S1342|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE SENATE SENATE BILL NO. 1342, As Amended BY JUDICIARY AND RULES COMMITTEE 1 AN ACT 2 RELATING TO GRADINGS OF THEFT; AMENDING SECTION 18-2407, IDAHO CODE, TO 3 INCREASE THE DOLLAR AMOUNT THRESHOLD IN CERTAIN INSTANCES TO ONE THOUSAND 4 DOLLARS FOR A PERSON TO BE GUILTY OF GRAND THEFT AND TO MAKE A TECHNICAL 5 CORRECTION; AND PROVIDING FOR APPLICATION OF THE ACT TO OFFENSES COMMITTED 6 ON AND AFTER JULY 1, 1998. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Section 18-2407, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 18-2407. GRADING OF THEFT. Theft is divided into two (2) degrees, grand 11 theft and petit theft. 12 (1) Grand theft. 13 (a) A person is guilty of grand theft when he commits a theft as defined 14 in this chapter and when the property, regardless of its nature and value, 15 is obtained by extortion committed by instilling in the victim a fear that 16 the actor or another person will: 17 1. Cause physical injury to some person in the future; or 18 2. Cause damage to property; or 19 3. Use or abuse his position as a public servant by engaging in con- 20 duct within or related to his official duties, or by failing or 21 refusing to perform an official duty, in such manner as to affect 22 some person adversely. 23 (b) A person is guilty of grand theft when he commits a theft as defined 24 in this chapter and when: 25 1. The value of the property taken exceedsthree hundred26one thousand dollars ($31,0 27 00); or 28 2. The property consists of a public record, writing or instrument 29 kept, filed or deposited according to law with or in the keeping of 30 any public office or public servant; or 31 3. The property consists of a credit card; or 32 4. The property, regardless of its nature or value, is taken from 33 the person of another; or 34 5. The property, regardless of its nature and value, is obtained by 35 extortion; or 36 6. The property consists of one (1) or more firearms, 37 rifles or shotguns; or 38 7. The property taken or deliberately killed is livestock or any 39 other animal exceeding one hundred fifty dollars ($150) in value. 40 8. When any series of thefts, comprised of individual thefts having 41 a value ofthree hundredone thousand dol- 42 lars ($31,0 00) or less, are part of a com- 43 mon scheme or plan, the thefts may be aggregated in one (1) count and 2 1 the sum of the value of all of the thefts shall be the value consid- 2 ered in determining whether the value exceedsthree hundred3one thousand dollars ($341,0 00). 5 (2) Petit theft. A person is guilty of petit theft when he commits a 6 theft as defined in this chapter and his actions do not constitute grand 7 theft. 8 SECTION 2. The provisions of this act shall apply to violations of sec- 9 tion 18-2407, Idaho Code, committed on and after July 1, 1998.
STATEMENT OF PURPOSE
RS 07593
The purpose of this bill is to amend Idaho Code Section 18-2407, Grading of Theft.
Currently. the dollar amount threshold for the charge of grand theft is three hundred dollars
($300). The amendment would raise the threshold to one thousand dollars ($1,000). The bill
would also make a technical correction. The increased threshold reflects a more realistic
amount due to inflation. A reduction of inmates incarcerated in the state prison system should
result from this bill.
FISCAL IMPACT
The savings to the state will be approximately $17,000 for every year the
