 1                                        AN ACT
 2    RELATING TO MOTOR VEHICLE REGISTRATIONS FOR RESIDENTS AND NONRESIDENTS; AMEND-
 3        ING SECTION 49-432, IDAHO CODE, TO DELETE REGISTRATIONS BASED ON WEIGHT OF
 4        VEHICLE AND MILLS PER MILE, TO PROVIDE ISSUANCE OF  NINETY-SIX  HOUR  TRIP
 5        PERMITS  AND  FUEL  PERMITS FOR RESIDENTS AND NONRESIDENTS, TO PROVIDE FOR
 6        MOVEMENT OF A VEHICLE BETWEEN LESSEE FLEETS AND TO MAKE A  TECHNICAL  COR-
 7        RECTION;  REPEALING  SECTION 49-433, IDAHO CODE; AND REPEALING CHAPTER 11,
 8        TITLE 49, IDAHO CODE.

 9    Be It Enacted by the Legislature of the State of Idaho:

10        SECTION 1.  That Section 49-432, Idaho Code, be, and the  same  is  hereby
11    amended to read as follows:

12        49-432.    TEMPORARY    REGISTRATION   BY   FOR
13    RESIDENTS AND  NONRESIDENTS -- FEES. (1)  All  motor  vehicles,  or
14    combination  of  vehicles owned by nonresidents and operated in Idaho shall be
15    subject to the same fees as are required with respect to like  vehicles  oper-
16    ated by residents of this state.
17        Vehicles  of  nonresidents  may  be  operated  without  the payment of any
18    license, use or registration fees to the extent that an exemption is  provided
19    in agreements or regulations for reciprocal privileges issued under and pursu-
20    ant  to  the  provisions  of  section 49-201, Idaho Code. If the nonresident's
21    state of residence grants temporary trip permit privilege in  that  state  for
22    vehicles from the state of Idaho, the nonresident operator of a vehicle or for
23    motor  vehicles or combinations of vehicles owned by Idaho residents and oper-
24    ated in this state, may in lieu of full licensing and registration  under  the
25    laws  of this state, obtain a temporary trip permit from the department autho-
26    rizing operation of any vehicle or combination of vehicles in the state for  a
27    period not to exceed ninety-six (96) hours.
28        There  shall  be  a  base issuance fee of twelve dollars ($12.00) per trip
29    permit on any vehicle or combination of vehicles over eight  thousand  (8,000)
30    pounds  gross  weight in addition to the following fees which shall be paid on
31    the maximum gross weight of the vehicle or combination of vehicles:

42     When a vehicle or combination of vehicles subject to registration is  to
43    be  moved  upon  the public highways in the state of Idaho, the department may

 1    issue a trip permit in lieu of registration for any vehicle or combination  of
 2    vehicles upon the payment of a fee as set forth in the following schedule:
 3        (a)  Ninety-six (96) hour trip permit
 4             Single vehicle.................................................$25.00
 5             Combination of vehicles .......................................$50.00
 6        (b)  Fuel permit ............................................$25.00 
 7        (2)  A  temporary  trip  permit shall be in a form, and issued under rules
 8     and regulations  adopted by the board, and shall be  displayed  at
 9    all  times  while the vehicle is being operated on the highways by posting the
10    permit upon the windshield of each vehicle  or  in  another  prominent  place,
11    where it may be readily legible.
12        (3)  The  department  may select vendors to serve as agents on state high-
13    ways for the purpose of selling trip permits where fixed ports of entry do not
14    adequately serve a respective highway entering the state. The vendor shall  be
15    remunerated  at  the rate of two dollars ($2.00) per permit sold, and he shall
16    collect the fees specified in this section, and pay the fees  to  the  depart-
17    ment.  The  vendor  shall guarantee payment by giving a bond to the state in a
18    sum as shall be fixed by the board, the premium on the bond to be paid by  the
19    department.
20          (4)  An  owner-operator  vehicle moving between lessee fleets where
21    the vehicle registration was issued in the name of the former lessee, shall be
22    eligible for a ninety-six (96) hour trip permit for movement from the point of
23    entry into the state to the destination of the new lessee's place of business.

25        SECTION 2.  That Section 49-433, Idaho Code, be, and the  same  is  hereby
26    repealed.

27        SECTION  3.  That  Chapter  11,  Title 49, Idaho Code, be, and the same is
28    hereby repealed.

Statement of Purpose / Fiscal Impact


STATEMENT OF PURPOSE

            This legislation would amend Sections 49-432, 49-433 and  Title
         49, Chapter 11, Idaho Code, to provide a flat rate schedule of fees
         to replace the issuance fee and mill rate per mile system currently
         in place for the issuance of 96-hour trip permits, for temporary
         registration.
   The proposed change would make the system easier for the
department to administer and monitor, and easier for vendors and
department personnel to use.  It would also allow for the issuance
of trip permits to be computerized instead of issued manually as
under the current system.
FISCAL IMPACT
The total increase in revenue is approximately $246,000.00. This
increase is based on the assumption that the exact same number of
trip permits and type of trip permits are issued under the proposed
fee structure, as were issued under the old fee structure.

Approximately $71,000.00 of the increase is a $2.00 fee that will be
kept by the vendors for issuing trip permits (currently allowed by
law).  The vendors issue approximately 67% of all trip permits.  The
remaining $175,000.00 will go into the Highway Distribution Account.
Total revenue is $175,000 - Distribution would be as follows: SHA -
$102,952.00; Locals - $62,598.00-1 DLE - $9,450.00.
