APPROPRIATIONS - COLLEGES AND UNIVERSITIES - Appropriates $256,710,500 to
the State Board of Education and the Board of Regents of the University of
Idaho for Boise State University, Idaho State University, Lewis-Clark State
College, the University of Idaho, and the Office of the State Board of
Education for fiscal year 1999; provides legislative intent that $75,000 of
the amount appropriated be used by the Office of the State Board of
Education for system-wide needs; provides legislative intent that
$1,600,000 be used for matching awards, research centers and infrastructure
and provides intent that the specific research grant program be terminated;
provides legislative intent that $1,750,000 be used for a competitive
technology grants and for participation in the Western Governor's
Association Virtual University; provides legislative intent regarding
moneys received from outside sources; and reappropriates unexpended and
unencumbered fund balance.

 1                                        AN ACT
 2    APPROPRIATING MONEYS FOR GENERAL EDUCATION PROGRAMS AT BOISE STATE UNIVERSITY,
 3        IDAHO STATE UNIVERSITY, LEWIS-CLARK STATE COLLEGE, THE UNIVERSITY OF IDAHO
 4        AND FOR THE OFFICE OF THE STATE BOARD OF EDUCATION FOR FISCAL  YEAR  1999;
 5        LIMITING  THE  AMOUNT  OF THE GENERAL FUND APPROPRIATION TO BE USED BY THE
 6        OFFICE OF THE STATE BOARD OF EDUCATION; ESTABLISHING AN AMOUNT OF THE GEN-
 7        ERAL FUND APPROPRIATION THAT IS TO BE EXPENDED FOR RESEARCH AND EXPRESSING
 8        LEGISLATIVE INTENT FOR THE SPECIFIC RESEARCH GRANT  PROGRAM;  ESTABLISHING
 9        AN AMOUNT OF THE GENERAL FUND APPROPRIATION TO BE EXPENDED FOR COMPETITIVE
10        TECHNOLOGY GRANTS AND FOR PARTICIPATION IN THE WESTERN GOVERNOR'S ASSOCIA-
11        TION  VIRTUAL UNIVERSITY AND EXPRESSING LEGISLATIVE INTENT AS TO COORDINA-
12        TION WITH THE STATE COUNCIL FOR TECHNOLOGY  IN  LEARNING;  MAKING  CERTAIN
13        IDAHO  CODE PROVISIONS SPECIFICALLY AVAILABLE TO THE STATE BOARD OF EDUCA-
14        TION AND THE BOARD OF REGENTS OF THE UNIVERSITY OF IDAHO;  REAPPROPRIATING
15        ANY UNEXPENDED AND UNENCUMBERED BALANCES; AND SETTING FORTH CONDITIONS FOR
16        THE REAPPROPRIATION.

17    Be It Enacted by the Legislature of the State of Idaho:

18        SECTION  1.  There  is hereby appropriated to the State Board of Education
19    and the Board of Regents of the University of Idaho for  Boise  State  Univer-
20    sity,  Idaho  State  University,  Lewis-Clark State College, the University of
21    Idaho, and the Office of the State Board of Education the following amount, to
22    be expended for the designated programs from the listed funds for  the  period
23    July 1, 1998, through June 30, 1999:

36        SECTION  2.  Of the amount appropriated from the General Fund in Section 1
37    of this act, an amount not to exceed $75,000 shall be used by  the  Office  of
38    the State Board of Education for system-wide needs.

39        SECTION  3.  Of the amount appropriated from the General Fund in Section 1
40    of this act, $1,600,000 shall be used for matching awards,  research  centers,
41    and  infrastructure,  with commercial application as a goal. It is legislative
42    intent that the specific research grant program be terminated.

 1        SECTION 4.  Of the amount appropriated from the General Fund in Section  1
 2    of  this act, $1,750,000 shall be used for a competitive grant program to fos-
 3    ter innovative learning approaches using technology, and for Idaho's  partici-
 4    pation  in the Western Governor's Association Virtual University. It is legis-
 5    lative intent that these funds be expended  in  coordination  with  the  State
 6    Council for Technology in Learning.

 7        SECTION  5.  The  provisions  of  Sections  67-3608,  67-3609, 67-3610 and
 8    67-3611, Idaho Code, are hereby made available to the State Board of Education
 9    and the Board of Regents of the University of Idaho for  the  period  July  1,
10    1998, through June 30, 1999, the provisions of Section 67-3516(1), Idaho Code,
11    with  respect to non-General Fund moneys only, and Section 67-3516(3) and (4),
12    Idaho Code, notwithstanding.

13        SECTION 6.  There is hereby reappropriated to the State Board of Education
14    and the Board of Regents of the University of Idaho for  Boise  State  Univer-
15    sity,  Idaho  State  University,  Lewis-Clark State College, the University of
16    Idaho and the Office of the State Board of Education, subject  to  the  provi-
17    sions of Section 7 of this act, the unexpended and unencumbered balance of any
18    appropriation  contained  in  Section 1, Chapter 165, Laws of 1997, to be used
19    for nonrecurring expenditures, for the period July 1, 1998, through  June  30,
20    1999.

21        SECTION  7.  The reappropriation for the General Fund granted in Section 6
22    of this act shall be subject to the following provisions:
23        (1)  If the unexpended and unencumbered balance in  the  General  Fund  on
24    June  30, 1998, is zero, the reappropriation for the General Fund in Section 6
25    is hereby declared to be null and void.
26        (2)  If the unexpended and unencumbered balance in  the  General  Fund  on
27    June  30,  1998, is greater than zero but less than the total General Fund re-
28    appropriation authority granted to all state agencies, the amount  reappropri-
29    ated in Section 6 of this act shall be in the proportion that the reappropria-
30    tion  for  Boise  State  University, Idaho State University, Lewis-Clark State
31    College, the University of Idaho and the Office of the State Board  of  Educa-
32    tion  bears to the total General Fund reappropriation authority granted to all
33    state agencies.
