HCR032|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE HOUSE OF REPRESENTATIVES HOUSE CONCURRENT RESOLUTION NO. 32 BY EDUCATION COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND AUTHORIZING THE LEGISLATIVE COUNCIL TO 3 APPOINT A COMMITTEE TO UNDERTAKE AND COMPLETE A STUDY OF PUBLIC SCHOOL 4 EMPLOYMENT CONTRACTS. 5 Be It Resolved by the Legislature of the State of Idaho: 6 WHEREAS, patron perception as to the quality of professional performance 7 by public school teachers is diminished by the continuing contract law; and 8 WHEREAS, current Idaho law limits local school boards of trustees from 9 providing alternative forms of contracts; and 10 WHEREAS, the public perception is that all public school employees should 11 be considered for reemployment based upon job performance; and 12 WHEREAS, not all public school employees are under the terms of the con- 13 tinuing contract law; and 14 WHEREAS, Section 33-515, Idaho Code, requiring a "reasonable period of 15 probation," is vague and leads to legal difficulties; and 16 WHEREAS, legal interpretations of Idaho law, specifically Sections 33-514 17 and 33-515, Idaho Code, relating to teacher annual and renewable contracts are 18 unclear; and 19 WHEREAS, the current educational process is diminished and confounded by 20 expensive and time-consuming litigation in dismissal of incompetent personnel. 21 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses- 22 sion of the Fifty-fourth Idaho Legislature, the House of Representatives and 23 the Senate concurring therein, that the Legislative Council is authorized to 24 appoint a committee to undertake and complete a study of public school employ- 25 ment contracts. The Legislative Council shall determine the number of legisla- 26 tors and membership from each house appointed to the Committee and shall 27 authorize the Committee to receive input, advice and assistance from inter- 28 ested and affected parties who are not members of the Legislature. 29 BE IT FURTHER RESOLVED that nonlegislative members of the Committee may be 30 appointed by the Cochairs of the Committee who are appointed by the Legisla- 31 tive Council. Nonlegislative members of the advisory committee shall not be 32 reimbursed from legislative funds for per diem, mileage or other expenses and 33 shall not have voting privileges regarding the Committee's recommendations or 34 proposed legislation. 35 BE IT FURTHER RESOLVED that the Committee shall report its findings, rec- 36 ommendations and proposed legislation, if any, to the First Regular Session of 37 the Fifty-fifth Idaho Legislature.
STATEMENT OF PURPOSE RS 07519 The purpose of this legislation is to ask the Legislative Council to appoint a legislative study committee to review, examine and recommend legislation regarding all aspects of public schools' employment contracts contained in Idaho Code.
