From and after January 1, 1995, 15 through June 30, 1998, it shall be the policy of the state of 16 Idaho that there be no reduction of pharmacy reimbursement levels for medicaid 17 under title XIX of the social security act except as necessary to comply with 18 federal regulations, 42 CFR 447.331 through 447.334, as implemented in the 19 state of Idaho. Effective July 1, 1998, pharmacy reimbursement levels 20 may be adjusted in accordance with rules promulgated by the director through 21 negotiated rulemaking with interested parties including representatives of the 22 pharmacy profession.
STATEMENT OF PURPOSE RS07941 Consistent with the Governor's Medicaid Reform initiatives, the purpose of this legislation is to give the state flexibility to adjust, through negotiated rule-making with interested parties including representatives of the pharmacy profession, reimbursement for prescription drugs purchased in connection with the state's medical assistance program. Current state law prohibits the department from reducing payment levels except where federal upper payment limits are exceeded. This legislation will allow the department the flexibility to consider both components of the reimbursement level, the dispensing fee and the cost of the drug, in determining appropriate payment levels. FISCAL IMPACT While no cost to the state is anticipated, any savings is dependent on the rules that are negotiated.
