                         BY RESOURCES AND CONSERVATION COMMITTEE

 1                                   A JOINT MEMORIAL
 2    TO THE SENATE AND HOUSE OF REPRESENTATIVES OF THE UNITED  STATES  IN  CONGRESS
 3        ASSEMBLED,  AND  TO THE CONGRESSIONAL DELEGATION REPRESENTING THE STATE OF
 4        IDAHO IN THE CONGRESS OF THE UNITED STATES.

 5        We, your Memorialists, the House of Representatives and the Senate of  the
 6    State  of  Idaho  assembled  in the Second Regular Session of the Fifty-fourth
 7    Idaho Legislature, do hereby respectfully represent that:

 8        WHEREAS, the Council on Environmental Quality  published  in  the  Federal
 9    Register  of May 19, 1997, pages 27253-27256, the intention of the administra-
10    tion to designate ten rivers per year as American Heritage Rivers; and
11        WHEREAS, in 1996 Congress defeated an attempt to  legislatively  create  a
12    "National Heritage Areas Partnership Program"; and
13        WHEREAS, Presidential Executive Order No. 13061 signed September 11, 1997,
14    launched  the  American Heritage Rivers Initiative, without Congressional con-
15    sideration; and
16        WHEREAS, 63% of the state of Idaho is under federal  land  management  and
17    designation of additional areas for federal involvement in land use management
18    would be unduly restrictive; and
19        WHEREAS,  the  initiative  redefines communities, watersheds and jurisdic-
20    tional boundaries and there is no guarantee that private property owners  will
21    be included in any decisions that would affect private property; and
22        WHEREAS,  the  increase  in  federal bureaucracy and the de facto shift of
23    control over water from the states to the federal government  would  establish
24    the federal government as the ultimate authority in river protections; and
25        WHEREAS, the citizens of Idaho have continually demonstrated they can work
26    together to strike a balance between protecting their rivers and using them as
27    valuable economic resources; and
28        WHEREAS,  a  letter  submitted September 23, 1997, by Senator Larry Craig,
29    Senator  Dirk  Kempthorn,  Congressman  Mike  Crapo  and  Congresswoman  Helen
30    Chenoweth to Kathleen A. McGinty, Chair,  Council  on  Environmental  Quality,
31    requested  that  no rivers in Idaho be designated as American Heritage Rivers;
32    and
33        WHEREAS, the Idaho Conservation League  and  the  Clearwater  Biodiversity
34    Project subsequently submitted Idaho's Clearwater River in nomination December
35    18, 1997.
36        NOW,  THEREFORE,  BE IT RESOLVED by the members of the Second Regular Ses-
37    sion of the Fifty-fourth Idaho Legislature, the House of  Representatives  and
38    the Senate concurring therein, that the Idaho Legislature is opposed to desig-
39    nation  of any river, watershed, or river segment within the boundaries of the
40    state of Idaho as an American Heritage River and supports the request made  by
41    Idaho's  congressional  delegation to withdraw Idaho from the initiative proc-
42    ess.
43        BE IT FURTHER RESOLVED that the Chief Clerk of the  House  of  Representa-
44    tives  be, and she is hereby authorized and directed to forward a copy of this

 1    Memorial to the President of the Senate and the Speaker of the House of Repre-
 2    sentatives of Congress, and  the  congressional  delegation  representing  the
 3    State of Idaho in the Congress of the United States.

                            STATEMENT OF PURPOSE

    This Joint Memorial represents opposition to designation of any 
    river, watershed, or river segment within the boundaries of the State 
    of Idaho as an American Heritage River. Expresses support for Idaho's 
    congressional delegation request to withdraw Idaho from the initiative 
    process.
