                                   SENATE BILL NO. 1304

                             BY JUDICIARY AND RULES COMMITTEE

 1                                        AN ACT
 2    RELATING TO JURY COMMISSIONS; AMENDING SECTION 2-205, IDAHO CODE,  TO  PROVIDE
 3        THAT  A  JURY COMMISSIONER WHOSE TERM HAS EXPIRED SHALL SERVE UNTIL A SUC-
 4        CESSOR IS APPOINTED AND QUALIFIES.

 5    Be It Enacted by the Legislature of the State of Idaho:

 6        SECTION 1.  That Section 2-205, Idaho Code, be, and  the  same  is  hereby
 7    amended to read as follows:

 8        2-205.  JURY  COMMISSIONS  ESTABLISHED -- COMPOSITION -- QUALIFICATIONS OF
 9    COMMISSIONERS -- EXPENSES AND COMPENSATION. A jury commission  is  established
10    in  each county to manage the jury selection process under the supervision and
11    control of the court. The jury commission shall be composed of  the  clerk  of
12    the court and a jury commissioner appointed for a term of two (2) years by the
13    administrative judge , who shall serve until a successor is appointed and
14    qualifies . The jury commissioner must be a citizen of the United States
15    and  a resident in the county in which he serves. The jury commissioner may be
16    reimbursed for travel, subsistence, and other necessary expenses  incurred  by
17    him  in  the  performance  of his duties and may receive compensation at a per
18    diem rate fixed by the administrative judge and payable from the  county  gen-
19    eral fund, if he is not otherwise a county employee.

    This bill is one of a series of bills that the Justices 
    of the Supreme Court transmitted to the Governor in their 
    annual "defects in the law" report under Art. 5, Sec. 25 of 
    the Idaho Constitution.
    
    This bill amends I.C. § 2-205 relating to the appointment 
    and term of office of a jury commissioner who arranges for 
    potential jurors in court cases. Presently, I.C. § 2-205 does 
    not have a standard clause existing in other similar statutes 
    which provides for a holdover term of office when a 
    commissioner's term of office expires but a successor has not 
    yet been appointed.
    
    This bill adds this standard feature to the statute to 
    provide that the incumbent commissioner continues in office 
    until a successor is appointed and qualifies.
    
                                FISCAL NOTE
    
    This bill will not have an impact on state or local 
    funds.
