That Chapter 21, Title 41, Idaho Code, be, and the same is 18 hereby amended by the addition thereto of a NEW SECTION , to be 19 known and designated as Section 41-2147, Idaho Code, and to read as follows: 20 41-2147. REQUIRED PROVISIONS -- FAMILY SERVICES. From and after July 1, 21 1998, all disability contracts which provide payment for prescription drugs 22 shall include provision for payment of prescription contraceptive drugs and 23 devices; and a contract which provides payment for an uncomplicated pregnancy 24 shall also include provision for payment for surgical sterilization proce- 25 dures, and contraceptive devices and services including methods which are 26 injectable or implantable which are used to prevent unwanted pregnancy. A 27 religious organization or a religiously affiliated organization shall be 28 exempt from this requirement if it contradicts their philosophy. 29 SECTION 2. That Chapter 22, Title 41, Idaho Code, be, and the same is 30 hereby amended by the addition thereto of a NEW SECTION , to be 31 known and designated as Section 41-2222, Idaho Code, and to read as follows: 32 41-2222. REQUIRED PROVISIONS -- FAMILY SERVICES. From and after July 1, 33 1998, all group or blanket disability insurance policies which provide payment 34 for prescription drugs shall include provision for payment of prescription 35 contraceptive drugs and devices; and a policy which provides payment for an 36 uncomplicated pregnancy shall also include provision for payment for surgical 37 sterilization procedures, and contraceptive devices and services including 38 methods which are injectable or implantable which are used to prevent unwanted 39 pregnancy. A religious organization or a religiously affiliated organization 40 shall be exempt from this requirement if it contradicts their philosophy. 2 1 SECTION 3. That Chapter 28, Title 41, Idaho Code, be, and the same is 2 hereby amended by the addition thereto of a NEW SECTION , to be 3 known and designated as Section 41-2873, Idaho Code, and to read as follows: 4 41-2873. REQUIRED PROVISIONS -- FAMILY SERVICES. From and after July 1, 5 1998, any stock or mutual insurer issuing benefits which provide payment for 6 prescription drugs shall include provision for payment of prescription con- 7 traceptive drugs and devices; and an insurer issuing benefits which provide 8 payment for an uncomplicated pregnancy shall also include provision for pay- 9 ment for surgical sterilization procedures, and contraceptive devices and ser- 10 vices including methods which are injectable or implantable which are used to 11 prevent unwanted pregnancy. A religious organization or a religiously affili- 12 ated organization shall be exempt from this requirement if it contradicts 13 their philosophy. 14 SECTION 4. That Chapter 34, Title 41, Idaho Code, be, and the same is 15 hereby amended by the addition thereto of a NEW SECTION , to be 16 known and designated as Section 41-3443, Idaho Code, and to read as follows: 17 41-3443. REQUIRED PROVISIONS -- FAMILY SERVICES. From and after July 1, 18 1998, all group subscriber's contracts which provide payment for prescription 19 drugs shall include provision for payment of prescription contraceptive drugs 20 and devices; and a contract which provides payment for an uncomplicated preg- 21 nancy shall also include provision for payment for surgical sterilization pro- 22 cedures, and contraceptive devices and services including methods which are 23 injectable or implantable which are used to prevent unwanted pregnancy. A 24 religious organization or a religiously affiliated organization shall be 25 exempt from this requirement if it contradicts their philosophy. 26 SECTION 5. That Chapter 39, Title 41, Idaho Code, be, and the same is 27 hereby amended by the addition thereto of a NEW SECTION , to be 28 known and designated as Section 41-3939, Idaho Code, and to read as follows: 29 41-3939. REQUIRED PROVISIONS -- FAMILY SERVICES. From and after July 1, 30 1998, all health maintenance organization policies, contracts, plans or cer- 31 tificates which provide payment for prescription drugs shall include provision 32 for payment of prescription contraceptive drugs and devices; and policies, 33 contracts, plans or certificates which provide payment for an uncomplicated 34 pregnancy shall also include provision for payment for surgical sterilization 35 procedures, and contraceptive devices and services including methods which are 36 injectable or implantable which are used to prevent unwanted pregnancy. A 37 religious organization or a religiously affiliated organization shall be 38 exempt from this requirement if it contradicts their philosophy. 39 SECTION 6. That Chapter 40, Title 41, Idaho Code, be, and the same is 40 hereby amended by the addition thereto of a NEW SECTION , to be 41 known and designated as Section 41-4027, Idaho Code, and to read as follows: 42 41-4027. REQUIRED PROVISIONS -- FAMILY SERVICES. From and after July 1, 43 1998, all self-funded plans which provide payment for prescription drugs shall 44 include provision for payment of prescription contraceptive drugs and 45 devices; and plans which provide payment for an uncomplicated pregnancy shall 46 also include provision for payment for surgical sterilization procedures, and 47 contraceptive devices and services including methods which are injectable or 48 implantable which are used to prevent unwanted pregnancy. STATEMENT OF PURPOSE RS08082C1 This bill requires insurance policies which provide for payment of prescription drugs to include coverage for contraceptive drugs and devices. The bill would also require policies which provide for payment of uncomplicated pregnancies to include contraceptive devices and services which are used to prevent unwanted pregnancy. An exemption is provided for religious organizations if this requirement contradicts their philosophy. FISCAL STATEMENT Actuarial costs are difficult to determine since this is an uncommon benefit. An industry estimate of $2.00- $3.00 per month per insurance policy is projected. This estimate does not take into consideration the considerable cost savings which may be achieved through prevention of unplanned pregnancies. Currently, birth control pills cost approximately $30.00 per month which is a substantial additional out-of-pocket expense for insured women in Idaho. CONTACT: Rep. Margaret Henbest 332-1267 H 763
