                                   SENATE BILL NO. 1313

                             BY HEALTH AND WELFARE COMMITTEE

 1                                        AN ACT
 2    RELATING TO LICENSURE OF OCCUPATIONAL THERAPISTS;  AMENDING  SECTION  54-3704,
 3        IDAHO  CODE,  TO  EXEMPT  PERSONNEL  IN A SCHOOL SETTING WORKING UNDER THE
 4        SUPERVISION OF AN OCCUPATIONAL THERAPIST FROM LICENSURE.

 5    Be It Enacted by the Legislature of the State of Idaho:

 6        SECTION 1.  That Section 54-3704, Idaho Code, be, and the same  is  hereby
 7    amended to read as follows:

 8        54-3704.  EXEMPTIONS. Nothing in this act shall be construed as preventing
 9    or  restricting  the  practice,  services or activities or requiring licensure
10    pursuant to this act of:
11        (1)  Any person licensed in this state by any other law from  engaging  in
12    the profession or occupation for which such person is licensed; or
13        (2)  Any  person  employed  as  an  occupational therapist or occupational
14    therapy assistant by the  government  of  the  United  States  or  any  agency
15    thereof,  if such person provides occupational therapy solely under the direc-
16    tion or control of the organization by which such person is employed; or
17        (3)  Any person pursuing a supervised course of study leading to a  degree
18    or  certificate  in  occupational  therapy in an accredited or approved educa-
19    tional program, if the person is designated by a title which clearly indicates
20    a student or trainee status; or
21        (4)  Any person fulfilling the supervised  fieldwork  experience  require-
22    ments  of section 54-3706, Idaho Code, if the experience constitutes a part of
23    the experience necessary to meet the requirement of that section; or
24        (5)  For purposes of continuing education,  consulting,  and/or  training,
25    any  person  performing  occupational  therapy services in the state, if these
26    services are performed for no more than sixty (60) days in a calendar year  in
27    association with an occupational therapist licensed under this act, if:
28        (a)  The  person  is licensed as an occupational therapist or occupational
29        therapy assistant in good standing in another state; or
30        (b)  The person is certified as an occupational therapist registered (OTR)
31        or a certified occupational therapy assistant (COTA) by the American occu-
32        pational therapy association.
33         (6)  Any person, employed in a school setting, who provides  special
34    education  and  related services pursuant to a student's individualized educa-
35    tional plan, under the supervision of an occupational therapist.

                           STATEMENT OF PURPOSE

    The purpose of this bill is to provide an exemption to 
    schools of licensing requirements for individuals assisting 
    with occupational therapy services to children, while 
    working under the supervision of licensed occupational 
    therapists and implementing the requirements of the students 
    individualized educational plan (IEP).
