DRIVER'S LICENSE - SUSPENSION - Amends Section 49-237, Idaho Code, as
amended by House Bill 422, as amended in the Senate, enacted by the Second
Regular Session of the Fifty-fourth Idaho Legislature to provide for
information to be sent to the Idaho Transportation Department and the
Department of Correction for administration of court-ordered suspensions.
The bill incorporates the sections enacted by Senate Bill 1464, enacted by
the Second Regular Session of the Fifty-fourth Idaho Legislature.

 1                                        AN ACT
 2    RELATING TO THE ADMINISTRATION OF SUSPENSIONS OF DRIVER'S LICENSES AND DRIVING
 3        PRIVILEGES; AMENDING SECTION 49-237, AS AMENDED  BY  HOUSE  BILL  422,  AS
 4        AMENDED  IN  THE  SENATE,  ENACTED  BY  THE  SECOND REGULAR SESSION OF THE
 5        FIFTY-FOURTH IDAHO LEGISLATURE, TO PROVIDE FOR INFORMATION TO BE  SENT  TO
 6        THE  TRANSPORTATION DEPARTMENT AND THE DEPARTMENT OF CORRECTION FOR ADMIN-
 7        ISTRATION OF COURT-ORDERED SUSPENSIONS.

 8    Be It Enacted by the Legislature of the State of Idaho:

 9        SECTION 1.  That Section 49-237, Idaho Code, as amended by House Bill 422,
10    As Amended in the Senate,  enacted  by  the  Second  Regular  Session  of  the
11    Fifty-fourth  Idaho Legislature, be, and the same is hereby amended to read as
12    follows:

13        49-237.  RECORD S   OF CONVICTIONS  TO  BE  SENT  TO
14    DEPARTMENT.  Upon the conviction of any person for the violation of any of the
15    provisions of this title, the  judicial officer before whom the  proceed-
16    ings are had   clerk of the district court  shall immediately
17      certify      transmit    the  facts of the case to the
18    department  and the department of correction , in either  paper  or
19    electronic   form,   including   the  name  ,      and  
20    address , date of birth, and the driver's license number or social  secu-
21    rity  number    of the parties charged,  the number, if any, of his
22    driver's  license,    the  registration  number  of  the  motor  vehicle
23    involved, the nature of the offense,  the date of the hearing, the  plea,
24    the      and any  judgment  issued, including a withheld
25    judgment.  The clerk of the district court shall also forward to  the  depart-
26    ment  information  regarding the character of the punishment ,  the
27    sentence,  and the amount of  any  fine  imposed  and  paid  ,  the
28    ordered  sentence  and its terms, and the ordered suspension period, including
29    when the suspension is to commence. The information provided to the department
30    and the department of correction shall be  certified  if  submitted  in  paper
31    form;  no  certification  is  required for electronic transfers of information
32    . The department shall enter the facts either in the records  of  regis-
33    tered  vehicles,  or  in  the  records  of registered dealers,  or in the
34    driver's license records,  as the case may be, opposite the name of  the
35    person  so  convicted,  and  in  the  case of any other person, in a record of
36    offenders,  to  be  kept  for  that  purpose.    If  an   individual   is
37    reincarcerated  while that person's driver's license or driving privileges are
38    suspended, the department of correction is to notify the department  that  the
39    individual   is   reincarcerated,   as   well  as  the  terms  and  period  of
40    reincarceration.  If the conviction be reversed on  appeal,  the  person
41    whose  conviction  has  been  reversed may serve on the department a certified
42    copy of the order of reversal, and the department shall enter the reversal  in
43    the proper records.

    STATEMENT OF PURPOSE

    This legislation combines and reconciles the amendments to Section 49-237, Idaho Code, 
    enacted in House Bill 422, as amended in the Senate, and enacted in Senate Bill 1464. This bill 
    amends House Bill 422, as amended in the Senate, to incorporate the amendments from Senate Bill 
    1464, and eliminate technical difficulties in compilation which would otherwise exist.

    This legislation would have no fiscal impact on the general fund.
