                            HOUSE CONCURRENT RESOLUTION NO. 39

                            BY REVENUE AND TAXATION COMMITTEE

 1                               A CONCURRENT RESOLUTION
 2    STATING FINDINGS OF THE LEGISLATURE CONCERNING NEEDS FOR  ADDITIONAL  INFORMA-
 3        TION  RELATING TO COSTS TO INDIVIDUALS FOR CHOOSING SCHOOLING ALTERNATIVES
 4        RESULTING IN A NONUSE OF THE PUBLIC SCHOOL RESOURCES AND  AUTHORIZING  THE
 5        LEGISLATURE TO UNDERTAKE A STUDY.

 6    Be It Resolved by the Legislature of the State of Idaho:

 7        WHEREAS,  the legislature is aware that the costs of private education for
 8    children whose parents make that choice fall entirely upon the family; and
 9        WHEREAS, many Idaho families  have  chosen  schooling  alternatives  which
10    result  in a nonuse of the public school resources and also mean that the fam-
11    ily meets all costs of the education; and
12        WHEREAS, while these families pay the costs of private education and  save
13    certain cost impacts which would otherwise fall upon the state, they also con-
14    tinue to pay the costs of public education through taxes; and
15        WHEREAS, there is a recognized benefit to all society from a strong public
16    education system, and many persons who are not direct users of the public edu-
17    cation system also pay taxes which contribute to the strength of public educa-
18    tion in Idaho; and
19        WHEREAS,  balancing these contrasting positions has been placed before the
20    legislature through bills presented in recent sessions which provide tax  cre-
21    dits or tax deductions for the costs of private education; and
22        WHEREAS,  it  is evident that this issue involves significant impacts upon
23    citizens, requires the gathering of data concerning the fiscal impact upon the
24    state as well as the impact upon individuals, and a thorough  study  of  these
25    issues will also require input from many affected individuals and groups.
26        NOW,  THEREFORE,  BE IT RESOLVED by the members of the Second Regular Ses-
27    sion of the Fifty-fourth Idaho Legislature, the House of  Representatives  and
28    the  Senate  concurring therein, that the Legislative Council is authorized to
29    appoint a committee to undertake and complete a study of tuition  tax  credits
30    or deductions for Idaho taxpayers who do not use the public school system. The
31    Legislative  Council shall determine the number of legislators and the member-
32    ship from each house appointed to the committee and shall authorize  the  com-
33    mittee  to  receive  input, advice and assistance from interested and affected
34    parties who are not members of the legislature.
35        BE IT FURTHER RESOLVED that nonlegislative members of the committee may be
36    appointed by the cochairs of the committee who are appointed by  the  Legisla-
37    tive  Council.  Nonlegislative  members of the advisory committee shall not be
38    reimbursed from legislative funds for per diem, mileage or other expenses  and
39    shall  not have voting privileges regarding the committee's recommendations or
40    proposed legislation.
41        BE IT FURTHER RESOLVED that the committee shall report its findings,  rec-
42    ommendations and proposed legislation, if any, to the First Regular Session of
43    the Fifty-fifth Idaho Legislature.

                           STATEMENT OF PURPOSE

    To authorize the Legislative Council to appoint 
    a
    
    committee to undertake and complete a study of 
    findings
    
    concerning needs for additional information relating to 
    costs
    
    to individuals for choosing schooling alternatives resulting 
    in a nonuse of the public school resources and authorizing 
    the Legislature to undertake a study.
    
                               FISCAL NOTE
    
    If this resolution is adopted by the Legislature and 
    the committee is appointed by Legislative Council, any 
    necessary legislator travel and per diem expense would be 
    paid from the existing legislative appropriation to the 
    Senate and the House of Representatives. Funding for staff 
    support and expenses would be provided from the existing 
    appropriation to the Legislative Council for the 
    Legislative Services Office. There would be no additional 
    impact upon the state general fund as a result of this 
    resolution.
