 1                                        AN ACT
 2    RELATING TO REGISTRATION OF SNOWMOBILES; AMENDING SECTION 67-7103, IDAHO CODE,
 3        TO INCREASE THE FEE FOR REGISTRATION OF A SNOWMOBILE, TO INCREASE THE PUR-
 4        CHASE PRICE TO RESIDENT AND NONRESIDENT OWNERS OF SNOWMOBILES OF  CERTIFI-
 5        CATES  OF  NUMBER FOR RENTALS OF SNOWMOBILES AND TO MAKE TECHNICAL CORREC-
 6        TIONS.

 7    Be It Enacted by the Legislature of the State of Idaho:

 8        SECTION 1.  That Section 67-7103, Idaho Code, be, and the same  is  hereby
 9    amended to read as follows:

10        67-7103.  APPLICATION FOR NUMBER -- ATTACHMENT OF NUMBER -- CERTIFICATE --
11    APPLICATION FOR TRANSFER OF CERTIFICATE -- TRANSFER OF CERTIFICATE FEE -- TEM-
12    PORARY  NUMBER  -- FEES. (1) On or before November 1 of each year the owner of
13    each snowmobile requiring numbering by the state of Idaho shall file an appli-
14    cation for number with the department on forms approved by it. The application
15    shall be signed by the owner and shall, except as provided in  subsection  (7)
16    of  this section, be accompanied by a fee of  fifteen   twenty
17     dollars ($ 15   20  .00).  Upon  receipt  of  the
18    application  the department shall issue to the applicant a certificate of num-
19    ber stating the number assigned to the snowmobile and the name and address  of
20    the  owner. The owner shall paint on or attach to the snowmobile the identifi-
21    cation number in a manner as may be prescribed by rules  and  regulations
22      of  the  department. The number shall be located on the right and left
23    side of the cowling of the snowmobile and  shall  be  completely  visible  and
24    shall  be  maintained in legible condition. The certificate of number shall be
25    pocket size and shall be available at all times for inspection on the  snowmo-
26    bile for which issued, wherever the snowmobile is in operation.
27        (2)  The  department  may  issue any certificate of number directly or may
28    authorize any persons to act as vendor for the issuance. In the event a person
29    accepts the authorization, he may be assigned a block of numbers and  certifi-
30    cates  which  upon  issue,  in conformity with this chapter and with any rules
31     and regulations  of the department, shall be valid  as  if  issued
32    directly by the department.
33        (3)  All  records  of the department made or kept pursuant to this section
34    shall be public records.
35        (4)  Each snowmobile must be registered before it leaves the  premises  at
36    the time of sale from any retail snowmobile dealer.
37        (5)  The purchaser of a snowmobile shall, within fifteen (15) days immedi-
38    ately  after  acquisition,  make application to the department for transfer to
39    him of the certificate of number issued to the snowmobile,  giving  his  name,
40    address and the number of the snowmobile and shall at the same time pay to the
41    department a fee of three dollars ($3.00). Upon receipt of the application and
42    fee,  the  department  shall transfer the certificate of number issued for the
43    snowmobile to the new owner or owners. Unless the application is made and  fee

 1    paid  within fifteen (15) days, the snowmobile shall be considered to be with-
 2    out a certificate of number and it shall be unlawful for any person to operate
 3    that snowmobile until the certificate is issued.
 4        (6)  No number other than the number issued to a  snowmobile  pursuant  to
 5    this chapter shall be painted, attached, or otherwise displayed on the snowmo-
 6    bile,  except  a temporary number may be attached to identify a snowmobile for
 7    the purpose of racing or other sporting events.
 8        (7)   The annual fee for certificates of  number  issued  to  dealers
 9    shall  be  fifteen  dollars ($15.00), for demonstration purposes. Certificates
10    issued to dealers shall at all times be displayed on snowmobiles being  rented
11    or demonstrated.
12        (8)     Resident and nonresident o  O wners of
13    snowmobiles used for rental purposes shall purchase certificates of number for

16    at all times.

                           STATEMENT OF PURPOSE

    The purpose of this legislation is to provide adequate 
    funding for the plowing of parking lots, maintenance of 
    facilities and the operation of snowmobile trail groomers. 
    There are currently 32 machines grooming over 7,000 miles of 
    trail in 28 county programs

    This legislation will have no impact on the General Fund; 
    funds made available for the purposes of the bill are from
