S1348|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE SENATE SENATE BILL NO. 1348 BY FINANCE COMMITTEE 1 AN ACT 2 APPROPRIATING ADDITIONAL MONEYS TO THE MILITARY DIVISION FOR FISCAL YEAR 1998; 3 DIRECTING THE STATE CONTROLLER TO TRANSFER MONEYS TO THE HAZARDOUS SUB- 4 STANCE EMERGENCY RESPONSE FUND; GRANTING CONTINUOUS APPROPRIATION AUTHOR- 5 ITY FOR A SPECIFIC FUND AND TIME PERIOD; EXPRESSING LEGISLATIVE INTENT 6 REGARDING THE USE OF STATE MONEYS; DIRECTING THE STATE CONTROLLER TO 7 TRANSFER MONEYS TO THE NATURAL RESTORATION FUND; PROVIDING FOR REAPPRO- 8 PRIATION OF CERTAIN UNEXPENDED AND UNENCUMBERED BALANCES; DIRECTING THE 9 REVERSION OF CERTAIN UNSPENT MONEYS; AND DECLARING AN EMERGENCY. 10 Be It Enacted by the Legislature of the State of Idaho: 11 SECTION 1. In addition to the appropriation made in Section 1, Chapter 12 325, Laws of 1997, there is hereby appropriated to the Office of the Governor 13 for the Military Division, the following amounts to be expended for the desig- 14 nated programs according to the designated standard classifications from the 15 listed funds for the period July 1, 1997, through June 30, 1998: 16 A. BUREAU OF HAZARDOUS MATERIALS: 17 FOR: 18 Operating Expenditures $17,400 19 FROM: 20 General Fund $17,400 21 B. BUREAU OF DISASTER SERVICES: 22 FOR: 23 Operating Expenditures $8,170,000 24 FROM: 25 General Fund $ 975,000 26 State Highway Fund 367,500 27 Natural Restoration Fund 150,000 28 Federal Grant Fund 6,677,500 29 TOTAL: $8,170,000 30 SECTION 2. The State Controller shall make a cash transfer of $17,400 31 from the General Fund to the Hazardous Substance Emergency Response Fund, as 32 appropriated to the Bureau of Hazardous Materials in Section 1 of this act. 33 SECTION 3. The Military Division is hereby granted continuous appropria- 34 tion authority for the Bureau of Hazardous Materials' Miscellaneous Revenue 35 Fund for the period July 1, 1997, through June 30, 1998. 36 SECTION 4. It is legislative intent that the state moneys appropriated to 37 the Bureau of Disaster Services in Section 1 of this act shall only by used to 38 match grant moneys from nonstate sources for the purposes of funding the Milo 39 Creek Containment Project. 40 SECTION 5. The State Controller shall make cash transfers of the moneys 2 1 appropriated to the Bureau of Disaster Services in Section 1 of this act to 2 the Natural Restoration Fund. 3 SECTION 6. There is hereby reappropriated to the Military Division, the 4 unexpended and unencumbered balance of moneys transferred to the Natural Res- 5 toration Fund in Section 5 of this act for the period July 1, 1997, through 6 June 30, 1998, to be used only for nonrecurring expenditures related to the 7 Milo Creek Containment Project for the period July 1, 1998, through June 30, 8 1999. 9 SECTION 7. The unexpended and unencumbered moneys appropriated for the 10 Milo Creek Containment Project remaining in the Natural Restoration Fund on 11 June 30, 1999, shall revert to the fund sources listed in Section 1 of this 12 act, in the proportion each fund bears to the total moneys appropriated to the 13 Bureau of Disaster Services in Section 1 of this act. 14 SECTION 8. An emergency existing therefor, which emergency is hereby 15 declared to exist, this act shall be in full force and effect on and after its 16 passage and approval.
STATEMENT OF PURPOSE
SB1348
This bill is a fiscal year 1998 supplemental for the Military Division. Two issues are addressed by
this appropriation. The first provides for the payment of deficiency warrants in the Bureau of
Hazardous Materials which were issued to cover the cost of responding to a diesel spill in Sandpoint.
The second issue involves providing funding for the Bureau of Disaster Services to pay for the Milo
Creek Containment Project. This project is a response to last winter's flooding in the Silver Valley,
which resulted in contaminants from the Bunker Hill mine reaching Milo Creek, and flooding the cities
of Wardner and Kellogg. This project would help prevent Bunker Hill contaminants from reaching Milo
Creek, and would repair and expand the drainage capacity of the piping system under the cities of
Wardner and Kellogg, to prevent future floods.
