                                BY STATE AFFAIRS COMMITTEE

 1                                        AN ACT
 2    RELATING TO DISSOLUTION OF ADOPTION; AMENDING  CHAPTER  15,  TITLE  16,  IDAHO
 3        CODE,  BY THE ADDITION OF A NEW SECTION 16-1509A, IDAHO CODE, TO AUTHORIZE
 4        THE DISSOLUTION OF AN ADOPTION UNDER CONDITIONS SPECIFIED.

 5    Be It Enacted by the Legislature of the State of Idaho:

 6        SECTION 1.  That Chapter 15, Title 16, Idaho Code, be,  and  the  same  is
 7    hereby  amended  by  the addition thereto of a  NEW SECTION , to be
 8    known and designated as Section 16-1509A, Idaho Code, and to read as follows:

 9        16-1509A.  DISSOLUTION OF ADOPTION. An adoption  may  be  dissolved,  upon
10    petition, with the agreement of both the adoptee and the adopting parent, when
11    the  adopting  parent  was the spouse of a natural parent, and the marriage of
12    the natural parent and adoptive parent was terminated.  If  the  petition  for
13    dissolution occurs after the death of the adoptive parent, the court shall, in
14    the finding of dissolution, specify the effect upon rights of inheritance. The
15    court  must  determine  that avoidance of statutory care is not the purpose of
16    the dissolution, unless the court finds grounds  to  waive  this  finding.  An
17    action  to  obtain a decree of dissolution of adoption may be commenced at any
18    time after the adoptee reaches twenty-one (21) years of age.
