3-piperidyl benzilate;
39        (24) N-methyl -3- piperidyl benzilate;

42        (27) Tetrahydrocannabinols.  Synthetic  equivalents of the substances con-
43        tained in the plant, or in  the  resinous  extractives  of  Cannabis,  sp.
44        and/or  synthetic  substances, derivatives, and their isomers with similar
45        chemical structure and pharmacological activity such as the following:
46            cis or trans tetrahydrocannabinol, and their optical isomers,  exclud-
47        ing dronabinol in sesame oil and encapsulated in a soft gelatin capsule in
48        a drug product approved by the U.S. Food and Drug Administration.
49            cis or trans tetrahydrocannabinol, and their optical isomers.
50            cis  or  trans  tetrahydrocannabinol,  and its optical isomers. (Since
51        nomenclature of these substances is not internationally standardized, com-
52        pounds of these structures, regardless of numerical designation of  atomic
53        positions are covered.)
54        (28) Ethylamine analog of phencyclidine (N-ethyl -1- phenylcyclohexylamine
55        (1-phenylcyclohexyl)    ethylamine;   N-(1-phenylcyclohexyl)   ethylamine,

 1        cyclohexamine, PCE;
 2        (29) Pyrrolidine    analog    of    phencyclidine:    1-(phenylcyclohexy1)
 3        -pyrrolidine, PCPy, PHP;
 4        (30) Thiophene             analog             of             phencyclidine
 5        1-[1-(2-thienyl)-cyclohexyl]-piperidine, 2-thienylanalog of phencyclidine,
 6        TPCP, TCP;
 7        (31) 1-[1-(2-thienyl) cyclohexyl] pyrrolidine another name: TCPy.
 8        (e)  Any material, compound, mixture or  preparation  which  contains  any
 9    quantity of the following substances having a depressant effect on the central
10    nervous  system,  including  its salts, isomers, and salts of isomers wherever
11    the existence of such salts, isomers, and salts of isomers is possible  within
12    the specific chemical designation:
13        (1)   Gamma hydroxybutyrate (GHB);
14        (2)   Flunitrazepam (also known as "R2", "Rohypnol");
15        ( 2  3 )  Mecloqualone;
16        ( 3  4 )  Methaqualone.
17        (f)  Stimulants.  Unless specifically excepted or unless listed in another
18    schedule, any material, compound, mixture, or preparation which  contains  any
19    quantity  of the following substances having a stimulant effect on the central
20    nervous system, including its salts, isomers, and salts of isomers:
21        (1)  Aminorex        (some        other        names:         aminoxaphen,
22        2-amino-5-phenyl-2-oxazoline, or 4,5-dihydro-5-phenyl-2-oxazolamine);
23        (2)  Cathinone     (some     other     names:    alpha-aminopropiophenone,
24        2-aminopropiophenone and norephedrone);
25        (3)  Fenethylline;
26        (4)  Methcathinone  (some  other  names:   2-(methyl-amino)-propiophenone,
27        alpha-(methylamino)-propiophenone,   N-methylcathinone,   AL-464,  AL-422,
28        AL-463 and UR1423);
29        (5)  (t)cis-4-methylaminorex
30        [(+/-)cis-4,5-dihydro-4-methyl-5-phenyl-2-oxazolamine];
31        (6)  N-ethylamphetamine;
32        (7)  N,N-dimethylamphetamine   (also   known   as:    N,N-alpha-trimethyl-
33        benzeneethanamine).
34        (g)  Temporary  listing of substances subject to emergency scheduling. Any
35    material, compound, mixture or preparation which contains any quantity of  the
36    following substances:
37        (1)  N-[1-benzyl-4-piperidyl]-N-phenylpropanamide   (benzylfentanyl),  its
38        optical isomers, salts and salts of isomers.
39        (2)  N-[1-(2-thienyl)methyl-4-piperidyl]-N-phenylpropanamide
40        (thenylfentanyl), its optical isomers, salts and salts of isomers.
41        (3)  4-methylaminorex      (also      known      as      2-amino-4-methyl-
42        5-phenyl-2-oxazoline).

                          STATEMENT OF PURPOSE
    
                                RS 07868
    
    Add to Idaho Code 37-2711 Schedule 1 of the Uniform Controlled 
    Substance Act Chapter 27, Title 37, the drug Gamma Hydroxy 
    Butyrate. This change is being requested because of the increased 
    abuse of this drug.
    
                              FISCAL NOTE
    
    No impact on the General Fund. No cost to the general public or 
    practitioners. Implementation of legislation will be from the 
    Board of Pharmacy dedicated funds.
