 1                                        AN ACT
 2    RELATING TO THE HIGHWAY DISTRIBUTION ACCOUNT; AMENDING SECTION  40-701,  IDAHO
 3        CODE,  TO  PROVIDE  THAT  AN  AMOUNT EQUIVALENT TO THE NET INCREASE IN THE
 4        MOTOR FUELS TAX EXCEEDING TWENTY-ONE CENTS PER GALLON SHALL  BE  DEPOSITED
 5        IN  THE RESTRICTED HIGHWAY FUND AND TO MAKE TECHNICAL CORRECTIONS; DECLAR-
 6        ING AN EMERGENCY AND PROVIDING RETROACTIVE APPLICATION.

 7    Be It Enacted by the Legislature of the State of Idaho:

 8        SECTION 1.  That Section 40-701, Idaho Code, be, and the  same  is  hereby
 9    amended to read as follows:

10        40-701.  HIGHWAY  DISTRIBUTION  ACCOUNT  --  APPORTIONMENT.  (1)  There is
11    established in the state treasury an account known as the  "Highway  Distribu-
12    tion Account," to which shall be credited:
13        (a)  Moneys  as  provided by sections 63-2412(1)(e)4 and 63-2418(3), Idaho
14        Code;
15        (b)  All moneys collected by the department, their agents and vendors, and
16        county assessors and sheriffs, under the provisions  of  title  49,  Idaho
17        Code, except as otherwise specifically provided for; and
18        (c)  All other moneys as may be provided by law.
19        (2)  The highway distribution account shall be apportioned as follows:
20        (a)  An  amount  equivalent  to  the  net  increase in  gasoline fuel
21          the motor fuels  tax exceeding twenty-one  cents  (21[)
22        per  gallon  shall  be  deposited  to the restricted highway fund, and the
23        remainder shall be distributed:
24        (b)  Thirty-five and seventy-seven hundredths  per cent   
25        percent    (35.77%) to local units of government as provided in sec-
26        tion 40-709, Idaho Code;
27        (c)  Fifty-eight and eighty-three hundredths  per cent    
28        percent    (58.83%) to the state highway account established in sec-
29        tion 40-702, Idaho Code; and
30        (d)  Five and forty hundredths  per cent   percent  
31        (5.40%)  to  the  law enforcement account, established in section 67-2914,
32        Idaho Code. The state controller shall cause the remittance of the  moneys
33        apportioned  to local units of government not later than January 25, April
34        25, July 25 and October 25 of each year, and to the state highway  account
35        and  the  law  enforcement  account  as the moneys become available to the
36        highway distribution account.
37        (3)  Interest earned on the investment of idle moneys in the highway  dis-
38    tribution account shall be paid to the highway distribution account.
39        (4)  All  idle  moneys in the dedicated highway trust or asset accounts or
40    subaccounts established from highway user revenues,  reimbursements,  fees  or
41    permits  shall  be  invested by the state treasurer in the same manner as pro-
42    vided under section 67-1210, Idaho Code, with respect to other surplus or idle
43    moneys in the state treasury. Interest earned  on  the  investments  shall  be

 1    returned to the various highway trust or asset accounts and subaccounts.

 2        SECTION  2.  An  emergency  existing  therefor,  which emergency is hereby
 3    declared to exist, this act shall be in full force and effect on and after its
 4    passage and approval, and retroactively to April 1, 1996.

    This bill corrects the distribution of funds from the highway 
    distribution account to the restricted highway fund to conform with 
    the original legislative intent of the amendment to the distribution 
    in 1996 and with the actual distribution.
