                                   SENATE BILL NO. 1318

                             BY JUDICIARY AND RULES COMMITTEE

 1                                        AN ACT
 2    RELATING TO THE PEACE OFFICERS STANDARDS AND TRAINING ACCOUNT;  AMENDING  SEC-
 3        TION  19-5116,  IDAHO  CODE,  TO  INCREASE THE MAXIMUM AMOUNT WHICH MAY BE
 4        ACCUMULATED IN THE ACCOUNT AND TO MAKE A TECHNICAL CORRECTION; AND DECLAR-
 5        ING AN EMERGENCY.

 6    Be It Enacted by the Legislature of the State of Idaho:

 7        SECTION 1.  That Section 19-5116, Idaho Code, be, and the same  is  hereby
 8    amended to read as follows:

 9        19-5116.  PEACE  OFFICERS  STANDARDS  AND  TRAINING  ACCOUNT. (a) There is
10    hereby established in the state operating fund, the peace  officers  standards
11    and training account. All moneys deposited to the account shall be expended by
12    the peace officers standards and training council for the following purposes:
13        (1)  Training   peace  officers,  county  detention  officers,  and  self-
14        sponsored students, within the state of Idaho, including, but not  limited
15        to,  sheriffs  and their deputies, officers of the Idaho department of law
16        enforcement and conservation officers of the Idaho department of fish  and
17        game,   and   city  and  county  prosecutors  and  their  deputies  .
18         ; 
19        (2)  Salaries, costs and expenses relating to such training as provided in
20        subsection (1) of this section;
21        (3)  Such capital expenditures as the peace officers standards and  train-
22        ing council may provide, for the acquisition, construction and/or improve-
23        ment of a peace officers standards and training academy; and
24        (4)  Such  expenditures as may be necessary to aid approved peace officers
25        training programs or county detention officer programs certified as having
26        met the standards established by the peace officers standards and training
27        council.
28        (b)  The peace officers standards and training account shall be funded  as
29    provided in section 31-3201B, Idaho Code.
30        (c)  All  contributions and other moneys and appropriations which are des-
31    ignated for peace officers standards and training shall be  deposited  in  the
32    peace officers standards and training account.
33        (d)  Moneys  received  into  the  account as provided in subsection (c) of
34    this section, shall be accounted for separately.
35        (e)  If the fiscal year-end balance in the  account  pursuant  to  section
36    31-3201B,  Idaho  Code, exceeds  five hundred fifty thousand  
37    one million  dollars ($ 55  1,00 0,000) the excess
38    shall revert to the general account.

39        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
40    declared to exist, this act shall be in full force and effect on and after its
41    passage and approval.

Statement of Purpose / Fiscal Impact


                                   STATEMENT OF PURPOSE
    
    The Peace Officers Standards and Training fee, Idaho Code ยง 31-3201B was established 
    in 1983 with an assessment of $3.00 on most fines and citations. Also in 1983, a year-end 
    balance cap of $550,000 was placed on this account, which remains today. During that 
    time, the yearend balance has never exceeded $300,000 until FY96. As demands for 
    service and training have increased, POST appropriation has gone from $452,900 in FY84 
    to $1,259,700 in FY98. When POST Academy expanded the basic academy from seven to 
    ten weeks, and started the basic detention academy to meet the needs of Idaho Sheriffs, 
    the POST fee was raised $2.00 to its present fee of $6.00. Due to this increase, the 
    year-end balance exceeded $550,000 and for the first time, in FY97, an excess of $21,600 
    reverted to the general fund. This fiscal year, estimates show that POST will loose 
    approximately $105,000, which will not be available to help sustain the POST dedicated 
    fund in future years. If POST were to close FY98 with reverted appropriation balances, 
    which could help offset future year shortfalls, additional money will be lost. Also with the 
    loss of $106,000 this year, the year-end balance is estimated to drop to $251,400 in FY99 
    with continual decreases every year thereafter. Loss of this critical funding will force POST 
    to seek a fee increase much earlier than might be required if the $550,000 surplus cap is 
    raised. Training demands are steadily increasing, and POST is experiencing an increase 
    in basic academy enrollment from an average of 30 to 45 students in each session. County 
    Detention facilities are being added or enlarged throughout the state and many more 
    detention officers are in need of training. Law enforcement agencies will be facing a 
    dilemma shortly as estimates indicate 60% to 80% Of existing administrative and 
    supervisory staff will reach retirement age in the next five years. This will expand the 
    demand for training new supervisors, managers and administrators to fill these vacancies. 
    To help keep the POST account healthy and to save cities and counties money, POST 
    recently implemented a self-sponsored student program to allow men and women to pay for 
    their basic academy training. Money earned from this program could also be lost if this cap 
    is not raised.
    
                                        FISCAL IMPACT
    
    
    This bill will allow POST to save excess funds in the POST dedicated account up to 
    $1,000,000. This will help prevent the balance from depleting and should delay future fee
