S1364|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE SENATE SENATE BILL NO. 1364 BY TRANSPORTATION COMMITTEE 1 AN ACT 2 RELATING TO COMMERCIAL MOTOR VEHICLE DRIVER'S LICENSES; AMENDING SECTION 3 49-306, IDAHO CODE, TO INCREASE THE FEE FOR COMMERCIAL MOTOR VEHICLE 4 DRIVER'S LICENSES AND TO PROVIDE FOR DISTRIBUTION OF THE INCREASE TO THE 5 PROFESSIONAL TRUCK DRIVER TRAINING FUND; AND AMENDING CHAPTER 1, TITLE 33, 6 IDAHO CODE, BY THE ADDITION OF A NEW SECTION 33-111A, IDAHO CODE, TO 7 ESTABLISH THE PROFESSIONAL TRUCK DRIVER TRAINING FUND. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 49-306, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 49-306. APPLICATION FOR DRIVER'S LICENSE OR INSTRUCTION PERMIT. (1) Every 12 application for an instruction permit or for a driver's license shall be made 13 upon a form furnished by the department and shall be verified by the applicant 14 before a person authorized to administer oaths. Officers and employees of the 15 department and sheriffs and their deputies are authorized to administer the 16 oaths without charge. A driver's 41 license or instruction permit issued on and after January 1, 1993, shall not 42 contain an applicant's social security number. Applications on file shall be 43 exempt from disclosure except as provided in sections 49-202, 49-203, 49-203A 2 1 and 49-204, Idaho Code. Every application shall also state whether the appli- 2 cant has previously been licensed as a driver, and if so, when and by what 3 state or country, and whether a driver's license or privileges have ever been 4 suspended, revoked, denied, disqualified, cancelled or whether an application 5 has ever been refused, and if so, the date of and reason for the suspension, 6 revocation, denial, disqualification, cancellation or refusal and the 7 applicant's oath that all information is correct as signified by the 8 applicant's signature. The applicant may be required to submit proof of iden- 9 tity and date of birth as set forth in a certified copy of his birth certifi- 10 cate and other satisfactory evidence to satisfy the issuing officer or the 11 department. If an applicant for a driver's training instruction permit cannot 12 provide a certified copy of his birth certificate at the time of application, 13 the department may issue a temporary driver's training instruction permit in 14 accordance with the provisions of section 49-305, Idaho Code. 15 (3) Whenever an application is received from a person previously licensed 16 in another jurisdiction, the department shall request a copy of the driver's 17 record from the other jurisdiction and shall contact the national driver reg- 18 ister. When received, the driver's record from the previous jurisdiction shall 19 become a part of the driver's record in this state with the same force and 20 effect as though entered on the driver's record in this state in the original 21 instance. 22 (4) Whenever the department receives a request for a driver's record from 23 another licensing jurisdiction, the record shall be forwarded without charge. 24 (5) The department shall contact and notify the commercial driver license 25 information system of the proposed application for a class A, B or C driver's 26 license to insure identification of the person and to obtain clearance to 27 issue the license. 28 (6) When the fees required under this section are collected by a county 29 officer, they shall be paid over to the county treasurer not less often than 30 monthly, who shall immediately: 31 (a) Deposit an amount equal to five dollars ($5.00) from each driver's 32 license or instruction permit application fees, application for a dupli- 33 cate driver's license or permit, classification change, seasonal driver's 34 license and additional endorsement in the current expense fund; and 35 (b) Deposit two dollars and fifty cents ($2.50) from each motorcycle 36 endorsement and motorcycle endorsement instruction permit fee in the cur- 37 rent expense fund; and 38 (c) Deposit an amount equal to three dollars ($3.00) from each fee for a 39 knowledge test in the current expense fund; and 40 (d) Deposit an amount equal to five dollars ($5.00) from each fee for a 41 motorcycle endorsement skills test in the current expense fund; provided 42 however, if a contractor administers the skills test he shall be entitled 43 to the five dollar ($5.00) fee; 44 (e) Remit the remainder to the state treasurer; and 45 (f) Deposit eleven dollars and fifty cents ($11.50) from each fee for a 46 class D skills test into the county current expense fund, unless the test 47 is administered by a department-approved contractor, in which case the 48 contractor shall be entitled to eleven dollars and fifty cents ($11.50) of 49 each fee. 50 (7) When the fees required under this section are collected by a state 51 officer or agency, they shall be paid over to the state treasurer. 52 (8) The state treasurer shall distribute the moneys received from fees 53 imposed by the provisions of this section, whether collected by a county offi- 54 cer or by a state officer or agency as follows: 55 (a) Two dollars ($2.00) of each fee for a driver's license or seasonal 3 1 driver's license shall be deposited in the emergency medical services 2 account II created in section 39-146A, Idaho Code; and 3 (b) Sixteen dollars and fifty cents ($16.50) of each fee for a seasonal 4 or class A, B, or C driver's license shall be deposited in the state high- 5 way account; and 6 (c) Ten dollars and fifty cents ($10.50) of each fee for a class A, B, or 7 C instruction permit or driver's license classification change shall be 8 deposited in the state highway account; and 9 (d) Six dollars and fifty cents ($6.50) of each fee for a duplicate sea- 10 sonal or class A, B, or C driver's license, class A, B, or C driver's 11 license extension, or additional endorsement shall be deposited in the 12 state highway account; and 13 (e) Four dollars ($4.00) of each fee for a motorcycle endorsement and 14 motorcycle endorsement instruction permit shall be deposited in the state 15 highway account; and 16 (f) Five dollars and thirty cents ($5.30) of each fee for a class D 17 driver's license shall be deposited in the driver training account; and 18 (g) Seven dollars and twenty cents ($7.20) of each fee for a class D 19 driver's license shall be deposited in the highway distribution account; 20 and 21 (h) Two dollars and sixty cents ($2.60) of each fee for a class D 22 instruction permit, duplicate class D license or permit, and class D 23 license extension shall be deposited in the driver training account; and 24 (i) Three dollars and ninety cents ($3.90) of each fee for a class D 25 instruction permit, duplicate class D license or permit, and class D 26 license extension shall be deposited in the highway distribution account; 27 and 28 (j) Five dollars ($5.00) of each fee for a class A, B, or C skills test 29 shall be deposited in the state highway account; and 30 (k) One dollar ($1.00) of each fee for a class A, B, C or D driver's 31 license shall be deposited in the motorcycle safety program fund estab- 32 lished in section 33-4804, Idaho Code.; and 33 (l) Three dollars and fifty cents ($3.50) of each fee for a class D 34 skills test shall be deposited into the state highway account ; and 35 36 (m) Ten dollars ($10.00) of each fee for a class A, B, or C 37 driver's license shall be deposited to the professional truck driver 38 training fund established in section 33-111A, Idaho Code . 39 (9) The contractor administering a class A, B, or C skills test shall be 40 entitled to thirty dollars ($30.00) of the skills test fee. A contractor 41 administering a class A, B, or C skills test may collect an additional fee for 42 the use of the contractor's vehicle for the skills test. 43 (10) The department may issue seasonal class B or C driver's licenses 44 that: 45 (a) Will only be valid for driving commercial vehicles that normally 46 require class B or C commercial driver's licenses; 47 (b) Will be valid for seasonal periods that begin on the date of issuance 48 and that are not to exceed one hundred eighty (180) days in a twelve (12) 49 month period; 50 (c) May only be obtained twice in a driver's lifetime; 51 (d) Are valid only within a one hundred fifty (150) mile radius of the 52 place of business or farm being serviced; and 53 (e) Will be valid only in conjunction with valid Idaho class D driver's 54 licenses. 55 (11) The department may issue seasonal class B or C driver's licenses to 4 1 drivers who: 2 (a) Have not violated the single license provisions of 49 CFR part 383; 3 (b) Have not had any license suspensions, revocations or cancellations; 4 (c) Have not had any convictions in any vehicle for any offense listed in 5 section 49-335(1) or 49-335(2), Idaho Code, or any one (1) serious traffic 6 offense; 7 (d) Have at least one (1) year of driving experience with a class D or 8 equivalent license in any type motor vehicle; and 9 (e) Are at least sixteen (16) years old. 10 SECTION 2. That Chapter 1, Title 33, Idaho Code, be, and the same is 11 hereby amended by the addition thereto of a NEW SECTION , to be 12 known and designated as Section 33-111A, Idaho Code, and to read as follows: 13 33-111A. PROFESSIONAL TRUCK DRIVER TRAINING FUND. (1) The professional 14 truck driver training fund is established in the state treasury and appropri- 15 ated on a continual basis to the state board of education which shall adminis- 16 ter the moneys. Money in the fund shall only be used for the support of pro- 17 fessional truck driver training programs which are offered by a public post- 18 secondary institution on a full-time, continuing basis and for which college 19 credit is given upon successful completion of the truck driver training 20 course. 21 (2) At the end of each fiscal year, moneys remaining in the professional 22 truck driver training fund shall be retained in said fund and shall not revert 23 to any other general fund. The interest and income earned on money in the 24 fund, after deducting any applicable charges, shall be credited to and remain 25 in the professional truck driver training fund. 26 (3) Revenue credited to the fund shall include ten dollars ($10.00) of 27 each fee assessed for a commercial driver's license as provided in section 28 49-306, Idaho Code.

Amending Section 49-306. The purpose of this bill is to stabilize
and guarantee the longevity of full-time, credit bearing
professional truck driver training currently offered only at Boise
State University. In addition, funding help will allow the program
to offer driver training statewide through the distance learning
network and to make the program more accessible by allowing the
lowering of the fees students have to pay.
Since the trucking industry is so vital to Idaho's economy, and
since there is a huge shortage of drivers, Boise State University
is committed to training as many people as possible for employment
in the industry through its College of Applied Technology. The
problem is that the program gets no state support of any kind, as
do all the other vocational/technical programs. The program must
generate in excess of $400,000 each year as a "break-even" point
which is now raised totally by the students taking the program who
pay approximately three times what the other vocational/technical
students pay at BSU for their training.
FISCAL NOTE
The 1997 totals are unavailable but the total new and renewed CDL
licenses issued for 1995 were 14,827 and for 1996 they were 22,888.
The average of the two years is 18,858 @ $10=$188,580. The Idaho
Transportation Department has estimated that an initial $4500. will
be needed the first year to set in motion the process of collecting
and transmitting the additional fee.
